We did a walk around or property to discuss the project.What we discussed was removal of the lariope and mulch which was around our birdcage , removal of the bushes that were surrounding the two ** units, repair of two sprinkler heads,placing open coverage around the Ac units removal of the existing bushes at the front of the house As well as removal of ferns near the pool area, trimming the existing landscaping which had been cleaned up in March . So the landscaping was not horribly over grown The work was supposed to be started the last week of May, but was not started until June . May 23 we gave a deposit of $900.00 for the work to begin. On the walk around he had given me a verbal estimate of $1500.00 He then emailed a quote of $1850.00. As of June 5 work incomplete.Emails requesting payment went back and forth, With DPM requesting payment for the incomplete work. On June 17 he showed up we were not home and was hostile To the pet sitter, we were in Lakeland, He was demanding our Phone number from her which was odd since DPM had all of Our info. On June 23 sent a reminder - work still not completed.There is still old weed paper- They removed some mulch but Not all of it, and removed mulch from the side and front of which was not slated for removal. When I brought this up he said, it was Hard not to. Which made no sense. We had only discussed the removal of the mulch by the oak trees on the back of our property They sent us renderings that were not useable, for the front Of the house, I discussed in detail with **** that the front porch area must retain coverage due to the dog. The Ferns and bushes around the Ac unit were not removed until the 17 of July. We had a new Ac unit installed and the ** people had to work around the bushes . DPM demolished rocks that were set to soften the water runoff from our eves they are now not serving their purpose. And are not Aesthetically pleasing to look at. As can be seen by the emails we-haves do mulch been more than patient In trying to resolve these matters. Please see photos. DPM has not given us quality work, is threatening us with late Fees, and falsifying Documents that state we would pay these fees.The first quote that was sent to us did not include any specifics of their policy regarding late fee's.This was presented to us on aug 7th which I never saw nor did I sign. It was added onto the original quote may 23. Please see the attachments.My remaining bushes are uneven, there is mulch where the mulch was to be removed . And there is no mulch where there should be.The 3 renderings that **** sent us were unworkable and we will not be using them as we are not continuing to work with him.As of this date we have paid $1200.00 for this substandard and incomplete work.We have spent a great deal of time and effort trying to resolve this matter by email and telephone to no result other than threats for not paying for incomplete work. We do agree that some work was done, the sprinklers were fixed, the bushes were eventually removed 2 months after they began the work.All of our prior clean *** had taken a weekend to complete and we were charged in the $400 to $500 range.Business Response

1) Everything on her scope of work was completed. As per the mulch we made multiple trips back to satisfy her as she wanted every spec picked up which is impossible. Every time we came back to try and satisfy her needs she would ask for more money off the bill.
2) She wanted the project to start immediately upon payment and we let her know we were two weeks out (as we always are) and scheduled the job for June 2nd. When we came out. We came back out June 5th to finish up as the project took multiple days. ********************* was still not satisfied so we returned again June 12th, June 19th, and July 17th. We went above and beyond to keep coming back to satisfy her but it seems her only prerogative was to try and get free services.
3) Our company does not and has not ever done business "verbally" we send a contract through our CRM program that requires access through the email provided to us in order to sign. We sent the invoice to ******************** where ******************** signed the invoice.
4)The renderings did contain plants that provide coverage and privacy. Theplants need time to grow to provide full coverage.
5) All of our quotes include the same language for late fees. This was signed by the customer.
6) Our design fee is 300$ to create a design for the customer and includes one additional change to design. Not only did we provide one change, but 3 at no additional cost. We provided the service and expect to be paid for it.
7) They have not attempted to resolve things at all. We have called, emailed, etc and they ignored all attempts of contact to avoid paying their bill. The one time they did call was them refusing to pay their bill and cussing out our staff.
8) You knew the cost of our companies services before signing the quote so what another company charges is irrelevant. We did not force you to go with us.

I am rejecting this response because:
The response contains bold face lies! I take these lies as an admittance of guilt on their part. We never attempted to get money off the bill as it is portrayed and never sought free service. Also their stipulations and late fees were never sent in the original quote as you will read in the letter sent to them by our lawyer which I have attached here.

