BBB has received a pending government action from US Commodity Futures Trading Commission alleging the company and its sole member and manager Hendrik Van Beuningen have committed fraud, misappropriation and issuing false statement in connection with a commodity pool they operated. Participants of the pool allege that only a percentage of their investment was placed in the trading account and the overall trading of the pool funds were never profitable. The company despite their losses stated to participants a trading return of 19.14 percent for 2014 and a cumulative return of 31.77 percent.
