Additional Notes

Complaint: We purchased our house and we have a 10 year warranty for the insulating glass on our windows. It states the windows will be free from failure of the air seal and covered for a period of 10 years from the date of purchase. I contacted Home Kim originally back in early Feb 2013 and was told that I had to go through the builder. After getting the run around I understand the builder (********** *****) is no longer in business. I once again contacted the Home Kim Group In March 2013 and they came out to give me an estimate to get the windows replaced because the seals on the windows are buckling that are still under warranty. I was provided two different warranties from Home KIM and was told that the warranty that is on line is not the correct one so they emailed me a different warranty. They did an estimate that is below and it states that material will be covered by **** *****. I called to speak with the manager, as I emailed as well, that at this time I would like to just have the material delivered to me and will hold off on the installation due to finances. After a very unprofessional call with ** *** and continuous yelling from him ( I put the phone on speaker so that my next door neighbor could hear how unprofessional and rude he was). Additionally, he provided misinformation. He stated that the charge was for shipping the windows to our house and I asked where the windows were manufactured from - he stated ********. I said I would come and pick them up instead - as $750 is a very high price for shipping, when the source and destination and less than 12 miles apart. ** *** then corrected himself and stated that the $750 cost was for other things as well and continued to yell at me and would not listen to me. I asked for the owner’s name and contact information and he flat out refused to give me that information. I said thank you for all your help and I ended the call. I am now being told that we still have to pay half of the $750 if we want the windows as part of the warranty. I would like to pick up my Six windows at no charge as the Estimate stated

Desired Settlement: Replacemet of windows

Business Response:

*** ******, This complaint (ID #*******) about our business isn’t right, the home owner went online and read the wrong warranty information. We have 2) different warranty 1) for remodeled home owner that “sign” a contract with Home Kim Group,  and 1) warranty for new home builders.  I have attached a copy of our warranty information where I highlighted,   It clearly says that the home owner is responsible to pay ½ the cost of list price for the broken seals after the 1st  5 years. The list price for each glass is $250.00 and we estimated $125.00 per glass. 6) 2410 transoms x $250.00 = $1500.00. **** ***** ******* will pay for ½ so the cost is $750.00 not “free”. By the way we went to the home owner house to measure the glass size for no cost and in general the home owner must tell us the glass size or we charge a $75.00 service fee for this. As of right now we still haven’t received any of the home owner information on a written claim, we don’t know if she was the original home owner or when she settled with ********** *****. This is the main determining factor if she is covered under any of our warranty’s or not. We are a local business and tried to help her out without all the paper work but  she wants it “free” and that’s not going to happen. ** tried to explain our warranty to her  over the phone but she wouldn’t listen she kept trying to speak over him therefore she says he was yelling.  We would be more than willing to help her fix her windows but we need all  the information on a written claim like our warranty states. Thanks,****** *******Operations Manager Home-Kim Group, Inc.Home Guard Windows.Home-Kim Contractors.Office:  ***** ******** *** ******** ***** ************ ***** ************ *********************** ***** ********* ** ********* ** *****
