Complaint: Failure to receive a promised refund. In early 2012 I sent my 2000 Mercury Mountaineer to this shop to have my transmission fixed. I paid $2285 to receive a rebuilt transmission. The original problem was fixed, but another considerable problem was created within the same transmission. Over the course of a year, I returned the Mountaineer to be fixed under warranty but the mechanic could not figure out how to fix it. Also, during the course of this year, other problems were created like a leaky gasket and an extreme overfill of transmission fluid. Finally, after taking the Mountaineer to another mechanic on July 15, 2013 the transmission was fixed correctly when I received it on July 23. That mechanic charged me $767 without labor. I then returned to Atlas Transmissions to seek a refund. While I believe I deserve more, I reluctantly agreed to a refund, by mail, of $767 on July 26. As of today (July 30), I have not yet received the refund I was promised.
Desired Settlement: $767.00
from: ***** ******** <*********************>
Mr. ******** incriminated himself by acknowledging that my car needed to be fixed by another mechanic because Mr. ******** was unable to do so after many attempts during the warranty he spoke of. Also, on August 7, 2013, Mr. ******** gave me his word, through text, that he would not only reimburse the other mechanics bill of $762, but that he also "always stands by his word". And finally, I have an audio recording of Mr. ******** agreeing to reimburse me the $762 bill from the other mechanic from July 24, 2013.
BBB's Final Determination: The business failed to resolve the complaint issues.
