December 6, 2007, the company filed for reorganization under Chapter 11 of the federal Bankruptcy Act, case number 079024. This permits the company to continue to operate with court supervision while developing a plan of reorganization. Those with monetary claims against the company are advised to obtain a Proof of Claim form by writing to U.S. Bankruptcy Court Middle District of Tennessee, 701 Broadway, Nashville, TN, 37203 for resubmission to that court. According to information provided on Dec. 12, 2007, to your BBB by Wendy Reiss, an attorney representing Sofa Express, motions are filed with the bankruptcy court to allow an auction on Dec. 19, 2007, to sell the assets of Sofa Express to a liquidator. Depending on the terms reached through that sale, the liquidator will conduct going out of business sales that will likely begin in December and may continue through February 2008 leading up to the closing of all Sofa Express stores, she said.

Also on Dec. 12 the court issued an order granting the company's motion to continue certain customer programs and commitments pending liquidation of the assets of Sofa Express through the last day of the going out of business sale. Gift certificates, Sofa Dollars and credits will be accepted and honored through the going out of business sale and any consumer who has not used their gift certificates, Sofa Dollars and/or credits shall be eligible to file a proof of claim for the value, according to the order. And
Sofa Express is to post prominent, clear and conspicuous notices in each store explaining and notifying consumers of its customer programs.

The liquidating agent is also ordered to post ample signage and inform all customers purchasing merchandise from the liquidating agent in Sofa Express stores that all sales are final. The liquidating agent will not provide refunds or merchandise credits or accept exchanges with respect to any merchandise purchased from the liquidating agent in the Sofa Express stores.

Any change in the customer programs must be provided to the respective Attorneys General's Office where the store is located and the Tennessee Attorney General's Office with the opportunity of at least five days notice that such matter may be heard by the bankruptcy court, according to the order.

Employees said they learned stores were closing on Dec. 4, 2007, when they received a letter from Sofa Express giving employees 60 days notice to find new employment, but did not specifying when stores would close.
