Additional Notes

Complaint: I became ill in October 2012 and did not know if I would be able to rejoin the work force. I contacted Prosper about couching for a Home based business. Total investment was to be about $2000.00. After paying $600.00 I received a couple of calls from my couch. Then my couch was no where to be found for about a month. Someone from Prosper called me and informed me that my couch was in another department now. Since then an additional $183.35 was taken from my checking. I was out $783.35 with no services being provided. I should not have to look for people I hire to do a job. It left a bad taste in my mouth and I told them I would be canceling the agreement. Basically-Your Fired. It soon went to collections and my reason for canceling fell on deaf ears. They still wanted to collect my money for doing nothing. This is now a big problem on my credit report.

Desired Settlement: Remove dispute from my credit report

Business Response: ***, you enrolled into our coaching program
on 11/28/2012 in the amount of $2,600.00 dollars for a one year coaching
program. Upon enrollment you were financed and a loan was provided for you, to
help you pay for the coaching program. You had a down payment of $600.00
dollars and you were financed $2,000.00 dollars to fulfill the purchase. During
your enrollment we took you through a very detailed registration process where
we explain number of commitments that are expected of you and what you can
expect from us during the year program. During the registration if you felt
that at any time you could not keep those commitments, then you had the option
to withdraw from our services and the agreement that you had agreed to at that
time. There is nothing we can do to remove the inquiries that have been reported
to the major credit bureaus. You received a loan from a financial institution
and you agreed you would pay that back. From what I can see, there is still a
remaining balance that you need to pay off. If you reach out to the financial
company, and work out a payment plan, then they may be able to assist you
regarding this request.

During registration we explained to you in detail
once again what services you would be receiving. Your program package had four
one-on-one coaching sessions, you also had access to the resource line of
coaches that you could call on a daily basis when needed. There were weekly
group coaching calls that you could have accessed throughout the year as well.
You had access to an online member’s area that provided a great deal of information
to help you gain value from the program and to reach your goals. There were
many resources available to you during that years’ time, which you decided not
utilize. You never called in to address any issues that you may have had with
the program either. We would be more than happy to extend services for you once
we get confirmation that the loan is settled or paid for in full. That loan
will need to be paid back because you had used all four coaching sessions. We
also allocated your program cost to cover all the other resources that I
indicated above and there were staffing fees and other expenses which were paid
for, in the event you did use the program the way it was intended.

Again, we would be willing to extend the program
for you at this time at no expense. If you are willing to do your part as you
initially agreed to do and we get confirmation that the loan was settled or
paid in full then we can proceed to provide these additional services.

Consumer Response:

Complaint: ********

I am rejecting this response because:

I expressed on numerous occasions my dissatisfaction with the company. I received no materials and the so called coaching was a total joke. When I called to speak with a  coach who was some what  familiar with what I was trying

to do, I was told he is in another department. The old "Bait and Switch". When I did reach someone to talk to, it was starting the hole process over again. "Waste of Time" The only business advice they gave was create a Web Page.

For a company that say's they are Professional Business Coaches and say "Get a Web Page. that is a little generic don't you think?

1. I kept my commitment by calling your company many of times with nothing to show for it. Then the threatening calls started

2. If your company provided a service you are entitled to be paid for it. If you do not provide a promised service you should not be paid!  It's called Breaking the Contract/No Services Rendered.

3. Most important: Why would Achieve Today AKA Prosper need a loan from a Financial Institution for me to work with you.

4. I never agreed to pay back a loan and never told you to take out a loan. I agreed to pay for $2,600 of Professional Services which were not provided.

5. I would like the Following info to prove a loan was taken out for me.

6 Why did Prosper change the name to Achieve Today? To many complaints under Prosper? That's a RED FLAG

7. I have found a lot of the same complaints filed with the BBB. Why Achieve Today AKA Prosper allowed to continue praying on peoples hopes of doing better for them selves?

Name of Loan Institution and DBA if applicable

Address

Phone number

And finally, a copy of the loan or loan number to prove that a loan was taken out for me.

As far as

Sincerely,

*** ****

Business Response: ***,

You make mention that you made numerous attempts to express
your dissatisfaction. There is not one system note of you calling in to express
this claim. Every time you call into our office your account is time stamped
and noted. If you are able to provide us with any contacts here within our
company then we would love to look at that information. You also say you made
calls to our company “Many Times” which again, we do not show any of those
efforts. You received your four main coaching session and after which you had
access to our support line to contact daily if needed. That never happened.
There were commitments that you needed to keep for 12 months and that was not
the case.

The reason there was a loan associated with your account was
because you were not in a financial position to pay for the course up front. We
then explained to you that there will be an amount of $2,000.00 financed over a
twelve month period. You are very familiar with the financing company. Monterey
Financial was the servicing company for that loan. You agreed to pay that
amount back based on the term and commitments made upon enrollment. Monterey
Financial had even reached out to you a number of times to work with you to
help you bring your account current.

Other companies (like www.Prosper.com) have similar names as
ours, so we wanted a name that was more distinctive. I am more than happy to
have you reach out to me so that you can get the agreement that you had agreed
to when enrolling.

At this time, we will not be removing any negative reporting
due to the delinquency of your debt. We would be willing to meet you half. If
you are able to pay that amount off, then we can make a request to Monterey
Financial to accommodate this request. Please reach out to me so that I can
better assist with this option.

Additional Notes

Complaint: I wonder if you can help me? I am a British citizen living in the UK, and receive emails on personal development on the internet as it is an interest of mine. I have previously read information on "Law of Attraction" by Joe Vitale who was also a co-author of the book published called "the Secret" on this subject. Recently, I had a cold call from a representative called ****** in a company called" achieve today" based in Utah, and after this hour long interview call, I was passed on to another man called *****, followed by another hour long call to persuade me to part with my money, as I was accep*** on their restric*** year programme. The costs from $6,000 to 9,000+ and I went for the cheapest. A few days later, I had a brief orientation call from a woman ?Ms ****, and then was able to puruse the product information in their so called "success centre" on the Achieve Today website. I must admit at being underwhelmed by the contents which, frankly is available free, some better, all over the internet by competitors not charging. I emailed them to tell them it was unsuitable for me within the 3 days, and told them I felt the quality of written and recorded information was lacking, poor in many ways, and available free elsewhere. My email cancelled the contract until I could confirm this by speaking to someone out of courtesy. However, when ***** called he was bullish in his response and persuaded me it was too early as it was different as it offered one to one coaching. so I agreed to have my first coaching telephone call in a few days, but this was after the cancellation date. ******, my ascribed coach was charming and friendly, but is now on holiday for 2 weeks. The content of the half hour weekly call, was little more than one can get on videos available on the website resources or elsewhere. I further reflec*** my discontent, again by email but as it was the Christmas time, I only got a telephone response last evening, also from a bullish representative called *** *******, probably reading from a script certainly keeping to tight rules. He told me he was the "student rep" (but that name doesn't correlate to that I checked on your information on the company). He told me I could not talk to anyone further up the company reporting line as he was the representative for students and the CEO would only pass it back to him. As I got nowhere and it became a circular conversation, I could see that i would get no further, so had to give up my quest to get a refund. As I am unfamiliar with US law, I quizzed him on general US law on cancellation and he told me the 3 days is typical and only under special circumstances such as a 'terminal illness' is the only grounds they would consider for a refund. I feel caught by the company, initially by pressure selling over the telephone on a cold call, then when they told me not to cancel before getting coached, then when I was still ujnsatisfied by rthe product as it dissappointing, I was told it was too late according to US law. This feels like a 'scam' which I told the rep, and even if it is not, it certainly feels like very sharp practise to dupe customers by bullish selling tactics and emotional pressure. I am surprised as in UK the law is typically 30 days refund, and rules exist when a product or service is deemed by the customer "to be unfit for purpose" otherwise shoddy which I do in this case. Other US product offered on the internet have refund deals for far less expensive products and it seems fairer. Therefore, I wonder if you can help me sort this out, as i am unable to afford such a product that is unsuitablle fo my needs and under a quality compared to other currenlty available. My circumstances makes me vulnerable and represents further stress to my situation which I need to minimise as much as possible. I look forward to any help you may be able to give me.

Business Response: ****, we appreciate the feedback that you have provided
within this statement. We are a surprised to hear that you feel this coaching
program is of no value to you. Even after you made these comments, you had
continued to have the coaching sessions from your coach? During your enrollment
process we try to be as clear and as detailed as possible regarding the
cancellation options. You enrolled on 12/6/2014 and when you spoke to Student
Care that was on 12/29/2014. We do have in place a 3 business day cancellation
option in place, this is given to you by us. In fact, we do not need to provide
a cancellation option. It seems that you spoke to Mr. ****** regarding your
reservations to continue the coaching. His intent was not to make you feel
pressured. This is why he offered you to have a coaching session to see if this
is something you truly wanted. Listening to call recordings and reviewing our
system notes, you emailed your coach and expressed gratitude of what she was
able to discuss with you during that first session and that you wanted to
continue. You have now completed 4 coaching sessions and as I listened to those
recordings and reviewed the coach’s notes, you are making progress. However,
you mentioned to the coach some personal issues that you are facing and that
you felt this program was not for you based on those issues. These are things
we can bring value and add help to you so that you can reach the goals that you
initially wanted to accomplish through this program. You are outside the
cancellation time frame and you had re-committed to the coaching via email and
by utilizing services since the first session.

