  • On February 5, 2016 BBB sent correspondence to Fresh-Tops pertaining to a volume and pattern of complaints regarding late delivery or in some cases non-delivery of the purchased merchandise. Many complainants allege that merchandise is purchased via the company website at www.fresh-tops.com. Payment for the merchandise is taken immediately, then the consumer receives an email stating "the order will be shipped via USPS within 3 to 7 days, up to 14 days at the most". Consumers allege that a tracking number is provided via the same email, however, upon checking the tracking number repeatedly the consumer finds that the merchandise was never shipped. Some complainants allege receiving another person's order. When contacting the company they are told to pay for shipping and handling to return the merchandise. In such instances, consumers have requested refunds from the company and have received no response from the company. Additionally, some complainants allege receiving an email from the company 2 weeks after purchase stating the merchandise had been shipped with an estimated delivery date. When the merchandise could not be delivered to the consumer or returned to the company it was sent to a recovery center due to labeling issues. Upon trying to contact the company regarding their purchase, consumers claim the phone number is no longer in service. Consumers have also expressed difficulty contacting the company via email to request a refund. Many complainants allege no notification is received from the company indicating a delay in delivery. In accordance with the FTC's Mail, Internet or Telephone Order Merchandise Rule, companies are required to provide proper notification to the purchaser if there is a delay in delivery. To date, BBB has not received a response from the company regarding its volume and pattern of complaints.
