    State of Michigan v. AmeriGas
    The following describes a pending government action that has been formally brought by a government agency but has not yet been resolved. We are providing a summary of the government's allegations, which have not yet been proven.

    On June 27, 2018, the Michigan Attorney General's Consumer Protection Division (MI-AG) filed a complaint against AmeriGas Partners, L.P., for violating the Michigan Consumer Protection Act, and to recover damages for the company's alleged deceptive and unfair practices.

    Specifically, the lawsuit accuses the company of grossly inflating prices, charging unnecessary fees and failing to deliver promised services. The lawsuit also alleges the company no longer refunds Michigan customers who return propane after terminating service. Instead, the suit alleges the company resells the returned propane to other customers and keeps the money for itself. 

    The MI-AG further claims the company allowed 20-30 Michigan consumers served by one of its subsidiaries to run out of propane in the winter of 2015-16, even though the company was responsible for filling the tanks as part of an auto-fill program. The lawsuit further alleges the company charged a HazMat and Fuel Recovery fee on propane deliveries in Michigan. According to the lawsuit, the company mislead Michigan consumers into believing that these non government-mandated fees are needed to cover overhead expenses, which are already paid for through per-gallon pricing.

    The lawsuit further states that the company was in breach of a 2014 settlement agreement regarding excessive per-gallon prices on propane during the winter months, and its marketing statements were false and misleading regarding fixed-price contracts, free tank installation and early termination fees. 
     
    The MI-AG asks the court to find the company in violation of the law, permanently enjoin it from violations in the future and seeks restitution, injunctive relief, civil penalties, and reimbursement of the Michigan's costs and expenses of investigation.       On Saturday, August 12, 2023 while my husband was cutting grass in our back yard he smelt gas coming from our gas tank that runs our oven/stove and fire place. He immediately called Amerigas to let them know at 9:30 AM. Amerigas didn't send anyone out until 4:30PM. The tech, *******, was very rude and couldn't find the leak so she had to disable the tank. Amerigas left a leaking tank in our yard. On Monday, August 14 I called and cancelled our service and asked them when they were going to pick up the tank. After being on hold for 20 minutes the CSR couldn't tell me when they would pick it up. On Tuesday, August 15, we had our new provider come and install our new tank. Their tech informed me that the tank was still leaking and that Amerigas need to come and pick up the tank immediately. I called Amerigas to ask them when they would come and pick up the leaky tank. The first person I talked, I explained what was going on and they put me on hold for 20 minutes and I got disconnected. I called back and went thru this process again. This time the CSR told me that their standard practice was to pick up a tank with in 30 day. I again informed them that the tank was leaking. The CSR put me on hold and when they came back told me that they would out in a "emergency" order to get the tank. I asked that they call me to let me know when they would be there. Several hours passed and my ring alerted me that there was motion. I look and Amerigas had sent a gas truck to refill a disabled leaky tank. I called Amerigas again and had to explain the entire situation again. The CSR told me that they saw where an emergency order was put in to refill a tank. I asked to speak to a Supervisor and was put on with ***** who after 20 -30 min told me they would get the tank and call me before they came. NO CALL NO TRUCK. We were not able to use our stove/oven for 3 days and I still have a leaky tank in the yard.

      Negative stars if there were such a thing.My property had a tank that was installed by a previous supplier in 2009, which Amerigas acquired around 2016. The service from the previous supplier was always terrible (less than 1 star) but Amerigas somehow managed to take this to another level. Terrible customer service, terrible service, late deliveries, overbilling, you name it this disreputable company does it.On at least 2 occasions during the cold season in ** they almost let the tank run dry. When I called them on it, they took a minimum of 7 days to send someone out to fill the tank. It was at this point that I decided to dump this supplier but that was only the beginning.When the new propane company contacted them to purchase the tank, they stated that they do not sell their tanks. OK, so the new supplier dug up the tank and replaced it free of charge. Of course, this is not the end of the story with this terrible supplier.I called them to come pick up the tank which was now sitting in my yard, and they said they'd pick it up in about 10 days. I month later I called them again, we'll escalate it and pick it up in less than 5 days. 3 months later I called again, we'll escalate it and pick it up right away. Four months later they picked up the tank and 3 weeks later they send me a $300 dollar bill for picking up the tank less the 25 gallons of propane still in the tank.It's pretty clear this company does not care about keeping their customers and they are happy to overcharge you for the disservice.