We are more than happy to speak with you and discuss
different program options that we can offer. If we need to change coaches or
discuss any other options that may be available to you, we are happy to do so,
but again, cancellation and a refund is not an option. At this time I can have your
upcoming coaching sessions with your coach unscheduled so that we can discuss
what may be the best route for you is at this time or, I can keep that session
in place and we can continue to move forward as is. Please let us know.

Additional Notes

Complaint: After four weeks immersion I realized I had not been of sound mind with this choice of help and none of this material was appropriate. On December 21, 2013 I paid Prospering. Inc. $3000. for 52 weeks coaching/business direction. The Seller was a lovely man, **** *******. In years past I had been self employed for 16 years and thought this "coaching" would enable me to choose a new direction for a new business endeavor. Recently retired I felt quite desperate to find a new independent business as my only resource was Social Security. I had great trepidation and even queried Mr. ******* on the efficacy of a person my age taking on such an endeavor. I chose to proceed, trusting for the best. I listened to the recommended materials more than 10 hours/per day and found them frustrating, infuriating, and frightfully 19th century. Nevertheless I sloogged on taking notes hoping it would eventually give me a new perspective. I also worked with a Coach in Self development as a Prelimary task as I had suffered a life threatening blow to my self which created overwhelming fears. I had 3 sessions with ****** ******* who meant well and I did all that was asked. She was not a person who took "interruptions" so it was a one-way street. At this time I had opportunity to move to a safer place and took this decision. This was a very difficult, down-sizing task and took 3 weeks to accomplish. (This was during mid-January.) I was disheartened and delayed getting back to ****** as the phone service turned out to be very bad as well as the internet service at this new location. During this month (January - February), acclimating to my new situation I realized how unsafe I had been and as I settled down and tried to return to the tasks with Prosper where I left off, saw clearly that NONE of this was in any degree "appropriate" for a person of my age, my "skill-sets" (archaic as they have become) and that my decision to go forward with it, in December, was from a place of desperation on more than one level. At first I told my self that since I had agreed I should just "face the music" and pay it off however long it took, but I was not comfortable with this. Something was not right. During the first months I was called a few times with "upsell" offers, at which I was appalled and not the slightest tempted--I pointed out to the persons calling how so far NONE of the materials were either relevant for me, or--in a large degree--relevant to this time in history/ Maybe they'd be appropriate for a person in long term study, in their 20s or 30s, but as a "path" expedited for a previously self-employed person there was NOTHING they offered that they could advise about UNLESS I was willing to drop MANY MORE THOUSANDS. What, if anything, would be provided for that, is a question I was happy to not ask. So beginning March I called Mr. *******. We had phone tag for about two weeks. Finally I laid out my plea to him, to see if I could withdraw from the program and pay proportionately for the service/study received. He said there was nothing he could do and that I had to talk to "Student Care". Student Care turns out to be a light-hearted young man of about 18 who one could hear both had a script of "No, not a chance, you had 3 days to make such a decision" AND, not a molecule of compassion. He said I should avail my self of what was offered. I thought about that this week and decided to report the matter to the Better Business Bureau. Thank you for your consderation in this matter.

Desired Settlement: I paid $3000. The whole lot, all at once. For 52 weeks of materials availability and 5 sessions of "Coaching". It took some time to sort out what was available to me at that time and I have to say that most of the materials were only available for an advanced place in the studyI'm sure one would have to pay alot more. What was available was, after digestion, of extremely minimal use and value. I would like a proportionate reimbursement of the fee: $2000. I am willing to have paid $1000 for the Coaching and the materials studied, over the 4-5 weeks in which I was fully engaged in the matter. I feel strongly, to my shame, that I was not "of sound mind" when I made this decision, and beg consideration that a Single person (not married with other resources) having taken such a step at the age of 69, be shown some compassion and be permitted a partial refund and withdrawal from the program. Thank you.

