    Nov 2023 Legendary Construction started to clear the property next to my home to build a new home. They trespassed on my property and removed over 50 trees. All trees that were removed were Oak trees at least 12 to 50 feet tall. I went over with the people clearing the lot where the property line was and told them any trees that are on the property line to not remove, I have the right to decide if that should be removed seeing half of it is mine. The worker ***** kept saying he knew where the line was and not to worry. I spoke with him multiple times about this, I had to go to all day meeting and when I came home my trees were removed. It was a Friday and they were gone already. On that Monday I saw the worker ***** and explained the problem, showed him where the property line was again and he said " oh wow, I fxxked up" I told him I want to talk to the owner. He gave me the owners number. Once he came out a few days later he said "I will replace three trees" I said I disagree on that total and he said seeing that we will be next door for the next 15 months I want to have a good relationship. He then said we will talk soon. I have everything in text messages, I was promised multiple times the trees were paid for and being delivered and nothing was done. I was lied to multiple times in text messages about the trees being installed, now the home is almost complete, the irrigation was installed and so was the lawn, but no trees or irrigation set up as promised. This builder is trying to get away with not holding up his end, they trespassed on my property, removed my property without my permission, been lied to multiple times had lawyers involved- the lawyer I used decided she was too busy to continue working with me to finish the case and now I have no trees that were agreed to be installed, and with the fence up now they will tear up my property installing the trees so that will be an addition cost

    The assertions by Mr. ***** range from incorrect to false.  A third-party independent contractor performed land clearing with clear instructions on what to do.  Legendary Construction did not perform the land clearing and is not responsible, nor liable for the alleged damage Mr. ***** indicates has occurred and that has been explained to Mr. ***** on several occasions.  Despite our lack of fault, Mr. ***** hired counsel and, in an effort to to resolve the matter (despite our lack of liability), we did discuss multiple resolutions, but, to date, he has refused to sign an agreement to bring this matter to resolution.  Mr. ***** is not our customer and we did not damage his property.  Mr. ***** is aware that "the worker" he references works for a third party company and is not employed by Legendary.

    Legendary Construction hired a subcontractor to clear the acre next door to me. The company  hired by Legendary Construction trespassed on my property and removed over 50 trees (Live Oak and Pine Trees). I pointed out multiple times to the "workers" where the property line was, and it was ignored. We came to an agreement of 10 20 ft Live Oaks would be delivered, installed and then watered by the neighbors well, and regrade my property that was tore up from them removing my trees. My property was regraded, but it was not very good. The holes where the trees were was filled in with sand, and if you step on that area you sink down over a foot and my land is uneven still.

    Legendary has sent over different settlement letters, which I signed and then was sent a new one saying they will install smaller trees than we originally spoke about, and that if I mention my experience with Legendary electronically I can be sued. Legendary and the subcontractor have told me multiple times ( I have the text messages showing this) that the trees were being delivered and installed and nothing has happened. The owner of Legendary just told me about  3 weeks ago the trees would be delivered and installed that Friday, and again nothing. I am not a customer of *****************************************, I live next door to home they are building, and the work they do should not affect my property, but it has. I just want back what was mine, and this company is being difficult to work with.

    I have not heard from them at all. I see the owner at the house next door, he has not said a word to me and no contact from his attorney.

    Mr. ***** has failed to respond to contact from our attorney on March 31, 2025.  Despite our lack of liability for the issues at his property, we have attempted to work with him to resolve them.  At this point, we have exhausted all attempts to accommodate him unless we can reach a written agreement to resolve this matter.
