Complaint: Advertisements mailed out regularly indicate a filled hot tub in women's locker room of new remodel. This tub has been in place and not filled for about a year. Manager has said repeatedly this is because the "city" does not have time to come out and inspect.
Desired Settlement: This gym advertises services that do not exist, specifically this hot tub in the women's locker room. I would like the city to complete their inspection and arrange this tub be filled, if indeed the city is the hold up on this project.
Business Response: Initial Business Response /* (1000, 5, 2014/05/06) */ Ms. ***** renewed her Prestige single membership on 05/02/14. At that time, she was informed that the hot tub located in the women's 3rd floor locker room may not be used until King County approves our application for a variance, which stems from our contractor's failure to comply with a precover inspection and other compliance issues. We apologize and remain committed to doing everything possible to expedite this process. However, we did not advertise or guarantee a date that it will be operational. Instead, we made it clear to her and other members and guests that we are waiting for the County to approve our request. In fact, we posted a sign above the hot tub informing everyone about the status of it. Therefore, since Ms. ***** was clearly aware that we are waiting for permission to operate the hot tub and we have not advertised or provided her or anyone else with a specific date when or if that will happen, neither her or anyone else has been harmed. Moreover, in the meantime, we have 2 other operational hot tubs, located on the 1st and 2nd floor, for her and other members and guests to use. However, we are willing to provide Ms. ***** with a full refund, if she requests to void her contract and cancel her membership within 3 business days, which is plainly stated in her membership agreement and has been our policy for 35 years.