We did respond to this complaint weeks ago via phone. Not sure how that is not relevant as per our conversation we left at a resolution with the BBB that there was no harm or wrong doing done on our part as a company. This is simply a matter of a customer harassing our company defaming my character and slandering our company all because they dont want to pay there bill and still havnt paid there bill. Its a shame there isnt a better customer bureau as to make this matter fair i would like to make a complaint on Mr. and ********************* as they are what i would call the kind of customers i have nightmares about they dont communicate they dont pay there **** when you show up at there house (because they dont answer the phone) they are intoxicated and forget everything that was talked about they make things up that were never part of the original estimate and expect them to be done for free then when you do as they ask they still dont pay. I fell sorry for any contractor that works for or has to deal with them in the future. Its a shame that people like Mr. and ******************** take advantage of small companies like mine that are just trying to feed our families as well as the families of those that work for us then along with taking advantage they slander our name what a shame.Customer Answer

I am rejecting this response because:
The Facts Regarding DPMs Work
1. DPM did not deliver what was promised. Their work was sub par
and my property is in fact in worse condition (as is evidenced in the
Photos submitted).
2. The statement that every time they came back to and satisfy
My needs , I would ask for money off the bill is a completely
Untrue statement and a covert attempt to cover up , the reason
that they had to keep coming back;The work was not complete and poorly done. My only Intention was to better my landscaping .
2. I first contacted DPM In early May **** did say , he believed
He could start around Memorial Day . A lighthearted comment
I made , of wanting , the work done yesterday, is being twisted,
to suit their own need to portray us in a bad light and escape
taking responsibility for a job poorly done .
3. As to not doing business verbally, this is not entirely true, ****
And I spoke at length regarding, the project. And he did verbally
quote the sum of ****. 00 dollars. My husband asked me if we
Should hire them and sighed the quote for **** dollars we didnt
Discuss the amount. I have to say that was my mistake .
4. One of the main things is that the renderings are unusable.
I discussed at length with ****, that I must have coverage on my
Front porch as we are fostering my daughters Catahoula Leopard
Dog. And that complete coverage was mandatory. I absolutely stated this to ****. I also stated , to **** that if this were not possible, I would have to hold off on removing the shrubbery that is
In front of the porch. I was exceedingly clear on this.
So , why would he submit such an unworkable rendering is beyond
my compression.
5. Their 1s quote did not contain an info re late fee as evidenced by
Emails from them .
6 . They did not provide a service. Re: the renderings, as they are not workable and we are unable to use them . They are the exact
Opposite of what was discussed.
7. That we have not attempted to resolve this and not returned their
calls is an out and out lie as can be evidenced.
Working with this company has been a complete liability For the
following reasons:
1. All of the mulch was removed from the front of my property,
When I specifically stated , that I did not want it removed until
a plan was in place.
2. Where I wanted all the mulch removed a great deal of it is still in
In place. See photo.
3. The rocks that were placed under our eves to off set water run
Off were dismantled and left strong about the property on both the
North and south sides of our property.
This after DPM was told not to move them . See photo.
4. We made several attempts to resolve this matter as can be
Evidenced by phone calls and emails.
5. As for cussing out their staff, again a twisted version of the truth.
What I did say was, my property was left in a FIng mess.
This is not cursing out a person.
6. On July 17,2023 I was not at home. I was in Lakeland for a
Dental appointment. **** showed up unannounced , and aggressively demanded of my pet sitter, to give him my whereabouts and phone number. This is very odd behavior
as DPM has all of our contact information. The pet sitter was shaken by this . She then said, **** instructed his workers to
Leave that Fing S*** there. Then left leaving the debris.
My other pet sitter helped me clean it up .
7. We have no reason not to pay our bill as we are professionals
Who can afford it.
8. I will not ,however, be bullied in to paying for incomplete
Work , and useless renderings. Besides the other problems
Mentioned above. With their arbitrary, attempts to impose
Their Late fees on us. Which amounts to extortion.
9. DPM has been so unreasonable, that we have retained legal
Council.
10. We paid,1100.00 dollars, for a poorly done job useless renderings and a project that is sub standard .
