I inherited a house from my father, who took over the mortgage from my grandmother in 1994 (FHA), built in 1984. I recently had the property surveyed and discovered 9 ft of the house is on my uncle's property, and my aunt's drive way is on mine by 9 ft. Prior to this survey I had asked my uncle if he would sell me that part. He said No! I know I can apply for acquisition by prescription, but I wanted to know if any other party can be held liable for this, the previous surveyor, title company, builder, FHA?

The problem is with a lien for a 2nd mortgage that was paid off and we cannot get **** ** ******* to provide a release of lien so that we can refinance for a lower rate. We refinanced our home in 2007 and when doing so it paid the first and second mortgage off (closing docs confirm this). Afterwards the 2nd mortgage original documents were sent to us marked "paid". We have provided (4 times) a copy of the title search, a copy of the Paid Original 2nd Mortgage, a copy of the Title docs from closing indicating payment for the mortgages. **** ** ******* will not provide a release of lien that they have had on our home since 2007. Months later we are still trying every other day for assistance. We cannot seem to be able to be in touch with anyone who has knowledge or authority to make this happen.

I am buying a house that was sold 2years ago with full title insurance. Do I really have to pay the full amount of verifying the title? Isn't there a discount for recent title work already being completed? Thank you!

what is a reasonable time frame, after closing, for the title policy to be issued? I received a binder, or commitment but didn't ever receive a policy in almost two years of ownership. What's the reasonable time frame?

Purcchased my property in 1994 and in 2007 my husband suddenly passed away leaving me and 3 children behind. I was told by mortgage company I had mortgage insurance and loan should be paid and title should be mine. I called several Insurance companies that ******** (mortg co) told me I was insured with but just kept getting run around. My question is?????If I request a full title search on **** ***** ***** **** ******* ** ***** would there show that Mortg co failed the loan and sold my insurance and therefore I never was paid off.

When/if the title company finds an utility easement issue, will a bank still close on the home on time or will they require a letter from the utility co beforehand. And is that a liability for the bank?

Our title company never issued us an owners title policy. I called them to get it. They told me that I would have to pay to get it. I already paid for the policy at closing. Can they do this?

If you have paperwork showing that you paid for it then I would send a copy of that info to the title company and ask for next steps.

My adult daughter purchase 7 acres of land and she used a real estate attorney for the closing. He preformed the title search and she purchased title insurance. However, the attorney did the search one week before the closing and between the search and the closing a lien was placed on the property for 26,000 which was not detected nor disclosed at the time of closing. About two months later, another attorney sent my daughter a letter letting her know that he had placed a lien on the property prior to her purchase. Will title insurance cover this problem? Also, will they just give her the amount of her purchase or will they try to resolve this to where she can keep the land?