Business Response: Initial Business Response /* (1000, 5, 2014/04/04) */ Contact Name and Title: ***** ***** Director of Student Care Contact Phone: XXX-XXX-XXXX Ex **** Contact Email: ******@prospering.com You had enrolled with us on 12/21/2013 for our 1 year coaching program. Upon enrollment there are certain agreements and commitments made between both of us. Again, this is a 12 month program as you have also acknowledge, but of those 12 months, you have only utilized 4 of 5 coaching sessions and that was it. You had and still have daily access to the coaching support line as well as graduate/group coaching sessions weekly. These specific resources have not been utilized to the fullest by you. In regards to the program, you have just scratched the surface of help and coaching that is available to you throughout the year, and if needed there is extended help, well after the initial year at no cost, if you are actively using the resources. Below are the commitments that you had agreed to upon enrollment... E*** P***, you were brought aboard because you committed to the following key commitments: 1. You will commit 5 - 10 hours per week of study, planning, and personal development and use the success center as directed by your coach. 2. You will keep the scheduled appointments with your coach. 3. You will be willing to stretch outside of your comfort zone, take action on principles you learn, including doing all homework assignments, and report back to your coach as directed. 4. You will monitor your individual development, growth, and progress as directed in your program materials. 5. You will be open to identifying and overcoming limiting beliefs and obstacles during the personal transformation process. 6. You will complete the Enrollment Agreement, Student Profile, and participate in an orientation call before your first coaching session. After reviewing these commitments you did a fantastic job in the very beginning of the program, but again, this is a 12 month program, not a 2 month program. Based on the agreement and the services that we are still willing to provide, there is no option for a partial refund as you requested. With that being said, We will be more then happy to provide you with some additional coaching sessions for free, on top of the other resources that have been described above, which have not been utilized. We appreciate the feedback that you have brought to our attention and we definitely want to always make this a better program for you and or other students. Looking through all the coaching notes, there was great help and assistance that you had mentioned you received initially from your coach. We would love to get you back with the same coach, or if you feel that you do not want to work with the same coach, we can make an adjustment as needed and provide you those additional coaching sessions. If the timing in your life is not suitable to accept this offer, we understand. We will be willing to offer the original services as agreed upon and even more assistance when you truly feel you have the time needed to dedicate to your self improvement and initial goals. We feel confident if you take advantage of the program in its fullest you will make the needed progress that you initially wanted to achieve from the very beginning, but again, this is a 12 month process and we will do all we can to assist. Please feel free to reach out to me to take advantage of the services and additional coaching as offered. Initial Consumer Rebuttal /* (3000, 7, 2014/04/15) */ (The consumer indicated he/she DID NOT accept the response from the business.) Thank you for your timely response to my complaint. I do not agree with the Prosper position. I stand by everything I said in my initial statement. Are you, the BBB, able to listen to the initial speechifying by this Avatar **** ********* spouting 19th century wasp "As a man thinketh" exhortations that "if only one stepped boldly, kept thinking positively, one would succeed beyond one's wildest dreams".... that the program starts out with ? They claim that what is offered is a wide range of information and "coaching". Who, longing to find a new path, would not read into this nebulous promise what they so wished for. And so I immersed my self in everything that was made available to me. What I found was that even though to me $3000 was a HUGE amount of money to lay out and all at once, with unforeseeable benefit, what I found was that contrary to what I thought they meant by what they said, this actually bought me about 2% of the materials and "coaching" that was heavy-handed (read: one-sided; don't interrupt me; this is not a conversation) imposition of what I call "about About". This coach, Dr. ****** ********* meant well but all I remember of it was an extended rant about "allowing". I can still hear her repeating over and over "... I allow my brother to allow himself to be murdered...". I have been determined to go deep within my self and find what is the truth about what is holding me back from future success so I did my best to try this "allowing" but I did not find anything she told me or directed me to resonate with me. This is also true of those hours and hours of pre-recorded webinars from years' past. Yeeowweee. I listened sometimes over 10 hours a day wanting to think that "oh maybe the next one will give me insight". At some point I realized that all this speechifying was so generalized and so unfocused and so not a clear path to anything positive that it would have taken 10-20 years for any person to integrate what was heard into any coherent plan. In fact, in March I received (one) email from Prosper praising a student who had made a million dollars after 10+ years with Prosper. At this time I see how the "offer" from Prosper is so carefully phrased, with the carrot of "fer-shur" success and ALL being available (on the site) so that it appeared that if the student devoted one self to everything, material was available to find the education and tools with which to lay out for one self a path for excellent and spiritually rewarding remuneration. Once the money is paid it took about a month to realize that I could either invest thousands more dollars (and I received an upsell call a week or two after starting) to pursue the other "brass rings," or slog through on my own what offerings were available - irregardless of sequencing, relevance, and efficacy. And I was infuriated that it was totally "about About" - remember early personal computer software programs? By using Help files one could teach oneself how to utilize the program. But as the years have passed since the mid-90s) "About" files are ONLY "about About" and have zero content that is useable for real learning of the program purchased. This is exactly the same with this Prosper program. There was NO content that I had access to that I could utilize to map out a path for my self for a potential business, let alone a glimmer of how to find one's "life purpose" when one had lost her way. On top of that, no sooner had I paid out this money when the cottage I had been renting for 15 years suffered an electrical short pre-Christmas into Januarywhich I troubleshot for a week or so then appealed to the Owner to take steps, only to be stonewalled. It was hard to live without refrigeration and I found good reason to fear wiring in the wall overheating (the house is from the 1920's with minimal upgrades.) I felt internally driven for my primary safety to find a place to move to. Once I succeeded with this task and started to calm down, which recognition came to me only slowly with better sleep, I also saw clearly that I had (and I am 69 years old which I made clear to Mr. ******* and begged him to be honest with me about the likelihood for this program to be of real and good use for such as I-to which he assured me that success could be accomplished by following the program, within the year by one of any age not been of clear mind and reason. I made the complaint to you, the better Business Bureau, after I appealed to Mr. ******* and then the Student Care person because I could see that I had made this decision not only not with clarity of reason but from a place of internal panic. And I recognized that the Prosper organization takes advantage of such as I in that how they make this "offer" as well as with a beautifully designed and formatted website which looks abundant but one only knows after paying how little is available-how vacuous and slippery and lacking in useable substance. Yes, I was not in my right mind. Yes I had suffered (in the months previous to being offered this "help") some small cognitive deficits due to emotional shock from which I was somewhat slow to recover in that solutions were not available from medical doctors but required intense research regarding adrenal and hormonal imbalance as a result of extended use of certain medications. I come from a lifetime of some intelligence, initiative, tenacity, resilience as well as a history of past success with a small business. But I fell for the Prosper promise. It's a "suckering" and I am sure that are hundreds if not thousands of suckers such as I who have thrown up their hands and simply allowed themselves to be preachified to and then give up and take the "blame" for lack of success on themselves when Prosper claims they didn't take advantage of all that was offered. Only 20-year olds have time to spend hundreds of hours on this insubstantial material. (And even then, there was only one out of how many studying?) More hours of heavy-handed 19th century "be strong and live right" is not going to get any one anywhere in the 21st century. I choose to speak up, admit my gullibility, protest, and feel strongly that this organization is unethical and especially inappropriately targeting and persisting to sell to such as I. I feel strongly deserving of total reimbursement of my expenditure. I wish one had recourse to recovering the waste of time, energy, and self-recrimination Prosper so high-handedly reinforces. In this 21st century American civilization one must find one's Self and from there discover purpose and heart's desire: this is not in the realm of anything Prosper knows anything about (but which they claimed to, with their so-called "self-development module) and whatever it is they do know about is not available to anyone who pays out a mere $3000. But how could I have known that. I am profoundly grateful for your consideration in this matter. Final Consumer Response /* (3000, 13, 2014/06/06) */ June 6, 2014 Dear ******** ***** Director of Operations,Better Business Bureau: Thank you for your email of June 2nd. In regard to proof of not providing what they claim to, following is a statement received as part of the communication welcoming me to Prosper: "Critical Program Resources Elective Classes Included with your program, you will have access to our entire catalog of elective classes. Elective Classes are supplemental online mentoring classes that allow you to further your course of study or explore other topics of study. Elective Classes provide you with an opportunity to focus on specialized topics. To provide scheduling flexibility, you will have access to a replay of any class that you register for, even if you are not able to attend the live class. Course Curriculum Another critical resource is our course curriculum. You will have access to our up-to-date curriculum to supplement and enhance your educational experience. Our curriculum features engaging information designed to expand the mind and yield professional growth and personal development. You may access the most current version of our course curriculum at the Success Center. (If your program includes hard-copy manuals, you should receive them within 3 to 5 business days.)" NEITHER OF THESE CLAIMS WAS TRUE 1. Elective classesI was permitted access to one (1) "elective" class. EVERYTHING ELSE DID NOT HAVE ACTIVE LINKS. (and when I asked was informed they were for "graduate students"read "when more is paid".) (2) Course curriculum: also totally not true. I had access to only a couple "courses"which were just webinars previously recorded and within the "personal development" area, nothing outside the very limited and restricted confines of "personal development" (about which I will have to say they knew absolutely NOTHING of value). (3). The primary item I was given access to was a series of lectures by an avatar AND when I tried to listen to them in order given, I was "linked" to a website owned by the avatar person, **** ********. When I queried thisit was selling something and I thot it odd that I was being asked to pay for something right away, I was told THIS WAS NOT PART OF THE PROGRAM and they acted as if I had, on my own willful action, decided to go to his website. (which of course is absurd in that I had no idea anything that was actively linked was NOT part of the "path" that I was supposed to follow to listen to all the "lectures". (I was never able to get back to the original "lectures" to complete listening to them, not that I missed anything beyond a strng of references to a 19th c "up by the bootstraps" capitalist. When I called to query something, the response was far from "timely" and by the time they called back and I had called back to mind the exact path that has been taken many days previouslywhich the "support" person questioned what I was doing at every reported turnit was all more trouble than it was worth. Thank you for your kind examination of my response with the advice that I needed to find a middle ground to ask for. I received 4 of the 5 Coaching sessions. I think $1000. for 5 Coaching sessions is far more than they are worth for a porported 12-month year of study and the total of the Coaching was although not rigidly one week apart, no more, the variances I requested for more space of time between were highly resisted. The paragraphs copied from the "Welcoming" letter are typical of the Prosper communications. Flowery language and empty of substance. (In their responses within the BBB report, they reveal their fundamental illiteracy.) I WOULD LIKE TO RECOVER 50%, $1500. I WILL SACRIFICE $1500. TO MY GULLIBILITY AND LONGING FOR HELP TO FIND A NEW BUSINESS DIRECTION. (And, there being no way to see what I was NOT getting, beforehand, I was left to my own mental "picture" was what help for this education would be.) Every scam in the world offers one thing and then in reality acts like you misunderstood, or they disappear. Similarly, these Prosper people claim they are offering x,y,&z; then have the chutzpah to record all communicationswhile the student (me)is struggling to buy into the "education" by the Coach and then try to hold that against me as if I am lying now to say it was a waste, when in reality, after a little aesthetic distance, I see what a bloody pile of garbage they were trying to convince me was "gold". I do so hope this outrageous false promise of education can be held accountable for beng so empty of value. Thanking you so much for your help in this matter. I remain, Sincerely, ***** ********* P.S. Please advise how I pay your fee. Final Business Response /* (31415, 20, 2014/12/10) */ We would like to arbitrate this case.

Complaint: Initially I was told I can cancel after the 12 months. I requested to cancel now because the real time commitment is greater than stated. I called on Wednesday, August 13th regarding cancellation of the program. I purchased the program on July 18th. upon calling, I spoke to a representative at Student Care. I explain briefly that I did not want to continue the program and would like to remove obligation for future payments but was not looking for the initial %550 paid. The representative immediately got an attitude and started stating that I passed the 3 day probationary period. I mentioned the option to cancel later and he started speaking over me and stating that was not true and I will still just be billed for the program. I was a bit taken back by the rudeness and attitude for a conversation that was less that 2 minutes wrong. I didn't call to complain about the program. It just wasn't meeting my needs at this time. He took a bit to transfer me to the supervisor or manager whom I later spoke to. I asked about the refund and they told me it is not fault of their own. My intention was not to drag the coaches name to the ground but I later had to explain that most of the conversation sounded scripted. at times it seemed like she was looking for something to say to relate or not as personable. He offered to assign a different coach but I am just a bit unsatisfied with the service once he started stating that this is really a money issue for me and I have no complaints. I was quite offended because the payment is not a money issue. I just do not want to make payments on a program I am not using. The conversation with the supervisor seemed very condescending in the end and I had no desire to be talked to as such.

Desired Settlement: I would like to cut all my obligation with the company. I have already paid $550 and have a balance of $2200.21 based on the finance terms. I am looking to be removed from the $2200.21 obligation. I have already used their service for the a little over 3 weeks and think it's fair that they keep the initial down payment.

Business Response: Initial Business Response /* (1000, 5, 2014/08/27) */ Contact Name and Title: ***** ***** Director of Student Care Contact Phone: XXX-XXX-XXXX Ex **** Contact Email: ******@achievetoday.com Upon enrollment you are informed of the cancellation options you have with the coaching program. Within the agreement it is very specific that you have 3 business days after the initial enrollment, to cancel, after which there are no refunds or cancellations. However, we are very aware that certain circumstances can arise, and so for those certain reasons we take into consideration a cancellation option. In regards to your specific situation, cancellation of the financing agreement is not an option based on your initial request. I have investigated the call recordings that we have on file, and not at any time was I able to hear any representative state that you could cancel at any time, especially after 12 months of the program. In section 4a of the enrollment agreement that you signed, it is very specific as to your right to cancel. It is also very specific in regards to your obligation and accountability to honor the financing contract. I am sorry that you felt frustrated when you called in to cancel and that was not an option available to you. Based on the conversations that you had with us there were two issues that you addressed. First, you felt that the time commitment we had asked you to commit was inaccurate. You felt that you needed to devote more than 5-10 hours a week. That may be the case, however, that is the minimum time allotment that we ask a student to devote each week. We discussed different alternatives that could benefit you and your time commitment, but you did not accept that option. That option again, is to accommodate the coaching around your time frame. That way you have the time availability to devote what you feel is needed to the coaching each week or every other week. Also an option you still have available. Second, you felt that the coach was reading off of a script. As we had explained to you, it is so difficult to have a coach read directly off of a script when coaching you self-improvement teachings that are specific to your needs and goals. I spoke to your coach and also listened to call recordings so that I could get a better feel of what transpired. Your coach would reflect to past coaching notes that she had on file pertaining past conversations that the two of you had. She would also refer to your student profile at times so that she could better assist you. I am sorry you feel at time she was reading off a script, (because there was a pause or hesitation in her voice) but that was not the case. Again, we offered to change coaches and to even add additional coaching sessions for you, and that still was not acceptable to you. We are more than willing to do all we can to better assist you, but based on the reasons given, we will not be cancelling you out of the financial commitment that you have made with us. I encourage you to allow us to do all we can to make sure that this is a program that you receive value with. If you choose not to let us provide the services we initially said we would in the agreement, or if you are not willing to allow us to accommodate to your specific concerns at this time, than that financial commitment is still an obligation you have to honor and be accountable for. The commitments that you said you will keep were to be honored for 12 months; you have only been enrolled for a month and a half. There is so much time and opportunity for you to gain value from our services, at this point in time it is up to you to uphold those commitments so that we can continue to move forward with one another. The coaching will always be here for you to utilize and I would be more than happy to speak to you soon. This way we can make these needed adjustments and have a clearer understanding of the expectations we both will have as we move forward together!

