On August 2, 2021 the business, Alere Inc, now owned by Abbott Laboratories, entered into a settlement with the The United States Department of Justice. The settlement settles allegations that the business from April 2010 until the end of 2016, Arriva, with Alere’s approval, paid kickbacks to Medicare beneficiaries by providing them “free” or “no cost” glucometers and by routinely waiving, or not collecting, their copayments for meters and diabetic testing supplies. Under terms of the settlement, the business agreed to pay $160 million to resolve allegations that they violated the False Claims Act. On July 8, 2021 the business entered into a Settlement with the Civil Division and the District of Maryland. The Settlement settles allegations that the business failed to disclose serious adverse health events in connection with the premature depletion of the battery in certain models of its Fortify, Fortify Assura, Quadra and Unify devices, which are implantable defibrillators used in patients at risk of cardiac arrest due to an irregular heartbeat. Under terms of the Settlement, the business agreed to pay $27 million to settle allegations under the False Claims Act that, between November 2014 and October 2016, it knowingly sold defective heart devices to health care facilities that, in turn, implanted the devices into patients insured by federal health care programs. This government action was for settlement purposes only and should not be considered as an admission of guilt or finding of violation of the law. For more details go here.
