Complaint: oliver adjustment is on the national no call list, I have told them not to call********** but contact me by mail, but the brain dead people keep calling

Business Response: This is the first notification that we have received regarding this person.  We have marked our files accordingly, and we will no longer attempt to contact Mr. ****** by phone.

Complaint: Are debt was turned over to a lawyer's office and a letter was sent to us that we could face court costs if we did not pay. The debt was paid and I called Oilver's to see what determine when a debt is turned over to a lawyer? I explained to her that I knew of someone that had a debt with them just as old mine, owed more and they had not made any payments in over a year (there was activity on our account within the past year) and they did not receive a letter in the mail. I never gave her their name and just wanted to know what determine when it's turned over. Ms. Laura Black at that time told me "that it was none of my business."

Desired Settlement: Your website under "values" indicates that you "Treat individuals with care, respect, dignity and fairness." I do not feel you stand by that statement.

Business Response: We spoke with the employee that dealt with Ms. *****.  Our collectors are trained to never discuss another person's information and financial situation with a 3rd party, therefore our employee correctly handled the situation correctly.  

Consumer Response:

I did not want to know about the other person. I wanted to know what was their policy when a account is transferred over to a lawyer's office. I was confused when I made payments and the other party had made no attempt to pay for some time and their debt was just as old. I still do not know your policy. At this point it sounds like you pick and choose.

Better Business Bureau:

I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

Business Response: There is no "one size fits all" rule for when an account is sent for legal action.  Generally speaking, if we are able to verify that a debtor is employed and appears to have the means to pay (but has not responded to numerous attempts from our collectors), we may refer the matter to our attorneys.  In your case, you are/were gainfully employed, and were not making sufficient payment arrangements, so we sent the charges to small claims court.  In your friend's case, we likely are missing information on file that indicates they have the means to pay the past due charges.  If we do discover in the course of our collection efforts that they are gainfully employed, we may then take legal action to protect the interests of our client.

Complaint: I told this company that this was a workman's comp bill and I am not responsible and send it to them never received a call back and they automatically put it on my credit report that is bad business now I have a mark on credit for a debt of 157.00 that is not mine to pay

Desired Settlement: I want them to remove this from my credit reports immediately and they pay the debt or pay me 157.00 for screwing up my credit

I informed Mr. ****** that we do not have any open current or past charges in our system under his name.  If he ran a credit report on himself, he may be confusing us with ****** out of Milwaukee (that has happened many times in the past).  There isn't anything else we can do for him at this point.

Business Response: We did locate the charge that Mr. ***** *** is disputing.  We have requested copies of billing statements from ****** ******** ******, and any other documentation related to the charge.  Once we have the materials in our office, we will forward copies to  him at  **** *********** **** ***** **  ******

Complaint: To begin with, this debt collection company calls then drops the people they call into a queue line and they then have no clue who they just called. When I ask why they called they asked for the number they called me at. To attempt to get them to leave my phone number alone, again, I tell them. They then refuse to identify the first name of who they are looking for, why they are calling and who they are. From past experiences with this company, and complaints made with the State I have found their practices are not in line with the guidelines for a debt company. After demanding that they identify themselves, they finally do, and then after many minuets of demanding the first name of who they are looking for they finally give it, and this person who like so many in the past is not at the phone number they called at. I have filed another complaint against them with the state for their incorrect practices and harassment (they call before 8am and after 8pm). Finally when I made clear if they did not remove this number I would file complaints they said they would remove the number.

Desired Settlement: This complaint is in response to them calling after I told them never to again. And for each successive call they make I will file another complaint with the state and here with the BBB so that they may either correct their practices or understand that harassment and badgering innocent people comes with penalties. The outcome I am looking for is nothing other than that they confine themselves to proper rules, regulations, and guidelines in preforming their business, and now as a more informed citizen I will make sure if they continue calling and not adhering I will keep on pressing these complaints along with those who live here.

Business Response: Thank you for making us aware of this complaint.  We will make the necessary changes to preventing a similar situation in the future.

A little back ground first on our business.  We are a 3rd party collection agency that specializes in medical collections.  As such, we are governed by HIPAA, FDCPA, FRCA, and the new CRPB rules and regulations.  The person making the complaint with you about us is no doubt angry about our unwillingness to share information with him (privacy laws prevent us from exposing too much information to a 3rd party).

Our records indicate that we have placed calls to the complainants home phone for him, as well as for another person that lives (or lived previously) at the same address and phone.  In an effort to protect that person's privacy, we give minimal information to any 3rd party that we communicate with (even if they could be related to one another).  If pressed, we will identify ourselves, but we will not state the reason for the call, or give any other details to a 3rd party without the consent of the person we were attempting to contact.

We dispute the complainant's assertions that we have harassed him by calling his home prior to  8:00am  and again after 8pm (our hours of operation are M-W-F  8-5 and Tues. & Thursday  8 - 6:30).  There is literally no one in our office at the times he claims calls were placed to him.  Perhaps he is confusing us with another collection agency that may also be attempting to reach him. 

We also strongly deny that our business practices are not in line with the guidelines for a debt company.  On the contrary, we go to great lengths to protect the privacy of those that we attempt to contact for collection purposes.  The fact that we have never been sued for any of our business activities in our 66 years of existence is proof positive of our desire, and ability to perform our business within the established guidelines for our industry.

In closing, we have removed the claimants phone number from our files, and will only contact them (if necessary) by letter from this point forward.