Complaint: They refunded my account, then charged my account again under prosper inc. with they're same phone number and said that business doesn't exist. I subscribed to Achieve Today for life coaching with a guarantee of a full refund for any reason within 3 days. The next day I asked for a refund. They did refund the money only to charge me again under a false business name called prosper inc. Achieve Today then claimed that prosper inc. did not exist and called me names and berated me. They claimed they did not know who this business was. I called the phone number that was on the charge for Prosper Inc. and what do you know Achieve Today answered the phone. After they called me names and belittled me they finally said they were processing the refund now. I already reported them to my bank for fraudulent charges because I highly doubt that they will actually honor what they said. I had to shut down my debit card so they would not try to recharge me again under some other business name.

Desired Settlement: The settlement I am seeking is the 1000.00 refund.

Business Response: Initial Business Response /* (1000, 5, 2014/07/31) */ Contact Name and Title: ***** ***** Director of Student Care Contact Phone: XXX-XXX-XXXX Ex **** Contact Email: ******@achievetoday.com ****, you enrolled into our coaching program on 7/10/2014. Upon enrollment you had a 3 business day right to cancel, which you requested to do on 7/14/2014. This request was within your 3 day window, which we had honored. We had processed that refund request of $1000.00 back onto your initial credit card on 7/15/2014. That process takes about 5-7 business days to reflect back to your bank account. Unfortunately we have no control over your banks processing time and how soon that money appears back into your account. You had called and spoke to a few individuals here, that had confirmed the refund information so you could validate that with your bank. I have confirmed that the refund is complete and those funds were returned to you due to your right to cancel within those 3 days. Your account with us is cancelled and that refund was processed and closed out in full on our end on 7/15/2014. Initial Consumer Rebuttal /* (3000, 7, 2014/08/10) */ (The consumer indicated he/she DID NOT accept the response from the business.) You did not respond to the issue of why you returned my money, then re charged my account under a different business name and then claim that the business did not exist. You're senior coach *** ****** then called me an *** and proceeded to talk down to me because I am smart enough to know when I am being taken advantage of. Thank you for the refund, finally after many arguments with you're coaches and team. Final Business Response /* (4000, 9, 2014/08/15) */ ****, I am sorry for the difficulties that you had with our reps. We apologize for any wrong doings in regards to the conversations that you had with them and we appreciate you bringing those to our attention. We are definitely looking into this matter. In regards to the charges, I spoke to you myself on the phone and I tried to explain the charging procedures and to help you understand them more clearly. We do not charge your credit card right away, we actually do a pre authorization of the money. At which point you see that on your account. 24-48 hours later, our merchant captures those funds. That is why you saw the pre authorization fall off of your account,(This is where you think you received a refund, But there was no refund processed to you at this time). After which, our merchant then captures the initial funds, (This is where you believe we re-charged you). We do billing for a few companies, so the credit card descriptor name is different at times. This is why you saw another name assigned to that capturing charge. There were no additional charges or refunded amounts that took place during this timeline. **** this is not just the way a charge works with us, this is how almost all merchants and banks charge individuals accounts when payments are being processed. Again, something I tried to explain to you, but you were not willing to have that conversation in a professional manner with myself. Once again, we have cancelled you out and had done so by following our procedures and the procedures that are allowed to us by the banks. You have received the refund in full as it was your right to cancel in the time line allowed. We wish you the best of luck. Final Consumer Response /* (4200, 11, 2014/08/23) */ (The consumer indicated he/she DID NOT accept the response from the business.) I am not new to the way charges occur through banks and purchases. You're company Achieve Today originally billed me the $1000.00 I called the next day and wanted to cancel. I got the run around from you're company. The original bill was from Achieve Today. I had problems getting the refund so I called my bank and after the pre authorization turned into a regular charge and Achieve Today would not give me the refund I disputed the charges with my bank. I then was refunded the $1000.00. One day later after the refund was issued I received another charge for $1000.00 from a different company called Prosper Inc. which I had not had any business relations with. So I called Achieve Today again and asked about the new charges from Prosper inc. and *** ****** told me "that company does no exist" he also said he did not know who that company was. So I looked at the phone number associated with the charge on my bank statement and imagine that when I called the number it was Achieve Today Corporate office. It took several phone calls to you're representatives which I dealt with *** calling me an *** and berating me and saying all kinds of negative things about me. He was unhappy at the fact I could not be played for a fool by you're company. After several phones calls and enduring you reps bad attitude and behavior they finally said they would refund me the money. I also had to notify my bank of fraud in order to finally get the refund. I don't just believe that you charged me twice I have proof of it on my bank statement. I know how the banking system works. Thanks.

Complaint: Asked how I would like to have an extra $ 5000.00 to $15000.00 per month. How I would like to build the relationship with my estranged daughters and The whole outcome of what could be achieved is completely a lie. When I finally got a coach to contact me around February 3 months later it was about leaving my abusive husband, How was I going to achieve this. I explained to prosper that I was in financial trouble and was told on several occasions by the sales person how would you like to have an extra $ 5000 to $ 15000.00 in the next 3 months how would you like to have a relationship with your daughters and grandchildren. I tried on several occasions to cancel the contract and have payments refunded and scheduled payments stopped since I had not had any coach talk to me in an eight week period. The only time I heard from prosper in that period when I sent them an email letting them know that they were in breach of the contract and I wanted my money back. Honestly I could go on for hours but this is a sham nothing has changed in my life except I am further in debt still having payments take out of my credit card and disappointed with the whole scenario, they are just high pressured sales people praying on other peoples misery and grabbing to find some benefit in life,

Desired Settlement: Since I did finally here from a coach I would like to two thirds of the amount paid refunded, and cancellation of the money they are still taking our of my credit card. Not that I got any financial benefit or my children and grandchildren in my life just that they finally did ring me 6 times

Business Response: Initial Business Response /* (1000, 5, 2014/06/15) */ Contact Name and Title: Director of Student Care Contact Phone: X-XXX-XXX-XXXX Ext. Contact Email: ******@prospering.com Upon your enrollment on 12/6/2013 you had enrolled into our 12 month Personal Development Coaching program. As I reviewed your student profile that you filled out upon enrollment, you stated that you had personal goals and aspirations that you wanted to accomplish during this 12 month program. Many of those goals were money driven, so that you could improve your financial situation. Other goals were to focus on your personal growth and the reuniting with your family members. These goals that you had in place were very important to you, and during the enrollment process we explained to you that there will be a certain level of commitment on your end to help aid you through the progressions of growth that you set out to accomplish. With that being said, this is a yearly program, the transformations that you are hoping to see, takes time, and consistent efforts. We are committed to continue to assist you in any way that we can so that you can become closer to the goals you set for yourself. I have tried to reach you via phone the last week or so, so that we could discuss the different options available to you. I reviewed call recordings with both the enrollment process and the coaching sessions you had with us. When you enrolled into our coaching program we asked if there were any "Earnings Claims" made to you, meaning, were you promised to make or attract a certain amount of money at any time of the program. You stated "No". The goal of $5,000-$10,000 was a goal that you wanted to accomplish to help your personal financial situation. Any goal or aspiration that anyone may have is a goal of which is important to that person. We as a company would never discourage or de-minimize the value of such goals someone may have. These were your goals, you felt that you could accomplish them and we wanted to be supportive, at the same time making sure you realize that there will need to be a consistent effort and change in your life to reach the aspirations desired. We truly appreciate the feedback and want to do all we can to better assist you. Due to the services that have been rendered a refund is not an option of any kind. I know that you are up to date with the financing of the coaching program, and if we need to discuss different options relating those monthly charges we can. I am more than willing to add some additional coaching sessions for you at no expense. Student Care spoke to you at one point and actually added some additional coaching based on these same concerns addressed above. We have not heard from you or had any contact with you for over two months. This is something I would like to change and make sure that we are both accountable based on the original agreement to do all we can to assist you with your goals during the 12 month coaching program. I would be more than happy to discuss different options to assist you with the financing, and to also assist you with the coaching, which I feel would still be of great value to you based on the time I have taken to review your account and to listen to all the call recordings on file. Please let me know when I can reach out to you to discuss these options in detail, or feel free to contact me at the number listed here, so that we can reach a mutual resolution.

