On August 14, 2022, BBB of Western Pennsylvania requested that Gillece Services substantiate, modify or discontinue multiple advertising claims on their company website. Below are the outstanding challenges which can be found at https://www.gillece.com/ and each challenge below is referenced by its corresponding BBB Code of Advertising principle.

Principle #22 Asterisks
An asterisk may be used to impart additional information about a word or term which is not in itself inherently deceptive. The asterisk or other reference symbol must not be used as a means of contradicting or substantially changing the meaning of any advertising statement. Information referenced by asterisks must be clearly and conspicuously disclosed.
The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency. If the matter is being appealed or pending, it will be noted below.
On August 4, 2023 the Pennsylvania Attorney General’s Office announced developments in its ongoing lawsuit against Gillece Services issued by the Allegheny County Court of Common Pleas. On August 1, the Court found Gillece Services and its owner to be in violation of certain provisions of the Pennsylvania Home Improvement Consumer Protection Act and the Pennsylvania Consumer Protection Law.
Upon consideration of the Commonwealth’s motion for summary judgment, the court found in favor of The Commonwealth on Counts 3, 4 and 6, but denied its request for a summary judgment on Count 7. The Court found that Gillece Services and its owner engaged in the following misconduct: refusing to honor customers’ requests to cancel their home improvement contracts; penalizing consumers who cancel contracts; and failing to disclose and misrepresenting a customer’s right to cancel. The court also found that Gillece Services and its owner used advertising that made false and misleading statements about the qualifications of its technicians, and failed to provide itemized invoices to consumers .
The Court issued several permanent injunctions, requiring , among other things, that Gillece and its owner to: Permit consumers to revoke their home improvement contracts without penalty within three business days of signing; refund payments within ten days of cancellation, and clearly and conspicuously disclose in its advertising material terms and restrictions on certain of its offers.
According to the Commonwealth, the remaining issues in the lawsuit (Counts 1, 2 and 6) initially filed in 2020 will be tried at a later date. The assessment of civil penalties and /or restitution for the above-referenced violations shall be determined at trial.

In response to these charges, Gillece Services, in part provided the following statement to the BBB:
"Following the entry of Partial Summary Judgment and partial injunctive relief in the matter of Pennsylvania OAG v. Gillece, No. GD20-9374, in the Court of Common Pleas of Allegheny County, Pennsylvania. Gillece filed an appeal to the Commonwealth Court of Pennsylvania, on August 3, 2023, from the lower Court’s Order dated August 1, 2023 and the Court’s grant of injunctive relief. The remaining findings of fact and conclusions of law reached by the court are not ripe for appeal until the entire case has been adjudicated. Gillece does not agree with the findings and conclusions reached by the Court in its August 1, 2023, Order and intends to appeal those findings and conclusions to the Commonwealth Court when appropriate.
