Complaint: My husband and I went to Liberty Tax service on Feb 7th, 2013 to have our taxes filed. We filed married joint and was told that we should have our refund within 21 days. My husband has restitution that is owed to the state of colorado so every year they hold both mine and his state taxes to pay for it. I inquired about how to stop them from taking my state refund as I personally do not owe this money. The tax preparer filled out a form called "injured spouse" but only found that is could be filed for the federal taxes not state. He was then instructed by myself and my husband to not file that form as this issue has nothing to do with our federal taxes. Our taxes were filed and I checked frequently on the website to see if our tax refund was ready yet. After waiting the 21 days I went to the Liberty Tax office to find out what the hold up was and they called a number to talk to someone directly at the irs. At this time I found out that the tax preparer had not listened to our instructions and the "injured spouse" form had been filed with our federal taxes. This was to hold up our tax refund by 11 weeks. I explained to them that we had run into hard times and needed that money to catch up on our rent or be evicted. We had until Mach 9th,2013 to pay beck rent. I was told to file a 911 form explaining the situation and would get my taxes within 7 business days. It is now April 1st, 2013. I still have not recieved my refund and Liberty Tax has refused to help me. I called and requested that they cut me a check for my refund amount as it was their mistake that caused this issue. I was told that they never would have filed that form without my permission. So not only did we loose our home I was also called a liar. I finally did get them to agree to refund the money spent with them to prepare the taxes but also can't recieve that until after my refund is issued by the irs. My husband and are are homeless and broke thanks to Liberty Tax Service

Desired Settlement: DesiredSettlementID: Other (requires explanation) I want Liberty tax to issue me a check for my full refund amount of 2145.00 regardless of if they have recieved the funds from the irs. This was entirely the fault of the tax preparer

Business Response: Consumer Response /* (-5, 5, 2013/04/03) */ Since the time I filed this complaint I have been back into Liberty Tax to have them get an update from the IRS on when my taxes would be in. They did this for me and we finally got an actual date as to when I would get my refund. The gentleman I talked to was very understanding of my situation and called to get approval for me to get some money because I have none. He was able to get permission to give me the petty cash they had on hand at the time and even took the 2 bucks he had in his wallet to help me out. This action alone was a wonderful resolution in my eyes and I thank him for his help. I really wish I had gotten this sort of help from the get go and the experience would have been a whole lot better. Up until that point I felt that there was nobody at Liberty Tax who care about our situation, but I found out that one person really did care. Thank you
