On June 3, 2014, the Bureau of Real Estate (BRE) issued a decision against Jason Barlett, JKB Financial, Inc. (JKB), and Eric Mercer. Barlett’s broker license no. 01724823 was revoked. However, the right to a restricted broker license was granted following certain terms and conditions. Mercer’s broker license no. 01846189 was suspended for a period of 60 days, however that suspension was stayed on the condition that Mercer meet certain terms and conditions. The decision also notes that JKB’s corporate real estate broker license no. 01865786 was voluntarily surrendered.
The decision became effective on July 8, 2014 following an accusation filed on January 11, 2011. The accusation alleges that during an audit period of January 1, 2009 through November 30, 2009, the company violated several BRE Regulations regarding the recording, reconciliation, and accounting of client trust funds. The company also collected advance fees without receiving a "No Objection Letter" from the BRE. Additionally, the accusation alleges that JKB conducted business under the fictitious business name American Modification Services without first registering the name with the Bureau of Real Estate, and conducted real estate business without registering a designated officer/broker of record as required. Incorporating these allegations, the accusation further alleges that the respondents failed to supervise and were negligent and/or incompetent when performing acts requiring a real estate license.