Complaint: I received a letter from Monterey Collections stating that I owe $ 2200.00 for a coaching program that I never signed up for or received. I WAS SCAMMED OUT OF $ 10,000.00 by Prosper for a debt relief program that turned out to be useless, so I do not think that I would order anything else from this company. There is an agreement that we would be more than happy to send out to you to clarify this enrollment. This is the same agreement that Monterey Financial provided to you. This is not a false document. This was filled out by you online, confirming an IP address and an "electronic Signature" that you had made upon the date of enrollment. This is a debt that Monterey will try to recover due to the agreement in place and services that were rendered. ****, you also purchased additional services with us on 11/20/2009. Complaint: 1 year program was completed. Called to discontinue and refund Jan 2014. Didn't discontinue and charged again. The program was for 1 year at $49.95 per month. The year was up, I didn't have time for the program because I worked a lot and when I did the program, getting help was difficult and with very little results; so I opted to not continue with the program. I called again toward the end of January and the person said that they saw where a refund was issued but it just hadn't made it to my bank yet. Complaint: Prosper's coaching has NOT been coaching at all. I am highly unsatisfied with the way I have been treated and would like an apology and FULL REFUND. I have changed coaches once before with prosper and I am currently sick and tired of them giving me the run around. I have downloaded and practiced the tips they give to NO AVAIL. I have complained about my lack of progress and inability to see any positive changes and all the coach did was get aggressive and informed me to do some homework which I did and submitted. Each time they gave me a suggestion I entertained them and proceeded to do it with NO progress at ALL...Instead I got more heartache and NO HELP when I really needed it. NO PART OF MY LIFE HAS REALLY IMPROVED SINCE JOINING PROSPER. THEREFORE I BELIEVE THAT IT IS WITHIN MY RIGHTS TO CANCEL MEMBERSHIP AND RECEIVE A REFUND.

Complaint: This company made it sound easy to pay down debt, pressured us into starting a business. Outrageous amount of money charged for inadequate service. Around November, 2010, we paid this company approximately 8,000 dollars for a debt coaching service. Because of the large sum of money that was charged, we believed that the content of the coaching sessions would produce the desired results. We only received 8 sessions. The content was information that we could have learned elsewhere for free. The sessions were definitely not worth 8,000 dollars. We were then pressured into starting a business as part of paying down our debt. We then invested another 4,000 dollars into starting a business. After 12 sessions, we were dropped and left to fend for ourselves. We are now over 13,000 dollars more in debt because of this company. We voiced our concerns to Prosper. They gave us another year of access to their site, which did nothing. They did give us 4 more sessions with an e-commerce coach. It did start us on the right track, but 4 sessions was not nearly enough to help us.

Desired Settlement: We have tried to get more help with our business from Proper. The additional help that they provided to us was ineffective. We would like our money back so that we can invest it in an advertising company for our business in an effort to pay down the debt that we have incurred.

Business Response: Initial Business Response /* (1000, 5, 2013/12/30) */ Contact Name and Title: ***** ***** Director of Student Care Contact Phone: XXX-XXX-XXXX Ex **** Contact Email: ******@prospering.com You enrollment into our program in 2011 was for transferring debt into wealth. This program provided you the assistance to eliminate debt as well as the opportunity to help create additional income to eliminate even more debt. As I reviewed your account, we sent some surveys based on your experience during and after the coaching. You both made comments stating that the coaching was beneficial and that you were able to actually create better spending habits, and better your financial situation so that you can pursue a business. You spoke to a representative in regards to the program and explained that you did not feel you were getting the total value of the program. At that time we added 5 sessions free of charge to help assist your business opportunities. It was explained to you that the program was extended so that you can call in on a daily basis if needed to the coaches. After the additional sessions, there were never any attempts to continue to get the education and assistance that the coaches would be able to provide. A refund is not an option due to the services that were rendered. We are more then happy to assist you in your business opportunities that you are currently involved with. This is up to you. We spoke to you a few weeks back to extend the web access once again, but still you have not called into the coaches on the resource line to get assistance. This is a vital and important part of the 12 month program you enrolled into. This remains to be vital as we have extended access to you for no charge. Information is great but if you are not applying that correctly within your business, then it won't do you any good. You need to communicate with the coaches daily if needed to see the results you are looking for. Again, a refund is not an option. We will offer the continuing assistance and use of the website and coaching services if you can keep the commitments you initially agreed to. If this is acceptable and doable for you, then we will grant access back to the website and the coaching support line so that we can continue to help with your goals.

Complaint: The salesmen pressured me into believing this was the only way I could get out of debt they failed now I could loose everything I own. On 9/27/2010 I trusted Mitch Tolbert and he charged me 10,450.00 to help me get out of debt. If I followed the plan to the letter i would recoup my investment in 1 year. i was told the money would be tax deductable. It was not. I was coached by ****** for 5 sessions 1 hour at a time. I followed everything that i was told and did everything not leaving anything out. i was told to use my credit card to pay the additional expenses everymonth for websites they had me get and that I would be making enough money on them to pay back the card every month. I followed their plan week by week and got further and further in debt. I requested refund after refund when i was in a bad way and could not pay the bills. I am in debt way more than i was when they were going to help me. They did send me a $1,000 check back but I told them that wasnt going to help me very much i wanted my money for the program back. after a year that I was supposed to have my investment back I am worse off now it has been almost two years and I have tried to get money back for the whole time and I am so far in debt because of this. they were supposed to get my credit card interest reduced and never once was an attempt made to do that by them. So in turn i am paying or have been paying 15.99% interest on $9,450.00 and additional $90.00 a month for web sites that didnt do anything and I cancelled them after a year. So that is an additional $1,082.00 that I am paying on and I can not make the payments and am getting behind on everything all due to the amount they charged me and I asked att the beginning if I was going to have to pay anything else and was told you have to spend money to do this or it will not help you. i did and now i am in bad shape. So I was lied to and put off and even though i requested refunds because I couldnt pay the bills as of the 1st month I got my 1st bill and it was very high and i told them i could not pay that amount they said just keep putting money on the card and it will start paying for itself. I am going under and I really dont want to file bankruptsy when if they refund my money I can be ok. Every person i tallked to even within the first 30 day trial time period was saying that i had to follow the program before they could do anything.

Desired Settlement: I want a refund of the $9450.00 and also the $1,082 that I paid every month because they told me I had to. And i think i should be intitled to the interest they caused me to incur over the last two years on that amount which is somewhere over $11,000.00 and they also maxed out one of my cards so that I could do the program and said that was best. Now I know it was bad advice from a somewhat trusted source.Shows that even someone with a good rep may not always be on the up and up. I just need help they got me in this position and i need them to help me get back to where I was before they came along since they obvisously did not help me.

Complaint: Supposed to be coaching but is actually just customer service aimed at getting clients off the phone quickly and simply parroting rehearsed material. The intial phone call was advertised as a free coaching call, but was purely a sales call without any coaching in it at all. Then hoping to get some real coaching when enetering the service I found coaches not at all interested in finding out what level I was really at in order to guide me. Instead I found coaches simply parrotted rehearsed material that I had already read in the Joe Vitale book and handouts and audios. The elective classes they touted as being a valuable extra were very basic and the website setup has no alert to communicate when the next live class is available, leaving it so the user has to click through every single one just to find out if there is a live class. The coaches on the phone also clearly aimed at getting me off the phone as quickly as possible. In addition my sister had signed up for the free coaching call and was harrassed by the person who repeatedly called her at a time when she had already told them she was unavailble.

Desired Settlement: I want the $100 already paid for cancelling the service refunded as well as the remaining $100 waived.

I have tried numerous times to contact you by phone to finalize and address the issues that you have. We will continue to reach out to you. As you mentioned, you are not free till next week, so please contact me directly so that we can discuss the cancellation and refund request. This is the procedure that we follow pertaining to this specific situation and request you have. Initial Consumer Rebuttal /* (3000, 8, 2013/12/04) */ Hi there, Had arranged a time for Prosper Inc to contact me this morning and they did not call me. Final Consumer Response /* (3000, 11, 2013/12/05) */ Case has been marked, received rebuttal but I did not send any. Below is my rebuttal. I have now waited three mornings in a row for a call from Prosper. Prosper only answered my email, which gave the appropriate times to reach me,four working days later. I offered to resolve the issue via email given the difficult in time differences, but this was refused by propser. A refund is the resolution I would like, however it is not the motivating factor behind my complaint. To the original complaint I'd like to add a complaint about the case worker at prosper on this issue. I can no longer set aside time to wait for Prosper to call. My time spent has already cost far more than $200. Prior to the BBB case the President of Proser wrote an email to me outlining that he would refund the $200 exit fee. I have not received any refund. Final Business Response /* (4000, 13, 2013/12/09) */ Through emails, we have came to an arrangement to part ways. That was a refund of the cancellation fee. Your account is now cancelled and the relationship with you is terminated.

