I signed a contract for a full bathroom remodel in May of 2024. The deposit was made, and all items picked out. As of today, I have not had any construction and very little contact. You are unable to go to the physical address due to no one staffs this area. You only have one phone number to call, and the calls are never returned. I am beyond frustrated and just want my money back so I can find someone else to complete this project.Business Response

On May24, 2024, we, **** and *************************, signed a contract with Blue Skies Kitchen and Bath, *** represented by ************************* to renovate our guest bathroom to accomodate our paraplegic son. We paid half of the total, $3,846.32 by credit card in order to order materials. To this date (8/22,2024), absolutely no work has been done.Communication with the business has been vague, sporadic, and suspicious. According to their website, Blue Skies looks reputable but the internet can be deceiving. According to their Buildertrend app, we made selections of materials but we have no idea if they have been ordered.We need help to resolve this problem. I will see what materials we have purchased and what materials are returnable. Anything that we are unable to return will become your propoerty. I contracted Blue Skies Construction on 9/29/23 for home repairs, including: flooring removal; carpet/tile/wood floor install; drywall, cabinet, & woodwork repairs; as well as painting. The work occurred from 12/13/23 - 2/16/24. Despite their declaring completion on Feb. 16, many items remain unfinished: unpainted walls & trim; chipped baseboards; unstained toe kick/base shoe; poorly installed toilet (rocking); gaps in carpet; and more.The original contract was $14,055.80, of which I paid $13,027.90 (4 payments). On 1/12/24just before the 4th paymentthe owner told me that the estimate had been fully updated, and that after my 4th payment, there would be about $1,000 left for the final invoice. Afterward, however, I found many blatant overcharges totaling $1,498.97. These included: $343.13 to detach/reset a dishwasher they didnt touch; $271.43 for nonexistent "electrical work"; $284.59 to move furniture we had moved ourselves; and more. The corrected contract price should be $12,556.83, leaving Blue Skies owing me $471.07. Blue Skies manages projects using BuilderTrend. The home page shows the original (overcharged) contract price of $14,055.80, with unpaid balance of $1,027.90. However, the invoice page, which lists all payments, changed the contract price to $13,027.90the amount I have already paidwith a $0 balance, indicating their awareness of the overpayment. On 2/28 (BuilderTrend message), and 4/1 ******** I wrote Blue Skies requesting them to:- address the financial discrepancies; - complete the contracted work;- repair damage done to my woodwork;- redo certain items due to poor workmanship; and - send a completion report (necessary to recover depreciation from insurance) Blue Skies never responded.Between Feb. 12 and 16, Blue Skies deleted their BuilderTrend account, causing the loss of crucial project information. They created a new account, but only transferred the payment data, leaving me without access to essential documentation.Business Response

I am rejecting this response because Blue Skies' response failed to address:- the incomplete and poorly done work;
- the damage to my woodwork;
- the financial discrepancies; and
- the failure to provide a completion report.Furthermore:
- One of the attachments you provided to the Better Business Bureau contains a falsification that misrepresents the work and charges.
- It has come to my attention that your business has failed to renew their license with the state.
Discrepancy in EstimatesThe estimate that Blue Skies uploaded to the Better Business Bureau (2023-10-19-1135-1_Revised Draft.pdf) was an altered version of a previous estimate. I have received multiple versions of the estimate, but this is the first time I have seen the altered version that Blue Skies uploaded to the BBB. More specifically, line item 45 is different from every version that Blue Skies has ever sent to me.
In the "Kitchen" section, line 45 of the altered estimate that Blue Skies uploaded to the BBB (2023-10-19-1135-1_Revised Draft.pdf) reads as follows:
45. R & R tile floor covering TOTAL $2014.84
However, in the last version of that estimate that I was givenplease see the attachment February 2024 Revised Estimatethe same line item is listed as follows:
45. Install tile covering TOTAL $870.87
I had downloaded this estimate on February 4, 2024 The February version of that line item is the correct one, as there was no flooring to remove. My floor was bare concrete at the start of the work. (See attached picture, Kitchen Floor 12-13-23.)
Moreover, the number assigned to the estimate (2023-10-19-1135-1), which includes the date that the estimate was issued, is the same on both the recently altered version that Blue Skies provided to the BBB, as well as the copy I had downloaded in February 2024. **** number is printed on the bottom left of every page of both estimates. **** shows that Blue Skies has fraudulently altered the previous estimate. It is concerning that Blue Skies would retroactively modify the scope of work and costs in response to this complaint.
Unfinished and Deficient Work
Your response did not address the many tasks that remain unfinished or were poorly done. These include:- Unpainted walls and trim
- Chipped baseboards and door frames
- Unstained toe kicks
- Poorly installed toilet
- Gaps in the carpetOvercharges
Your response did not address that you had overcharged me and that you owe me a refund. The original contract was $14,055.80; I paid $13,027.90. I did not pay the $1,027.90 balance due to errors and misrepresentations in your original estimate: charges for services never performed, and overestimated measurements. I was overcharged by $1,498.97. After corrections, the actual contract price should be $12,556.83. Therefore, Blue Skies owes me $471.07.It is clear that Blue Skies deliberately misrepresented the charges. The home page for my job on BuilderTrend showed the overcharged contract price of $14,055.80 with an unpaid balance of $1,027.90 (see screenshot, BuilderTrend Home Page). However, the invoice page listed the contract price as $13,027.90, the amount I have already paid, with a $0 balance. (See screenshot, BuilderTrend Invoice Page.) **** discrepancy shows that Blue Skies is aware of the overcharge.
Sometime after I filed the BBB complaint, you deleted the BuilderTrend account entirely (see screenshot, BuilderTrend Inactive), leaving me without any access to what little information was left.Unlicensed Contractor
I recently learned that you have let your license lapse. (See screenshots: Filing History - License and GA Notice to Dissolve - Blue ************************ **** leads me to be concerned that you may never finish the work on my home.Despite my filing the complaint with the Better Business Bureau, you have yet to address even one of these issues. All of the above actionsin addition to your minimal responsedemonstrate a pattern of misrepresentation, poor workmanship, and a lack of accountability. I request immediate attention to these matters. The charges should reflect the original estimate, and the outstanding issues of incomplete tasks and deficient workmanship must be addressed. I look forward to your prompt response and resolution to these issues.

