Complaint
We hired All-N-1 to install a rain garden with connection to sump pump and plant a tree. They are now claiming they are bankrupt (although no filing)
We hired All-N-1 to plant a new tree, attach a sump pump/downspout connection to transfer rainwater to a rain garden they would design and install. Initial work was completed in **********. The tree initially planted was dead and did not leaf out. Multiple calls finally resulted in someone coming out to check, and they agreed to replace. They delayed and dodged email messages for months, finally agreeing to replace in **** but saying they wouldn't do so until fall because it wouldn't be conducive to the tree living. We waited and re-contacted in *****t to get on their calendar. Again, multiple emails were evaded and times pushed further and further out with more excuses. We finally had the tree replaced in *******. The replacement tree was also clearly dead upon planting, which they assured us was not true and it would "perk up" in the spring. It had no leaves, even though other trees of the same species still did. Its branches were brittle. In installing the tree, they damaged the connection to the raingarden as well as did not mulch the tree and made deep tracks in the backyard with their equipment. We contacted them to repair and address. They apologized and came to put much down within a week, claiming they'd "get us on the calendar" for the other repairs. We emailed them periodically throughout the fall and early winter and again in early spring. We were promised repairs beginning in ********, but our emails to ask for specific dates to repair were evaded or put off. Finally, we threatened legal action in *****, which prompted a detailed apology and response. Even so, no repairs were made by the date promised. We contacted them again to ask for a status update, at which point owner ************ indicated the company was no longer in business and any effort to make a financial recovery from them would be futile because they were bankrupt. All-N-1 is owned by a ****** corporation "***********************" which also owns another ******-based landscaping business. Neither All-N-1 nor the ****** business have taken down their websites or social media pages. There has been no discoverable ********************** bankruptcy filing. Our suspicion is that they are saying this to avoid making promised repairs and replacements.

Desired Settlement
We would like the cost of removing the dead tree and replacing it with a tree of a similar size and species as well as the cost of repairing the damage they caused. We estimate these costs to be roughly $*****.

All-N-1 is under new ownership as of **************. ******************************** purchased some of the assets of All-N-1 in a "fire sale" fashion as the business was under financial distress and acquired a minimal number of staff. As part of the purchase ********** did not assume any liability for warranty claims of work completed prior to **************. Further we are no longer servicing the ******* County area, strictly ******** and ******. That said, we strive to take care of customer's and do not want situations such as this to reflect negatively on the business. We are in the process of addressing how claims such as yours shall be handled and talking with All-N-1 nursery suppliers to see if they will work with us on plant replacement. I have minimal information aside from what you put in your BBB claim as ***********, and your original designer are no longer involved in the business.