Complaint: I cancelled the service within the three days allowed by law but my credit card was still charged $5,500.00. On Friday September 13, 2013 I spoke with ***** ******* of Prosper Inc. and signed up for coaching for $5,500.00 which I charged to my Discover card. After signing up I decided the course was not for me and on Saturday September 14, 2013 drafted a cancellation letter as per the agreement and faxed one copy to X-XXX-XXX-XXXX which is the number they give in the agreement and also faxed a copy to their corporate headquarters at X-XXX-XXX-XXXX. After faxing both numbers, I documented the fax that it was sent on 9/14/13 at 11:50 AM (and that would be Central time). Shortly after sending, I received a series of calls from the number Prosper Inc used to contact me. The number is a bogus one that appears to be coming from Janesville Wisconsin but, in fact, originates in Utah. I was not available to speak for the first few calls but at about 12:36 PM Central time, according to my phone log, I did speak with Mr. ***** ******** I did not wish to engage Mr. ******* in detailed conversation as to why I was withdrawing from the program and only stated that after looking through the material, it did not suit me. While Mr. ******* did try to engage me in conversation he did affirm that Prosper Inc. did receive my fax and that they would comply with the law and refund my $5,500.00. On Monday another member of Prosper Inc. tried to contact me and again on Tuesday but I do not wish to engage any employee or associate of Prosper Inc. until my Discover card is fully reimbersed for the $5,500.00. I did make one further call to their student help line on Saturday September 21, 2013 at 12:17 PM Central time and left a message asking when my refund would be complete.

Desired Settlement: The only lawful settlement would be for Prosper Inc to refund my Discover card the $5,500.00 they have charged it as I acted within the three business days allowed. I do not wish any further contact with Prosper Inc or any of its associates or employees until they follow the law and refund to my Discover Card the sum of $5,500.00.

The initial investment is charged at time of enrollment which was on 9/13/2013. Even though you had requested to cancel in those 3 days does not mean the funds will immediately show back up in you bank account that day. There is a refund process that we went through to refund you in full. We did cancel and refund the full amount. We show that as of 9/23/2013 your bank received those funds. Complaint: prospering or prosper convinced me I could get rich on the internet if I used their coaches to teach me. I paid 2,000 to them and lost it all it started out I saw a add on the internet on how to get rich by Anthony Morrison. This was in January or febuary 2013. I signed up to get rich using the internet and paid 49 dollars. The next day prosper called and said Anthony Morrison requested that prosper assign me a one on one coach to teach me how to get rich using the internet. They ask me how much money I had to invest in the program, I said 1,000 dollars. They took my money plus 200 a month from my checking account each month and to this day I have not made one penney using the internet and prosper continues to take my money each month

Desired Settlement: I want my whole 2,000 back. They did not teach me anything. They just took all my money and when I ran out of money, they stopped calling me.

Business Response: Initial Business Response /* (1000, 5, 2013/09/03) */ Contact Name and Title: ***** ***** Director of Student Care Contact Phone: XXX-XXX-XXXX Ex **** Contact Email: ******@prospering.com You have enrolled into our 12 month coaching program to learn and progress in building an eCommerce business opportunity. As we have discussed with you in previous responses, the commitments that you agreed to keep for the 12 months were not met on you end. You are currently still in you 12 month window. Below is the commitments that you agreed to upon enrollment... "Pa**, you were brought aboard because you committed to the following key commitments: 1. You will commit at least 10 hours per week to this program, and use the success center as directed by your coach. 2. You will keep the scheduled appointments with your coach. 3. You will take action on principles you learn, including doing all homework assignments, and report back to your coach as directed. 4. You will create and implement your strategy by the end of your 1st month in the program. 5. You will set aside between $1000 to $2000 during the first twelve months for marketing and development purposes. 6. You will complete the Enrollment Agreement, Student Profile, and participate in an orientation call before your first coaching session. During the program you had six one-on-one coaching sessions that you and your coach progressed through. You kept these above commitments great for the first two months, after that, you failed to call in to get the assistance you needed. We had spoken to you in regards to communications with our office and provided you the contact information to get a hold of the coaches as you needed them and as much as you needed them. That was not utilized by you. Till this day we have reached out to you a number of times to provide additional help and assistance, you have been non responsive. Due to the services rendered to date, a refund is not an options. Also, the financing charges will not be cancelled out. Again, we are more then willing to continue to follow through with our end of the agreement as long as you are willing to keep the commitments you initially agreed with. You did great in the beginning when keeping these commitments, but this is a 12 month program, not a get rich quick system. Please let us know when we can continue to provide the services you agreed to and we can both work together to accomplish the goals you have set. Final Consumer Response /* (3000, 7, 2013/09/12) */ (The consumer indicated he/she DID NOT accept the response from the business.) every time they called me they ask for a additional 200 to 500 dollars. I could not keep giving them money every time they called me. When I told them I was out of money they immediately stopped calling me. I invested well over the 1000 they say I was committed to spending. If they will coach me or 12 months and not ask for more money then im ok with more coaching. All I wanted to make was an additional 500 per month. They could not even show me how to make 100 dollars a month Final Business Response /* (4000, 9, 2013/09/26) */ Per our other conversations, we have reviewed all call recordings, and not at any time did a coach ask you to spend more money. We have a "time stamped" email sent from you asking if we could finance additional money for your website. At which point we had a representative of enrollment call you to address your financing options. However, you mentioned that you were not in a position at that time to qualify for any additional financing for the program resources. Within the email exchanges we have on file, you mentioned you will work hard and do all you can with the program to see success. After your weekly sessions you did not use the coaching resources the way we had told you to use them. If you had used the resources at the time the way they were intended, you would be in a different situation, as to opposed to the one you are in currently. Again a refund or cancellation of the initial financing is not an option. We are more then willing to provide extra coaching and assistance to help you reach your website goals and overall education. Please reach out to us to address those available options and to move forward.

Complaint: on-line School for real estate that has cost me $13,585.00. They told me I would receive all the information that I was going to need to start my own business in the mail in 3 days...I did not receive the box until days after that. When I received the package, I was shocked. The box was filled with the same books I received earlier from the television show I watched but with different covering....that was it! The information that I was told I would be receiving, I never got. I called and told them that I did not get the information that I was told that I was suppose to get and I was told that I would have pay and go to meetings that brokers hold for those who are enrolled in Prosper Inc., an on-line school...(WHAT!!!) and to find out more about the business, I would have to go on line to fill out other information and then someone would contact me from Prosper to get my on-line education in Real Estate started. I knew then that I was in trouble! The men that I had talked to earlier about the program, did not exist anymore and the telephone numbers they had given me prior were not contact numbers for them.

Desired Settlement: I have done everything I could think of. I have always paid my debts...but, I cannot pay for something I do not have or did not use. I called and cancelled the account immediately after receiving the books and was told by a girl in India, that I could not cancel the account, I can only close the account which I did. I'm looking for this debt to be cancelled from my history.

Business Response: Initial Business Response /* (1000, 5, 2013/10/01) */ Contact Name and Title: ***** ***** Director of Student Care Contact Phone: XXX-XXX-XXXX Ex **** Contact Email: ******@prospering.com The coaching program that you enrolled into was on 8/21/2007 and was indeed an educational program to help you gain the knowledge needed to invest into real estate. Looking at the notations we have on file, You folks called in to cancel after your cancellation period. that cancellation period was stated to you and was within your contract and agreement. This was stated to you during Verification and Enrollment which is recorded for legal purposes. We informed you that the cost of the program was a loan from a financial institution that needed to be paid back, and that after the cancellation period the purchase of enrollment is final. Again, we explained this to you in September and October of 2007. You folks had coaching sessions up until October of 2007 and when our coach had called the last time, you mentioned you did not want to continue. At which point student Care tried to reach out to you for months to address the options at the time, however, you folks were non responsive. To restate, this investment was a loan with a specific financial institution, we have no control of the credit reporting that they are doing based on your delinquencies. You will need to contact them directly to address those options. In regards to the Prosper coaching, we are more then willing to continue to work with you through the services we provide. It has been six years since the initial enrollment and the agreements have expired, but we are willing to provide additional support to you folks at this point in time if needed and wanted. Final Consumer Response /* (3000, 7, 2013/10/03) */ (The consumer indicated he/she DID NOT accept the response from the business.) They are lying! This is a scam and if someone investigates this company further they will see this. I called to try to cancel the credit that HSBC backed for this company and the girl who answered the phone was in India and told me I could not cancel it. I told the person who called my home that I wanted nothing to do with this and she said she felt bad because there was going to be no way I was going to get out of it. I don't want nothing from these people. I would just like for someone to truly look into this futher. The term folks their using is to sound friendly but these people are out to make money and what there doing is actually hurting the system. Please, if you cannot help me tell me what else I can do? Thank you.

Complaint: I believe they used deceptive sales tactics. They took advantage of my desperation. They led me to believe I would have one mentor for one year. This was not the case. I was assigned a mentor for two months, then told I could call and get help from a mentor. I got a different mentor each time I called. It became very frustrating to explain my reason for calling to different people. I felt the mentors really didn't give me good service at all. They also made me feel stupid if I said "No" to their offer. I'm sure my money was taken and put into an interest bearing account. It should be no problem for a successful company to refund $3,000.00 of the $5,450.00 that I paid. The training that is offered is of no value to me. I just want the $3,000.00 refund and I will be happy. A happy ex-customer is much better for business than an unhappy customer. The golden rule of business is: THE CUSTOMER IS ALWAYS RIGHT. I am also going to report this issue to the National Fraud Information Bureau and the Federal Trade Commission for Deceptive Sales Tactics. Please send the $3,000.00 refund check to my mailing address. I would prefer a FULL refund of $5,450.00 but I do understand this may not be possible. Thank you for your time and attention. Sincerely, ****** ********

Desired Settlement: I am seeking a refund in the amount of $3,000.00 or $5,450.00.

