All specific details as to dates, etc, are covered in the attached document "Explanation of the case." In short summary here, Benson's Appliances installed a dishwasher, which they damaged during the installation. The cannot be used because it leaks water (and did considerable damage to my house already.) Benson's refuses to back up their product installation because they claim that I, the home owner, "authorized" the installation with the full knowledge they could damage the machine in the process. This is just patently untrue. I was told that if they pushed the machine into the space available, it would be a permanent installation (i.e., stuck in there tightly) but under no circumstances would I have "authorized" an installation in the knowledge that there was a high risk of damage to the machine in the process. They cut up an removed the existing machine (which was still functioning) and thus had to know before cutting that the new machine was not going to fit - they only began "negotiating" with me about the space problem after they had permanently disabled my existing machine. Thus every step of "negotiation" from that point was essentially under duress - take it or leave it! Even so, I would not have "authorized" an installation with high risk of damaging the machine. I am assuming all costs for damage to my house, and for removing/replacing the tile floor in front of the dishwasher to facilitate installation. I am only asking that money I paid directly to Benson's for the faulty dishwasher, in the amount of $1170.16, be refunded in full.