I'm not surprised that you rejected the response. You do not seem to want to admit that you were provided 2 estimates. The first was for you to submit to your insurance company for the necessary repairs. This estimate was in the amount of $25,217.41. You were then provided a second estimate for the work we were to actually complete, and this estimate was for $19,568.05. You agreed to this proposal as written. Please stop using both estimates to try and say we have discrepancies in our pricing. We only worked off the lower estimate.
Your reasons for rejecting our response:
1 - Incomplete or poorly done work
A - All work was completed as proposed within the proposal, however, there was a punch list you provided of items that needed to be addressed. Those items do not mean the work was done poorly. Its standard to have a small punch list, and nothing on your list would warrant the workmanship as poor or incomplete.
2 - Damage to your woodwork
A - Your casings on your doors were originally repaired in in poor quality. Installing "shims" is not the correct way to repair them, but rather to replace the entire casing. We will not do repair work that looks like it was completed by a 3rd grader.
3 - Financial discrepancies
A - We addressed every single one of the line items you considered a discrepancy in our last response. Just because you do not agree to it, doesn't make it incorrect. You keep providing a screenshot of the invoice page showing a zero balance. The invoice page "ONLY" shows your invoices and if they were paid or not. It DOES NOT show your contract amount. It shows you have a zero balance only on the invoices you received. It does not show the balance on your contract, yet you keep trying to use it for justification.
4 - Failure to provide a completion report
A - We will not provide you with a certificate of completion until you agree that our business together is finalized. Had you responded that you were accepting of our response and our business with the BBB is complete, then we would have provided that certificate.
Your "Furthermore" comment: We did not, nor have we ever provided documents that misrepresents our work or our charges. And yes, you are correct. Blue Skies Construction has in fact went into a noncompliance status and our license has expired. Blue ********************** Construction is no longer in business.
This will be our last response. We believe we have made our case with our first response and do not need to reiterate the same things over and over just because you do not agree with them. If you would like to receive a certificate of completion to submit to your insurance company for the depreciation, please let us know that our business together is complete and finalized. We will be happy to provide this for you.