Consumer's Final Response /* (3000, 7, 2013/09/02) */ (The consumer indicated he/she DID NOT accept the response from the business.) I am actually not happy with the terms. The ONLY way I am going to be happy is if I get a refund as I requested in the first complaint. The only reason I agreed on the phone is because acccording to ***** "that isn't going to happen." Well, if that's the case, I want other prospective customers of theirs to be aware that their service is not worth the money they charge for it. ***** ridiculed me for not liking ebay and believing their services are not worth what they charge. I don't want to work with *****, ***** or any of the other people at Prosper. As far as I am concerned, they are all a bunch of smooth talking crooks. I want other people to be aware of this so they don't get duped and trapped into something they can't get out of. I am also going to report this issue to the National Fraud Information Bureau and the Federal Trade Commission for Deceptive Sales Tactics as I stated in my original complaint. ONCE AGAIN, THE ONLY WAY I AM GOING TO BE TRULY SATISFIED IS TO GET THE $3,000.00 REFUND!!! They don't need to bother wasting their time or mine by calling me again. Just send my refund....PERIOD. Please escalate this issue to corporate upper management. Thank you.

Complaint: The quality of service for the amount I paid is unacceptable and poor at best. Their resource line is not of the high standard they said it would be. I purchased Joe Vitale's Miracle Coaching Program through Prospering, Inc. on 3/13/2013 with a down-payment of $550.00 and to be billed monthly for $183.35 for one full year. After my 4 scheduled coaching sessions with a coach, I was to be one my own and to contact Prosper's resource line for help with the rest program which I was fine with. I was told I would be speaking with trained coaches on the resource line. There were many times when I would leave messages and not get returned phone calls for help, when I did get through and was able to speak with someone, they were rude, used belligerent language and were short with me. I also encountered getting my questions answered by a receptionist and not a trained coach as I was told I would be speaking with. I also encountered high pressure sales tactics to try to get me to purchase other and more in-depth programs for additional money to so called help me succeed quicker. When I called Prosper's billing department to voice my frustrations, unhappiness with their services and asked for a refund they told me flat out no! I then asked to speak with a supervisor and once again I was told no! I then told then to also discontinue my contract and once again I was told no! I do not appreciate being treated like this, especially for the money I paid so far, a total of #1,298.40 which i want a full refund for from prosper. I hope that the BBB can help get my money back from this company that I feel is being dishonest with their practices and over promising to their customers. I have also noticed and read from the BBB that Prosper has over 200 complaints in the last three years. This tells me that I am not the only one unhappy with this company and their services.

Complaint: Misrepresentation of the service provided in the sales presentation and no written copy of the contract supplied to me. I signed up for an Internet Marketing coaching course with Prosper in April 2013 as follow: - the sales rep ***** ******* said that if I paid an $8,000 fee, Prosper would provide a 12 month membership with Prosper which included one-on-one coaching for a period of 9 weeks and provide access to their Resource Center for 12 months, in order to teach me how to become a successful internet marketer that would provide significant income - the Prosper sales person said that the company provided a `money-back guarantee' for the course as follows: "That if at the end of the 12 months I had not made a return of my course fee from the business, Prosper would refund the $8,000." - I was shown an email from one of the `successful' UK students (similar age to me) whom Prosper had helped set up three websites within 6 months despite having no prior IM experience and was on-track to make $150,000 in his first year and $300,000 next year. - I said at the time (my wife was witness to the telephone conversation) that I was a newbie internet marketer and would need more than 9 weeks of one-on-one coaching - the reply given was that Prosper would provide additional coaching within my 12 month membership period to ensure that I succeeded - Prosper told me that it was in their interests as much as mine to provide additional coaching to ensure that I succeeded, because this would help with their future sales (see strategy above) - there was NO MENTION that this additional coaching would require an additional cost over the $8,000 that I had already paid. - I signed up with Prosper by paying Us 8,000 from a Debit Card. - at the end of 9 weeks, despite my working full-time on the course (300 hours +) it was obvious to all that I would need additional coaching (as expected) - Prosper agreed to provide an additional 3 weeks coaching at no cost to me. - in the meantime, I had employed two NZ web designers to set up my two sites ****************************** and **************************** at an additional cost of $3,000, that are targeting the travel and immigration market to Australia and New Zealand, which is a $35,000,000,000 per year value (6.5 M people per year). - at the end of this additional 3 weeks, it was agreed by myself and my coach that I would need an additional 12 weeks one-on-one coaching in order to learn how to market my websites. - I challenged Prosper about the additional cost based on my understanding that there would not be an charge for this additional coaching (see above) - the course fee of $8,000 equates to $660 per coaching session which is unreasonable (their Resource Center information can be found on the internet for free)and I have asked that they provide this additional coaching at NO additional cost to me - they are refusing to agree to this - as an attempt to move this stalemate forward, I offered to waive any further claims against the company (money-back guarantee - see above)on the basis that they provided this additional 12 weeks coaching at no cost to me - they have refused to agree to this -

Desired Settlement: - since they are not willing to agree to this, then I demand a refund of 50 % of my course fees ($4,000) which I believe under the circumstances is a fair outcome. N.B. `Word of mouth' also works in reverse - there are a number of review sites out there where Prosper is not doing too well!

Complaint: Salesperson used our shared religious affiliation,(co owners same religion too), to close the sale."You KNOW you can trust a fellow Mormon, right?" I CLEARLY specified to a salesman my inexperience in online comm & asked if PROSPER could coach me from 0 to 60.He PASSIONATELY said ABSOLUTELY.He said the 5 coach sess would be 45 min but I should plan an hr in case I had questions for coach,(Reality? they were 30 min).Salesman said he was in utah.I said I love Utah & wish I lived there. He said "are you LDS (Mormon).I said I was.He said he was too.He discussed how nice it would be for me to feel safe knowing that the owners of PROSPER were all LDS because I would know their values, that they're trustworthy,(USUALLY TRUE!, so it comforted me as I worried about giving PROSPER the last of my savings,$1100 cash, & committing to a year contract to pay $2000 MORE! After committing to the contract the salesman said my Orientation wouldn't occur for a week & my first coach session not for 10 days! because they were SWAMPED RIGHT NOW.HOW CONVENIENT THAT THEY WERE SWAMPED. I FREAKED OUT!How would I know if the coaching was right for me with no way to try it out before the 3 day cancel date? The salesperson REMINDED ME of our discussion regarding our shared religious beliefs & assured me of the owners' shared core principles & he cajoled me so I'd have absolutely no worries. My first "coaching" session with **** ********* was a terrifying joke.Nice guy, but the whole session, which was NOT 45 min but only 30, was a very expensive "shoot the breeze kind of thing"."You need to BRAINSTORM *******." I panicked. I, an almost destitute senior citizen am paying these people $3100 to "coach" me about BRAINSTORMING"? I made a frantic call to the Helpline & sent a concerned email to my coach,(no answer),but I was reassured by the Helpline that the second coaching session would be different.NOPE!AGAIN IT WAS "YOU NEED TO KEEP BRAINSTORMING" *******. I told my coach I'd been told he would assist me from 0 to 60 & he told me I'd been misinformed. He said Prosper services are more suited to people ALREADY FAMILIAR with online commerce, often with an already functioning company needing help expanding their market!!! That very moment I told my coach I wanted out.Prosper wasn't for me.I'd been misinformed & carefully mislead on several key issues in order to induce me to put my name on the contract. My coach, **** ********** said I needed to talk to Corp.about cancellation. He assured me he thought they'd refund my $ and release me from the contract since Prosper seemed inappropriate service for my needs & inexperience & continuing to hold me liable wouldn't serve me OR the company's reputation, ultimately. The following week at the pre-scheduled time I did not receive a call #3 from my coach.I guess he just ASSUMED I was out of the picture, that I'd settled with the company, apparently. At that point,it's obvious the company BROKE the contract.I was promised to have 5, 45 min coaching sessions (which were only 30 min)every Wed. at exactly 4:30 PM Pacific Standard Time. I never had another coaching session. When I finally got in touch with **** ****(Corp.), he was absolutely immovable RE: refunding my $ or rescinding the contract..There was NO WAY they were letting me out of the contract. He offered me 3 additional coaching sessions which I refused because of the manipulative tactics the company salesperson had used to induce me into the contract, & they had already broken the contract by not calling in my #3 coaching session,& the 2 coaching sessions I had had were absurdly devoid of ANY valuable content & I'D HAD NO OPPORTUNITY TO KNOW WHAT THE COACHING WOULD BE LIKE PRIOR TO THE 3 DAY CANCEL RULE.There'd been no coaching at all.Mr. ****' most recent offer of settlement involves letting me out of the contract but keeping my $1100 cash because, and I'm pasting his comments from his actual email to me here..."That is correct: coaching sessions were used, products and resources were given, employees time was absorbed. We ask to retain that to cover what was used".I PAID $1100 FOR 2 HALF HR BRAINSTORMING SESSIONS!

