      Feb 24 2023 I found ******** Charitsis online/******. We discussed his experience and details of my case to see if he would be a fit as my lawyer We agreed to $7500 tax and fees included if settled out of court and $2500 all in if case goes to trial. I paid a deposit $1700 on Feb 24 and another partial payment on March 10 of $1300 On March 13 ******** emailed me a contract with a different price in the agreement for me to sign and confirm he will be my lawyer on file I contacted him immediately to point out the discrepancy in price that it was different then what we discussed and agreed on and asked to make the correction so I can sign the retainer confirming he will be representing me as my lawyer on file We went back and forth through email trying to come to a resolution. March 20 I was sent a email stating he will not take my case and that he is charging me for our initial intake conversation as a consultation and is charging me a fee of $849 court inquiry fee’s He didn’t receive my disclosure, didn’t talk to anyone in my behalf and didn’t go to any court proceeding as my representative. We only spoke one in the phone and after that conversation We discussed the discrepancy in price that he changed on me and I couldn’t accept I asked for my full refund since he didn’t do any work in my case outside of use having our first initial intake conversation to determine the if I would use his service and after to discuss the price change and that I cant afford to move forward with the price change in our verbal agreement I feel he took advantage of me in my most vulnerable time of need and charged me for work he didn’t do and was advertised as a free 1hr consultation He is abusing his powers as a lawyer and taking complete advantage of people in need of a professional lawyers help I would like my money back if not at least I would like him to be reprehended for his actions and not conducting himself as a law professional

      Client agreed to fees associated with legal representation in advance of sending initial payments. Screenshot attached shows that fees of $7500 PLUS HST were for resolution of matter before trial were communicated to client prior to the Law Office receiving any payments from him. Client now suggests that fees were inclusive of hst - this was never agreed to. Client was informed of daily trial fee of $2500 plus hst, and was advised that his matter was unlikely going to proceed to trial. Client is unable to produce any evidence of fees he claims that the Law Office agreed to. Client then advises that he cannot even afford the fees that he agreed to pay. Client unilaterally changed terms of agreement to $10,000 inclusive of HST for the entire legal representation. Client was advised that we could not honour that agreement as it was unreasonable. Client fails to appreciate the overhead costs associated with opening his file at our office. There are billables associated with time spent making notes about his version of events, time spent documenting memo to file, time spent giving instructions to senior law clerk, time spent corresponding with client, time spent by law clerk inputting matter into our legal software, costs associated with cancelling court date, taking away time slot from other paying clients (most service providers charge cancellation fee for blocking time slot that is not used), fees associated with administration of client trust account (bookkeeping costs, compliance fees with governing body etc.). In my opinion client entered into an agreement that he never intended to fulfill becuase he realized that he could not afford the services in the first place, and then unilaterally changed the terms of agreement after giving the Law Office instructions to proceed with commencing legal services for him. Unfortunately with had already been done prior to client changing the terms of agreement and the Law Office deciding not to proceed further with the client. We will give client and additional refund of $100, but this is in good faith, and not in agreement with client's version of events that transpired. ******* *********** ** ******* ************** **** *** *** ****** *** ********* **** **********

      i Clearly stated in submissions that he changed the price and he stated he would correct it and refunded with Im charging you fees I was not aware he would do that. 

      I can accept $700 refund and we can close this case. That is my offer

      Nothing in the additional correspondence is different than what our initial response to the complaint was. Client is unhappy about having to pay for legal services and requests a refund that is not acceptable.
