Advertisers must be prepared to substantiate such claims per BBB's Code of Advertising.
BBB's Code of Advertising Section 28 of the Code requires claims that relate to tangible qualities and performance values of a product or service can be used when the advertiser has substantiation. An example of a claim requiring substantiation would be "#1 car sales in the city." BBB's Code of Advertising Section 34 of the Code requires that claims relating to performance, energy savings, safety, efficacy or results for a product or service should be based on recent and competent testing or other objective data. BBB's Code of Advertising Section 37 of the Code requires “Made in USA” and similar terms used to describe the origin of a product must be truthful and substantiated. BBB's Code of Advertising Section 9 of the Code requires time limits sales must be observed. Lastly, BBB's Code of Advertising Section 14 of the Code maintains that the advertiser must clearly and conspicuously disclose this condition with the “free” offer, the advertiser must not have increased the normal price of the product or service to be purchased nor reduced its quantity or quality, and the “free” offer should be temporary; otherwise, consumers may view it as a continuous combination offer, no part of which is free.
