David Hartman is an independent representative for Excell Communications. The follow report concerning Excell Communications was provided by the BBB of Dallas. Excel Telecommunications began business in the Dallas area in 1989. The BBB opened its file in 1989. This company markets long distance telephone services through independent representatives who participate in a multi-level marketing plan. Our file experience shows that Excel Telecommunications has been responsive to all complaints brought to its attention by the BBB. Most complaints alleging that independent distributors switched customers' long distance service without authorization, or used misleading selling practice when recruiting others. Other complaints allege non-receipt of refunds or difficulties resolving billing disputes. Excel has responded to all complaints by offering refunds or adjustments when appropriate. On September 23, 1996, Excel met with the Dallas BBB to describe steps it has taken to reduce complaints. In June 1996, the Federal Communications Commission ordered Excel Telecommunications to pay a fine of $80,000 resulting from allegations that on two occasions independent distributors switched customers long distance service without authorization. Excel states that it has severed its relationship with those distributors, who allegedly forged service request forms. The company states that it strictly prohibits independent agents in engaging in illegal activities of any kind.
