      5/23/25 on the whatnot app, I began watching ******************* stream, KKCARDVAULT. Ill leave out the fact that these men commit fraud the entire 10 hour stream. ****** ***** ** autographed jersey certified by ***. Now, whether or not, this was signed by the man, he intentionally goes out of his way using this sudden death bidding system into buying what turned out to be, a counterfeit jersey. This is not *** licensed. By displaying it as he did, its clear the sports card dealer who sold tons of Braves cards that evening, was perfectly aware it was a cheap knockoff worthless jersey. It has no brand name. No *** logo. The man refuses to refund me, and has now taken to threatening me, and that Ill be banned from the whatnot app for voicing displeasure over a $210 purchase which by definition is trafficking counterfeit goods.m Altogether I spent $1500+ and a number of the items received were of subpar quality and not as they claimed near mint/better. They guarantee same day shipping, it took 7 days to ******* gets even better, after taking 12 days to receive this order, using their many accounts on ****, coincidentally they just happened to undercut every single card I bought by hundreds of dollars devaluing everything. They are also selling these same jerseys all over ****. Mind you, that weekend was the first time Ive ever used whatnot. These are tactics they use against new customers. I question the authenticity of everything I got from them. Since what I question doesnt matter, Id like to again state, the autograph is useless, as the jersey is a counterfeit. He says ****** ***** ** instead of ****** as if that absolves him from any wrong doing, despite the *** players association having the rights of their players. Any use of those names without expressed, written, consent, is illegal.

      Accusing us of committing fraud for a 10 hour stream: Our sellers start all auctions at $1-3 and the buyers bid on the live streaming app. We ship all items won.


      ****** *************** Jersey: The sellers put up for auction a ****** ***** ** signed jersey. They stated on the live stream that the autograph was *** authenticated. *** is a leader in auto authentication, and very well respected throughout the hobby. They show the *** authentication and the matching holo sticker that the jersey had. Not at any time did the address the jersey itself. They did not claim that it was an authentic *** or game used jersey. All they talk about is the autograph itself. They do not ever state the jersey is *** licensed.


      The displaying of the jersey: The jersey was displayed to show the autograph and the *** authentication, which is what was being sold.


      Stating that we use the "sudden death" system of bidding: These sellers do not use sudden death on their shows ever. You can also tell by the length of the auction that sudden death was not used and that the time kept resetting. We do have sellers that use sudden death, but this seller and show did not use this type of bidding. It is also an option of bidding provided by the Whatnot app. Some buyers like it and some do not. And no one is forced to partake in any certain type of bidding if they do not like the format. Sudden death options are typically 5, 10, 15, or 20 seconds. As you can see on the recording this lasted longer than that.


      Accused of threatening to ban him from Whatnot app: No seller has the ability to ban any buyer from the Whatnot app completely. Whatnot themselves are the only ones who can do that. Sellers do have the freedom to block sellers from their channel, which is what was done.


      Stating we guarantee everything ships in 1 business day: Our sellers do not state any shipping times except most shows ship within 1-3 business days. Whatnot automatically updates our shipping profile based off of our past shipping times and this updates daily or weekly. Whatnot requires us to ship within 2-3 business days. This purchase was made on Friday May 23rd at 8:59pm. Saturday and Sunday are not considered business days, therefore we typically ship Friday shows on Mondays and sometimes Tuesday, which clearly fits within the window that Whatnot requires us as a seller per our contract. We do not take 7 days to ship any show. Whatnot would not allow that. Also, once packages are picked up at our offices daily, we cannot control how fast they arrive to each buyer. 


      Undercut every auction and selling on ****: The sellers from that show do not even have access to our **** selling account so therefore, they could not be selling any jerseys on our **** account.

      JSA authenticates a signature, not the jersey.

      MLB Player Rights: The MLBPA holds the exclusive, worldwide rights to license and sublicense the names, numbers, nicknames, likenesses, signatures, playing records, and biographical data of all active *** players (collectively, "publicity rights"). This is especially relevant in situations involving multiple players, like a single product featuring three or more players or promotional uses with multiple players.
      Licensing and Enforcement: ***************** is the *****'s affiliate responsible for managing licensing and enforcing these rights. They work with licensees to develop player-licensed products and take steps to protect the positive image and reputation of the players. They also engage in legal action to protect player rights. 

      -You didnt just threaten to block me, you blocked me. 

      -The length of time shipping takes is inconsistent with the message I originally received from the seller immediately after opening the package. Additionally now using the term sellers is inconsistent from the original response on whatnot of we. 

      The video of the sale does correct my claim of it being a sudden death sale, which adds more time they couldve been honest about the product.  

      This standard blanket denial response is an evidence of consciousness, as they used a likelihood of confusion to misrepresent and now try to distance themselves from liability.

      I respectfully reject their response.

      To Whom it May Concern,

      We have once again, attached documentation to dispute the claim that has been filed against us. This is not a case of circumstance, but rather facts. The facts and procedures are attached and stated clearly.  The video and response submitted initially, clearly states the sale of the ***** autographed jersey in question, was always presented by our company as a *** authenticated autograph. Documentation to attest to the validity of the autograph on the jersey was shown and specifically mentioned during the auction. The authenticity of the jersey was not brought up or asked about prior to any sale. The sale and auction, as explained and seen, clearly are completely transparent.

      With regard to any potential refund of the sale, the claimant would have to go through the platform used for the auction. In this case it is, Whatnot. All of his payments and transactions went through this company, not ours. Once an auction has ended, sales and information are then taken over and handled by *******. We only proceed with shipping, even using the shipping labels they provide us. 

      There was no negligence or evasiveness in this matter. If you have any further questions or requests, please feel free to reach out. We are happy to help in any way to resolve this matter.

      I am rejecting this response because they just admitted its a counterfeit.
      Did you just say the authenticity of the jersey was never brought up or asked about? Is this actually real life? Im talking to a guy right now who is in the business 20 years, and sells specifically autographs, his response was exactly mine, there should be tags inside the jersey. There are no size tags. Now youre actually claiming that as a sports memorabilia shop, you dont think its important the jersey is licensed? Or even better, as a citizen of a country where selling this is a felony, you mean to tell me that you dont know what a licensed jersey is, OR, do you mean to tell me you dont care? ORRR, do you mean to tell me there is no difference in having a licensed and nice looking quality jersey to hang on your wall? ORRRRRR do you mean to tell me, that the profit margin having *********** sign a $6 jersey and selling it for 200 vs a licensed jersey is not vastly different? 

      Thank you for admitting you sold and trafficked a counterfeit jersey who cares if the signature is real its a garbage embarrassment of a product. You wouldve said hey I got this ******* jersey off dhgate and got ****** ***** to sign it, I wouldve gladly appreciated that information as it impacts the sale!!!! 

      I appreciate the BBB here, but you guys are giving me no choice but press charges and you just admitted to the crime.
