This complaint is being filed by **** ***** & ********* ***** (*****) against James G**** and J & J Pest Control (*****) because of a falsified pest report dated 10-07-2020. G**** was retained to perform a pest control inspection prior to the purchase of the property at *** ******** **** ****, *********, SC. G**** presented to ***** a pest control report that stated that there is no active or previous infestation of termites, old house borers, powder post beetles or other wood-destroying insects and there was no evidence of any fungi damage at *** ******** **** ****, *********, SC. All of which is not true. G**** presented ***** with an invoice for $80.00 for services rendered. On that same invoice was a work sheet for his proposal for routine services, such as mosquito treatment, quarterly pest control services and installing bait stations for termite treatment. After the purchase of the property was finalized, ***** contacted ** ************* to inspect the house for pests and give their estimate for routine services including mosquito control. ** ************* issued a report stating there are existing problems with a variety of insects including termites. ***** then requested that the Department of ********* Regulation inspect the property to find out what, if any, issues exist. Within a week *** ***** an investigator from the Department of ********* Regulation inspected the property. Then on December 30, 2020 he issued a report case file #************ that included pictures. Mr. ***** clearly stated that the report that G**** issued on 10-07-2020 did not comply with Section 27-1085K of the Rules and Regulations for the Enforcement of the South Carolina Pesticide Control Act in that it did not disclose termite damage, powder post beetle damage nor decay damage that was found at the time of G****’s inspection. ***** then had the house inspected by *** *********** who issued an estimate for repairs to damage due to decay fungi and mold that was noted by ** ************* and the state inspector. On 3/24/21 ***** obtained a judgment against G**** in the Laurens County Small Claims Court due to G****’s negligence in the amount of $7,500. Said judgment remains unpaid and Mr. G**** has not offered any proposal for repayment.
