Neglected to repair engine after money paid up front, and now continues to bill further.
Paid Advantage Tire and Auto's owner(*** ********)$1100.00 up front to repair engine issues on my 2007 Chevrolet Silverado. After 2 weeks and very little effort from *** to contact me regarding my truck, He finally called. He said "Come pick it up, I have your truck finished". When I went to pick it up, I was given numerous reasons as to why it had been doing what it was doing. He named things like oil consumption due to a manufacturing defect, bad gas, bad piston, bad coil packs etc. After driving my truck just a few blocks I found that nothing had been fixed. I took it back to him complaining that the same issues were still occurring which was very sluggish acceleration. I had previously had the code read and the original problem was a misfire within the #4 cylinder. He asked me to bring it back to him after the weekend and he assured me that he would make it right. During the 2 weeks following that day, *** told me that a cylinder head had been removed from my truck and was being worked on at a machine shop. several days went by, so I finally went to the shop where he said my cylinder head was. There I met the owner of the shop, who stated that he hadn't had a cylinder head from Advatage Tire and Auto in months. When I confronted *** about this, he reassured me that he had just received it back and was putting the truck back together. Finally after over a month, he called and said once again that he had my truck finished. This time he said he installed the repaired cylinder head and a new cam shaft. When I picked it up it appeared that he fixed it. I signed the invoice, although all the parts that were replaced in the first 2 weeks were obviously not the source of the problem as I had to take the truck back to him for further repair. Within 1 week of having my truck back, I had fuel pouring out from my engine on the side that he had worked on. I found that he had damaged an injector seal while installing one of my fuel injectors. I fixed this as it was fairly simple. Within 2 weeks of picking up my truck, it was having the same issues I took it to him for in the first place. Cylinder 4 misfire. I still have yet to have my truck fixed because I cant afford it. I took a loan out to pay him the original $1100.00. Now I have a collection agency contacting me stating that my debt was sold to them from Advantage tire and auto. I do not feel as if I owe him the remaining $641.15 as my truck has not been fixed. I also believe he owes me $1100.00 because he did not repair it as he said he would. This whole period was very stressful due to the fact that I have kids and had to share a car with my girlfriend while it seemed like he just randomly replaced different parts on my vehicle.
I would like the debt of $641.15 that he feels is owed to him cleared so that my credit is not affected and I would also like my original payment of $1100.00 that I gave Advantage tire and Auto refunded. I gave this to him up front in good faith that he was skilled enough to repair my engine.
This customer was made aware that we would be crediting this and clearing his balance. We have made no reports to the credit bureau.
I do not feel that this matter has been resolved. Advantage Tire and Auto has agreed to clear my remaining balance, but I feel that my initial down payment of $1100.00 should be refunded as my engine was never repaired.
This response was provided verbally to BBB:
The deal we had with this customer was that would get the engine running, he came in with it in poor condition. He gave a certain amount of money down. We told him specific things that needed to be done and he authorized those repairs. He brought it back for more work, which we did and then we never heard from him again. We had to start a collection process against him for the balance owed and it was at that time that he said he had more problems with the engine. I told him at that time that if he had something to show that my repairs were faulty I would give him a refund. I haven't seen anything from this customer but the BBB complaint. We felt we repaired the initial complaint, engine not running. We repaired it to the point where it was running but poorly. We made more repairs to it and told him about additional problems that had to be taken care of. He never said anything else since then. If he has something from another mechanic showing exactly what it is that we did wrong we will review it. At this point all he is doing is calling to say it isn't running right. We have never seen it again, never heard from him, and haven't seen anything from any other mechanic proving our repair was faulty.
This rebuttal is incorrect. The initial repair was not to get the engine running. It was running. *** is aware of this as I drove it up there for him to diagnose it. It is also incorrect that I took it back to have more work done. I took it back only because he contacted me once saying the truck was running great, but that was far from correct. After driving it that night, I drove it right back to his shop and explained to him that the truck was doing the same thing as before and I didn't feel that it was fair for me to have paid money for such a poor job. His responded by telling me to bring it back after the weekend and he would make it right. He said he was a man of his word and that he would have my truck running perfect. *** has been much less than a man of his word and he twists actual events towards his favor.
