Complaint: I have shower door and enclosure that has been leaking since 4/2010 in a new construction home. The door has been installed four times with each replacement leaking worse than the previous one. The installation company * * * *************, has agreed to replace it but will not repair it if defective. A violation of the new home warranty. Iacobucci (Baker) Homes has stated that they will "stand behind" any repairs but will not give me any details about what that means. I have asked how long after the installation is the door warrantied for and also who will repair it since * * * says it will not. I have been told those questions are "hypothetical" and that they will not speculate. Baker Homes has also denied other repairs that were supposed to be covered. Needless to say, I am not comfortable with this and need to assured I have protection if * * * does another terrible replacement.

Desired Settlement: I would like to be paid the cost of the replacement door that they will have to order. Then I would like to have the door installed be a more competent company and * * * and the builder will not have to involved. I have offered other compromises as well but this one will be the most satisfactory. I have filed a complaint against * * * also.

Consumer Response: Here's a copy of contract. There are also repairs that the builder has refused to make that I feel also violate the warranty. Should I make a separate complaint?

Business Response: Thank you for your email. As you know I was recently transferred to the Pennsylvania Division.

After reviewing your file and BBB complaint #******* I wouid like to say, we at Baker Residential are proud of our outstanding reputation for customer satisfaction and integrity that we've earned over the last 47 years. We pay attention our product and the way we market our homes. We always put ourselves in the position of our customers and treat them as we want to be treated. I hear and understand your frustration with our attempts to solve the issue and would like to assure you I want to bring your complaint to an amicable conclusion as quickly as possible.

In reading your complaint to the BBB I would like to bring your attention to the ''Desired Outcome/Settlement" section where you say "I would like to be paid the cost of the replacement door that they will have to order. Then I would like to have the door installed by a more competent company and *** and builder will not have to be involved..'. Considering all the documented correspondence I have read, I agree with your statement and would like to offer the following settlement. I will agree to pay you $800 upon your signing a release to settle the complaint.

If this is agreeable please respond via this email and I sincerely apologize for these unfortunate events.