Desired Settlement: I expect a full refund of my $1100 cash and a cancellation of the contract involving the additional $2000.I was not given the opportunity to experience any part of the "product", (the 5 "coaching" sessions), prior to the allowed 3 day cancellation period, because ONLY AFTER committing to the contract, did the salesperson tell me that my first coaching session wouldn't happen for 10 days BECAUSE THEY WERE SOOOOO SWAMPED!I SHOULD have been provided with a coaching session within those first 3 days so as to decide RE: cancellation options!!!To prevent me from backing out of the sale at that point, the salesman cajoled me into being confident about the sale by using our shared religious affiliation, and that included ALL of the principle owners of Prosper..."we are all Mormons," as HE and & later, my coach, stated. He peddled their core values to me, which I would "KNOW" are the same as mine and "they can be trusted because we are all LDS." None of the videos on the website even APROXIMATE what happens during a coaching call,so there was NO WAY FOR ME TO CHECK OUT THE PRODUCT on my own BEFORE THE 3 DAY CANCELLATION MORATORIUM expired. Moreover,I found through research that after the 5 coaching sessions are completed, the only remaining "coaching" available to a client for the remainder of their contract is through the video library, similar contents of which may be found on YouTube for free!,or "coaching" through the company Helpline which offers no professional people at all...no trainers,no coaches,it's just a low level Q&A calling center. My salesman absolutely lied to me also by saying that I would be taken "from zero to sixty" in the process. Not true.Prosper is best suited to people already in online commerce looking to expand. The salesman had told me Propser would be coaching me informally for the length of my contract with them, even after the 5 official coaching sessions were done. That is not true either! So apparently, the only value of my $3100 contract was to be found in 5 one on one coaching sessions,(of which I received only 2!),promising to coach me thru the process of starting an online business from start to finish? Well, 1 week after I requested consideration for cancellation based on the above concerns,MY COACH DID NOT CALL ME AT THE APPOINTED TIME FOR COACHING SESSION #3.I guess he just assumed he didn't need to because I wanted to cancel? But no settlement had happened between me and the company yet. At that point, THEY BROKE THE CONTRACT WITH ME AND I DESERVE FULL CANCELLATION OF THE CONTRACT AND A FULL REFUND OF MY CASH! On July 3rd, I, an otherwise very healthy 60 year old runner & snowboarder, had a stroke which has left me with faltering speech and lingering (and frightening!)health challenges. I cannot help but wonder if the stress this company & **** **** have put me through aren't responsible for my currently compromised health.I strongly believe they are. On behalf of his company, **** **** recently offered to cancel the $2000 contract but said RE: a refund, and I quote from his email,"That is correct: coaching sessions were used, products and resources were given, employees time was absorbed. We ask to retain that(the $1100 cash) to cover what was used." sent July 8, 2013 1:19 PM... So, I paid Prosper $1100 cash for 2 half hr coaching sessions in which absolutely NO coaching occurred! And now their finance company is harassing me day and night,24/7, while I am struggling to recover from a stroke. Since the stroke,I feel basically like a walking brain-time-bomb, and this company and it's collection agency are daily adding to my deadly stress.

Complaint: Never delivered what was promised, belligerent attitude from Customer Service personnel. I had signed up for their coaching program after seeing their ad on *** V**** website. First off this is a scam you think you are signing up for coaching with him or his team but you are not. They are just paying him to market the coaching plan. They pressure you into signing up for one of their contracts on the phone, when you do- thinking you are getting a great program- you then find out the negatives. 1. They promise things on the phone that they never deliver. 2. They won't schedule times with you, you have to call them when you think you need coaching. - I have been with many different types of coaching and this is the first I have ever had to call them to set up appointments and not schedule a set time. 3. When you do call, they do not answer the phone. 4. They do not return phone calls. 5. After being upset I had finally gotten through to someone, and he proceeded to yell at me on the phone and blame me for the fact that things are not working. What kind of talk is this from a Customer Support person let alone a Coaching company. I will never use this company again and I would not recommend this company to anyone. Never, Never deal with them.

Desired Settlement: A refund of all charges to date

Business Response: Business' Initial Response /* (1000, 5, 2013/07/12) */ Contact Name and Title: ***** ***** Director of Student Care Contact Phone: XXX-XXX-XXXX Ex **** Contact Email: ******@prospering.com We actually do the one-on-one coaching for *** ******* this is his team and we are contracted out and we are is fulfillment. The program is the same principles and curriculum from *** ****** and all of his resources are available to you through the program you enrolled into. We spoke to you a few times recently in regards to your issues and explained to you the agreement that you agreed to with us. You pay a monthly charge to be able to call in to a coach at your convenience. You disagree with the method of this program and that is fine, however, you knew going into this specific program that this was the service provided. Below is a part of that agreement... "To get started... You will need to log onto the website (www.thesuccessnetwork.com) then call the Resource Center within the next 24 hours to go through a personal orientation with one of our Resource Advisors. This call will not go against your allotted Resource Line phone access. He or she will show you around The Success Network site and help you get started. The Resource Center is open Monday thru Friday, 9AM to 5PM Mountain Standard Time and is closed on Saturdays and Sundays. The Resource Line number is 1-866-748-3566 (if you're an international student, please call XXX-XXX-XXX-XXXX). A coach will NOT be calling you on a weekly basis, but The Success Network does provide you with Conference Calls and access to the Resource Center where you can talk to our representatives and ask any questions you might have." As you can see the specific program that you enrolled into is where you needed to call into to get the help as needed. We spoke to you last in this regard on 1/10/2013 and this was the last time we had heard from you when it came to coaching. We mentioned to you recently when you contacted our office that you needed to call in to get the support and services you paid for. The charges will not be refunded as it was clear on what you needed to do to utilize the services. Again, as we spoke to you on the phone we waived the early termination fee and cancelled you out of the program because you stated "you are not able to utilize the services" You are cancelled out of the program and there will not be any refunds with the earlier monthly charges.

Complaint: They have you sign up with the promise to make money then you don't make any and they wont cancel or stop the service. I signed up with prosper with them promising that if I followed their way they would make me money including enough to pay for their services and I have done everything they asked even in the first 4 weeks and never made money and they said I would. When I called to cancel they said they would not cancel or do anything to correct the problem and that I am responsible for all cost even though they did not fulfill there promises.

Desired Settlement: A full refund for my last payment and cancellation of the contract and service.

Business Response: Business' Initial Response /* (1000, 5, 2013/07/08) */ Contact Name and Title: ***** ***** Director of Student Care Contact Phone: XXX-XXX-XXXX Ex **** Contact Email: ******@prospering.com When you initially enrolled into the program on 3/11/2013 you signed up for a 12 month coaching program where you were also financed 2,000 dollars. Upon enrollment you had agreed to certain commitments that you would need to keep for 12 months. You did great with these commitments the first month, however we had never spoken to you after your fourth one-on-one coaching session. when you enrolled the contract states your allegation bases on earnings: "You understand that this program is strictly educational and that no claims of future earnings have been presented to you by any representative of Prosper, and that we do not represent you will earn any specific amount of money". Again, the program is educational based and that is simply why you have not seen the results you were hoping for because again you have not utilized the program the way you initially agreed to. The first time we had spoken to you since your 4th coaching session was 6/27/2013. At that time you mentioned that you lost a job and could not afford the monthly payments and acknowledge that you simply never called into the resource line for help. We had encouraged you at that time to use the services to help better your situation. A refund will not be an option. Also the monthly charges will not be cancelled out per the agreement that you have with us. At this time we are willing to provide additional help if needed as well as making sure you are aware this is a 12 month program and it takes time and the consistent effort on your end to see the results you are looking for. This consistent effort has not been done thus far. The access to the Resource Line on a daily basis will be available to you, as well as we can discuss adding another session or two to help jump start your business opportunity since you had not been in contact with us for months. Please let us know and we can move forward with those options. Consumer's Final Response /* (2000, 11, 2013/07/18) */ (The consumer indicated he/she ACCEPTED the response from the business.) As to the agreement we were able to set up both of us are happy. Business' Final Response /* (4000, 9, 2013/07/16) */ Thanks for speaking to me this evening on 7/16/2013 in regards to the issues you have brought to light. Per our conversation, we had came to a mutual agreement to continue to work with one another once again. Please contact the coaches via the Resource Line to get the assistance that is needed and to continue to move forward.

Complaint: I cancelled their program in the summer of 2011 and now I am seeing charges from them on my credit card. No return phone calls. I cancelled their program in the summer of 2011 and now I am seeing charges from them on my credit card. I have called them during business hours and no one answers, I have left voice mails and no one returns my calls. They are stealing money from me and I cannot contact anyone there. I do not have enough money to contact a lawyer, nor can I deactivate my credit card because my credit score is low enough as is and they are taking advantage of me. I want my money back asap not months from now. I have proof they are taking money out of my credit card and it just started in January and I don't know why. I am looking for the paper work where it shows I cancelled their program. I no longer have the email address I used with them, yahoo says it is available for use. This needs to get resolved SOON or I will be out of cash and lose my house and everything I own.

Desired Settlement: I just want the money they have stolen from me.

The rep in our student care department mentioned to you that we will refund all charges since January 2013 to June of 2013. We have made sure that this monthly charge is cancelled. You will not be charged that tax preparation fee any longer. Also, there were three disputes that you made with your bank in regards to the most recent charges. We informed your bank that those charges should be reversed and refunded back to you. So those charges may take time to appear in your account due to the dispute process. If you have questions you can contact your bank. Again, we have refunded and cancelled out the monthly charges as requested. Final Consumer Response /* (2000, 7, 2013/07/12) */ (The consumer indicated he/she ACCEPTED the response from the business.) I have received the money, but I am not convinced that this will not happen again. I made it clear to them to delete my credit card from their system so this does not happen again.Very poor customer service when talking on the phone with them.
