Complaint
Failed to obtain required Building Permits and poor workmanship and defects.
Bath and Kitchen Gallery did work in the kitchen, major remodeling in the master bathroom, work in two other bathrooms, and work in 13 other rooms in the house. Within months, several rooms had failures. Within two years, the failures expanded to over five rooms in the house. Within three years, failures and defects in workmanship have been found in every room of the house. We discovered that they failed to obtain building permits (at least three permits were required for the scope of the work) so their work was never reviewed by the Temple Terrace Building Inspector. We believe that, had the work been inspected, most of the major construction defects would have been caught. We have spent more than $42,000 more in repairs and remodeling because of Bath and Kitchen Gallery's poor workmanship, and that's only the beginning of the money we will have to pay out to fix all the problems.

It appears that Bath and Kitchen Gallery cut many corners and didn't properly supervise the job. It makes me wonder that if they were willing to cut so many corners on a project that cost over $260,000, and violate building code, what will they do to your house? It took months and months of nagging to even get the owner of Bath and Kitchen Gallery to come to the house to see the failures. We are most likely headed to court and have spent thousands of dollars to date in attorney's fees, construction expert witnesses, and consulting fees. I would strongly recommend you do not use Bath and Kitchen Gallery! I also recommend you check online as they operate another company under the same contractor license number.

This customer never hired the Bath and Kitchen Gallery, Inc. to work on this property.They never paid the Bath and Kitchen Gallery any money. They never signed a contract with the bath and kitchen gallery. We did work at that address for the previous home owner. WE did not do all the work at this address. The previous home owner hired other contractors to do work on this propety. WE have site inspected the property and lack of maintinaance is the main issue we saw. THis complaint should be removed as the ***** blame us for work we may or may not have comleted. They did not hire us, they did not pay us. They are lying about the time frame. AS they did not own the home during the remodeling process. They bought the home 2 YEARS after we worked on the home. We were direced by the prior home owner, and completed work at his direction. No codes were violated by us.
Just ask Mr. **** to produce a contract he signed with us! He will not be able to product any contract.

The Bath & Kitchen Gallery is the company that did all the work that we are having numerous problems with. The work was completed on behalf of the prior homeowner, but we did try to have Bath & Kitchen Gallery come onsite to review these problems during the warranty period. However, they refused to come and would not return numerous phone calls or emails.

Florida law provides that the work done must be done in accordance with the law and failure to do so allows the future homeowner to take action.

It is my hope that the BBB would like to inform those that use (and trust) the site that there is an issue with Bath & Kitchen Gallery. This is similar to Bath & Kitchen Gallery's request to Angie's List that this be squashed, but Angie's List truly wants their members to have all the information. It's my hope that the BBB does too and records the complaint in the BBB public history as well as adjusting their rating. I hope that the fact that they pay to be accredited doesn't "buy" them an unbiased standing with the BBB.

Regarding their comment that "lack of maintenance is the main issue" is nonsense. They left three holes in the foundation exposing the raw earth to the house, then covered the holes they left with tile. They failed to treat the soil by a licensed termite company as required by building code. As the homeowner, what "maintenance" am I supposed to perform that will fill the holes under the tile? They failed to apply the correct material to the tiles and tiles are falling off the wall and popping up of the floor. Again, what "maintenance" does a homeowner perform to correct improperly installed tiles? Bath & Kitchen Gallery failed to pitch the shower pan so water doesn't drain. That has nothing to do with homeowner maintenance or upkeep. This is just a small list of the issues.

As requested, I've attached a copy of an email that Bath & Kitchen Gallery sent. I took the liberty of underlining the section where they admit liability and ask to be released of further liability. The same letter asks us not to inform the City government or State of Florida. Why would they admit liability if they had none? Why would they want to avoid the City and State knowing about the work if they did take out all required building permits. They are liable and they did fail to take out a permit to move two drains, failed to take out a permit to redo numerous electric outlets and lights, and failed to take out a permit to move numerous plumbing lines.

There are several other documents including some from their attorney. I hope ***'s email, letter and document is sufficient, but if needed, I may be able to provide other documents that are prepared by attorneys if this doesn't get resolved outside the court system.

If you think it would be helpful, the third party that was present when *** admitted he did the work, admitted he did it improperly, and admitted he knowing avoided taking out permits is more than willing to discuss this with you. Just let me know and I'll forward their contact info.

WE did not contract to do work for this person. They did not pay us a dime. They bought the home after any warrenty period was over. All of the problems they listed are not our doing. The Bath and Kitchen Gallery, only offered to do an exploritory demo of the job to detimmine if this was the result of our work or not. And then to fix what we felt was our doing if anything. This offer was turned down. This was more than fair. This this person just hates the colors, materials and finishes picked out by the previous owner. They have wanted to change all tile, countertops, cabients from the day they bought the house. They are just trying to find someone else to pay for it. They just want a blank ck so they can remodel and change the colors and finished to their taste. They are not our customer, they did not pay is a dime. I would bend over backwards for my customers. However I will not be conned by someone who never hired us to do any work and never paid us a dime.