I reject Blue Skies latest response. It fails to address:- Financial discrepancies;
- Incomplete/poorly done work; &
- Damaged woodwork.Financial Discrepancies:
You stated, We addressed every single one of the line items you considered a discrepancy in our last response. Patently false. Your 1-line response merely said, See attached documents; the attachments had almost no new information. The 3 documents you sent:- A copy of the 1st, original estimate (for filing insurance);
- A falsified version of the 2nd estimate (more on this below); &
- A copy of my own letter I had sent you via FedEx.So, your paltry response consisted of 2 documents I already had, plus a fake one. Nowhere did you address even one of the financial discrepancies, much less every single one.
In your most recent response, you said, You do not seem to want to admit that you were provided 2 estimates, and Please stop using both estimates to try and say we have discrepancies in our pricing. We only worked off the lower estimate. These statements show that you have not read my provided documents. In the Clarifications and Corrections document I had provided, all line items and amounts correspond with the 2nd, lower estimate.
Furthermore, you sent a falsified, 3rd estimate on 7/17/24 via the BBB, for a different amount ($20,712.02) from either the 1st (for filing insurance) or 2nd (that you were working from). As stated in my 7/24 response, you had never before provided this estimate to me. To be clear:
- The 1st estimate* you provided via email was for filing insurance. Total = $25,217.41.
- The 2nd estimate*, which you were working from, you had uploaded to BuilderTrend sometime in January, when you had told me that you had finalized it. It was for $19,568.05. This estimate, **** with overcharges and errors, is the main one in dispute.
- The 3rd estimate* for $20,712.02which you had never before provided to me until you sent it via the BBB on 7/17/24has the same file name as the 2nd estimate, but has 1 major change that was not on either of the first 2 estimates: You changed item 45, Install tile floor covering ($870.87) to R & R tile floor covering ($2,014.84)an obvious falsification. As you are well aware, there was no flooring to remove because the kitchen floor was bare concrete* at the start of your work. Because this new charge only appeared in your BBB
response, and never in any previous communication with me, it appears to be a deliberate attempt to inflate charges and retroactively justify overbilling. This is fraudulent. Please see attachment comparing the 3 estimates.(It is notable that when you added R&R tile floor covering to the 3rd estimate, you forgot to remove line item 48, Add for glued down wood flooring application over concrete ($419.72). Wood flooring application is needed for tile? This is further proof that the 3rd estimate is bogus.)
During a conversation in my home on 1/12/24, I had asked you about removing the charges from the [1st] estimate for the work that was not done, as well as correcting the measurements and other discrepancies. You told me: 1) you already did that; 2) the updated [2nd] estimate was final; and 3) there was about $1,000 left that I owed.
After this conversation, I went over this second estimate and found the many discrepancies. I sent you the list of financial corrections* on 2/4/24. This list showed that I did not owe you $1,000, but rather, you owe me $471.07! It is suspicious that less than two weeks later, your employee, *************************, abruptly and prematurely declared that the job was finished. No one from Blue Skies has come to my home since.
On 2/21, I re-sent the list of financial corrections* to the estimate. You did not reply.
On 4/1, I sent it again. No reply.
To date, you have not addressed:
- False charges for work not done
- Your overcharging me by drastically inflating certain measurements (one in particular was 2000% more than the actual measurement!)Incomplete/Poorly Done Work:
In your latest communication, you stated, . . . nothing on your list would warrant the workmanship as poor or incomplete. This is an outright lie:- Unpainted walls = incomplete work.
- Multiple gaps and cracks in planks = poor workmanship.
- A rocking toilet = poor workmanship.
- Gaps in carpet = poor workmanship.
- Missing transitions between flooring = incomplete work.
- Unstained quarter round throughout an entire room = incomplete work.
- Unpainted quarter round = incomplete work.

I asked in a text on 2/19.
I asked in a message on BuilderTrend* and a text on 2/20.
I asked in a text on 2/21.
I called you and asked directly on 2/21. (You had complained that it was a lot, and it would take longer than expected. You did nothing.)
I asked again via BuilderTrend* on 2/28. No reply.
On 4/1, I sent a letter* by *****; you received it 4/4. No reply.
Even after my filing this complaint with the Better Business Bureau on 6/18, as well as all the back-and-forth since then, you still have made no effort to complete or address the punch list.
Your dismissive response to my concerns about incomplete or poorly executed work is unacceptable. I have provided detailed descriptions and photographic evidence of the substandard quality of work, which cannot be brushed aside as a mere "punch list." These are serious deficiencies that need to be addressed.
Damaged Woodwork:
In your snarky response to me via the BBB, you said, We will not do repair work that looks like it was completed by a 3rd grader. So, your solution is to leave the edges jagged and chipped? (See pictures in FINAL Blue Skies Repair Redo attachment.) If replacing the entire casing was necessary to ensure quality work, I should have been informed up front. This would have allowed me to file a supplemental claim with my insurance company. Instead, you left the casings damaged and incomplete; this is both unprofessional & incompetent.Finally, I find it highly unprofessional and coercive that you would withhold a certificate of completion unless I agree to close this BBB claim without addressing the significant issues still unresolved.
Given the totality of these circumstances, I must insist that you take immediate action to rectify these matters. Your refusal to address the legitimate concerns *** raised, along with the fraudulent changes made to the estimate, leave me no choice but to consider further legal action.
Please respond with a clear plan of how you intend to resolve these issues. I sincerely hope we can find a resolution without escalating this further.
