Complaint: regarding purchase of car. the company has not delivered title to the vehicle--more than 2 months after the date it was due. Undisclosed odometer tampering. Did not perform other terms of the contract, and refused to permit me to cancel and get my money back. Then I initiated an investigation with the State of Colorado auto industry division, and the investigator said that they cannot deliver clean title to the car and have agreed to unwind the transaction--this was more than a month ago, however, to date they refuse to refund my money or pick up the car. I continue to incur expenses for a vehicle I do not have title to and cannot drive. I need help getting this resolved.

Desired Settlement: I want them to refund all of the money I have paid--including costs of insuring the car, interest on the money they are holding, etc. I want them to come pick up the car--they brought it to ****** and the contract was done in ******. I have no way to return the car to them by myself. Need this to happen immediately.

Business Response: We regret that there was a misunderstanding between Ms ******** and Poudre Sports Car.   Ms ******** did not receive her title immediately due to a clerical error made on an out of state, non-reassinable title.  This required us to find and contact the former owner in Wyoming, which proved to be difficult.  During which time, Ms ******** stopped payment on approximately 50% of her invoice.  Despite that, we still made efforts to acquire her a new title.  After a lot of back and forth between the State of Colorado, we received the correct title, which has been delivered to the address she provided via USPS trackable mail.   

While trying to obtain a new title, we offered to purchase the vehicle back from Ms ******** at full purchase price, with no penalty for mileage or time.  Our offer was rejected, and countered with a
demand for an amount of 150% of the purchase price by Ms ********. Furthermore, we were instructed to wire the money to an account prior to receiving the vehicle.  Additionally, we were told by Ms ******** that if we did not meet her demand of 150%  of the purchase price by the close of business the same day, she would increase her demand to approximately 450% of the purchase price. 

Odometer Tampering is a serious charge, and implies a physical molestation of an odometer display.  We believe Ms ******** is conflating Odometer Tampering and a mis-penned clerical error.  To clarify this, Ms ******** was provided service records from both the prior owner and a different service business in the area, both of which displayed mileage prior to purchase.  The reported mileage matched the advertised mileage and the mileage on the paperwork.  The source of Ms ********’s confusion came from the clerical error on the title, indicating 89,000 miles instead of the correct 93,134.

 
We continue to work to resolve this issue through any reasonable means.   

BBB's Final Determination: Business offered a resolution. Consumer did not pursue further with BBB and the matter was assumed to be resolved
