            Government Action: BBB reports on known government actions involving business’ marketplace conduct:
            Department of Real Estate vs. Mynd Management Inc.
            On March 10, 2021, the Department of Real Estate filed an accusation (case H-12497SF) against Mynd Management, Inc. (MMI) along with the designated broker officer of MMI (Respondents).
              
            The accusation stems from audits conducted of MMI records intermittently between April 7, 2020, through May 29, 2020, covering the period 9/1/2018 through 1/31/2020. An accountability was performed on 5 separate trust accounts each showing a shortage in the account. It is alleged that the shortages to the accounts were done without first obtaining written permission from the owners of the trust funds accounts allowing balances to drop below accountability. It was also alleged that the respondents received undisclosed compensation from Wells Fargo Bank but did not disclose this to property owners as well as the broker did not exercise reasonable supervision over the accounts.
             
             On April 18, 2022, Mynd Management entered into an agreement to settle the above allegations.  According to the settlement agreement, licensing for Mynd Management and the designated broker officer of MMI are suspended for 60 days.  Thirty days of the suspension is stayed, provided that MMI and the broker pays a $1500.00 penalty.  Additionally, the broker and Mynd Management must pay a combined total of $17,857.40, for audits and cost of conducting the investigation.

              I was told by **** that if I spent $300 on the lock that was wifi I would not have to pay for rekey. I was charge over $700 and told I will have to pay more when my renter moves out. I had it professionally cleaned as recommended. They had the guy out and they made a huge mess in my house and then charged me $450. I called and took pictures of the mess they made. I was told I would not be charged. Then they took the money out of my account anyway and it took me months to get it back. I never did get the $400 back for the rekey

              I am shocked that this company has an A- rating after all the customer reviews. Quite possibly the worst property management company out there. I started working with them in October 2023 and so far they have done a terrible job of managing the tenant in my leased property. They continue to make one bad decision after the other.- Listing mistakes : They made huge mistakes when listing the property, listing it for a lower rent amount than agreed upon and allowing pets when explicitly told not to do so.- Constant pressure during tenant placement : In a down market, it takes time to place a tenant. They will repeatedly put pressure on you to provide incentives, reduce rent, etc.- *********** request management: They keep sending out technicians for requests that turn out to be a non-issue or things that the tenant can do themselves (e.g unlocking a garage door opener or replacing a light bulb). They completely ignore repeated requests to review all maintenance requests by the owner, then tack on and deduct high labor charges from the rent deposited every month.- Lack of clear communication and transparency: As noted above, their web portal is absolute trash. They give you cash flow numbers without a proper explanation of where your money is going. The property manager will promise you things without delivering on them.- Property manager has no control: It appears that the main person in charge of your property is simply a puppet doing nothing. They have no say or control over how funds are managed , withheld or distributed, nor over service requests. They are overloaded with properties ( one person managing 250+ properties) and hence do a terrible job of overseeing day to day affairs with any given property. - Withholding funds for phantom future expenses: They regularly withhold funds for service requests that have not been reviewed yet. These SRs may not even be approved, and the future cost is still unknown.
