              We used Jefferson Title (JT) to purchase a property in Jefferson County. Despite our agreement to close on April 30, 2021 – and the fact that we did our part promptly (signed closing documents on 4/28, wired funds on 4/29 ) -- our transaction did not close until May 4, 2021, primarily due to JT’s poor quality control and shoddy performance. Our lender, Cherry Creek Mortgage/Blue Spot Home Loans worked very hard to get the loan documents to JT in order to close on the agreed-upon date of April 30, 2021. Per JT's advice, we also agreed to: 1) Sign the closing documents on April 28 to ensure a 4/30 closing, and 2) Complete the signing via a mobile notary -- arranged by Jefferson Title -- at an additional cost of $250 in order to close on time. These decisions, including the new 4/30 closing date, were communicated on 4/26/2021 to Carolyn Harding, the escrow officer in charge of our transaction. AT NO POINT during our (and our lender's) communications with Carolyn did JT/Carolyn express any concerns about closing on 4/30; in fact, Carolyn told me that 4/30 was feasible as long as my lender "got the documents to JT on time," which Cherry Creek/Blue Spot did. Email thread available as evidence upon request. Both seller and buyer suffered financial losses as a result of the delayed closing: We had to compensate the seller for 4 days of rent (the property is currently rented; had the sale closed on time, we would have received that rental income) while the seller was forced to delay their plans to pay off their loan on the property. JT’s mistakes are primary reason for the delayed closing, key among them being: 1. Lost Documents/Late Notification JT notified me at 1pm on 4/30 (closing day) that they had not received the documents we signed, and they were unable to locate them (UPS tracking # wasn't showing the documents as having been scanned into the UPS system). At 2:09pm JT emailed to say that the documents would be delivered later that day but by then, it was clear that we would not be able to close on 4/30. 2. Missing Initials At 6:59pm on 4/30, JT emailed that they had the documents but some were missing initials. They would e-send the documents for us to e-sign on 5/1. They did and we promptly signed. 3. Poor/Lack of Communication i) My lender called on 4/30 to complain that, despite multiple attempts, they hadn't been able to contact Carolyn or get response for the past 24 hours, so closing would be delayed. ii) JT only confirmed our mobile notary appointment on 4/28, the day we were scheduled to sign closing documents. Prior to 4/28, we had no idea what time we'd be signing or how to contact the mobile notary ... despite several emails to JT asking for such info. I have contacted JT to request financial compensation for costs that I incurred as a result of their mistakes but they declined to take further action, instead citing the fact that our sales agreement listed May 25, 2021 as the closing date. While that is true -- we selected 5/25 because JT told us it would "take up to 60 days to close," it's important to note that JT did NOT push back or raise any concerns when we and our lender separately contacted them on 4/26 to request a 4/30 closing. As such, I strongly feel that JT is responsible for the 4-day delay in closing and would like compensation for financial losses the seller and I suffered as a result of JT's failure to perform.
