    Federal Trade Commission v. Passport Motorcars, Inc, et al

    The following describes a government action that has been resolved by either a settlement or a decision by a court or administrative agency. If the matter is being appealed, it will be noted below.

    On October 18, 2022,  Passport Automotive Group, Inc, et al (Passport) entered into a Stipulated Order for Permanent Injunction, Monetary Judgment, and Other Relief with the Federal Trade Commission (FTC). The order settles allegations that Passport participated in deceptive and unfair acts in violation of the FTC and the Equal Credit Opportunity Acts by adding “junk fees” on top of advertised car pricing, and charging more in financing costs and fees to Black and Latino customers.  Specifically, the FTC’s complaint alleged consumers had to pay hundreds to thousands of dollars in fees for inspections, reconditioning, preparation, and certifications above the advertised price or negotiated price, which already included these fees; thus double charging consumers.  Additionally, the complaint alleged Passport would increase the “buy rate” arbitrarily for credit applicants of Black (47%) and Latino (38%) buyers more often than non-Latino or Black customers.  The buy rate is the lowest interest rate a purchaser of loans would buy packages of loans, and increasing it effectively raises the cost of financing for these individual auto purchasers by hundreds of dollars. 

    Under terms of the Stipulated Order, Passport agreed to refrain from any misrepresentation of the costs or terms of purchasing, financing, or leasing a vehicle; list whether charges are optional or required; demonstrate charges, products, or services are authorized by the consumer, and note any material fact applicable to the purchase for which a charge is incurred.  Passport is further prohibited from the use of any unlawful credit discrimination practices and must implement a fair lending program.  Lastly, Passport was ordered to pay $3,380,000 as monetary relief to consumers. Consumers who have questions about their payment should contact the refund administrator at 877-701-3692 or visit the FTC website.  The Stipulation Order was for settlement purposes only and should not be considered as an admission of guilt or finding of violation of the law.

    On 3/27/2023, at 12:30 pm, I brought my car in for any scheduled maintenance check on my BMW **. This is not the 1st time I have taken my car to this business for Service. I was assigned service representative, ******* ******. As customary, we went over what is to be done to the car which is a standard scope check and my tire warning light was on and signed for an estimated amount for possible work on my car, in lieu of checking on any existing warranties on the car prior to any work done on the car. I was notified by a text message at 3:37 pm for recommended services. I spoke to Kenneth Brokaw over the phone and asked him how much it was going to cost totally and he stated over $1700 of work, and which point, I told him to only do work that is covered by my warranty which was replacement of the tires. He asked me if I can pick up the car the following day, and I told him no, that I needed my car to go to work. He then said he was going to ask the technicians to rush the job since they close at 6 pm. When I got there at 5:50 pm, to pick up my car, I could not be released to me until I pay a balance of $856.74, which I was not prepared to pay, which I was forced to pay with my credit card.

    I would not recommend Passport BMW. This dealership and staff cannot be trusted, very dishonest individuals. Took my M2 with 17,300 miles in for oil/filter change and was advised it needed additional service (coolant flush, rear differential flush, cabin air filter, fuel induction service) totaling approximately $1200. Later that day, the service advisor call and informed me that all work was done with the exception on the oil change because the oil pan drain plug was stripped. They somehow managed to performed their suggested work (to get paid) but not the oil change which was the original reason the car was brought in. The car wasn't leaking oil prior to Passport BMW service but was leaking oil when I took delivery. They advised the repair can be done at a discounted price of $250 in addition and refused to take responsibility for the damage caused by their technician. I contacted BMW of North America and file a complaint about the situation but they were unable to provide a resolution. Currently working on submitting a complaint with the MVDB (Motor Vehicle Dealer Board) and all other agencies that can assist with this dealer violations.
