Right to Report


In the United States, BBB's right to develop and issue Reviews is protected by the First Amendment guarantees of freedom and speech and freedom of the press. However, U.S. law also provides a right to seek redress through the courts for publication of false and damaging information, provided the publisher acted with actual malice (that is, statements were made with knowledge that information was false or reckless disregard for the truth or falsity of the information) or sometimes with simple negligence (i.e. the statements were made without a reasonable level of care). In most circumstances, BBB may take advantage of the stronger protections afforded by the actual malice standard.
