Can't Pay Your Mortgage: What You Should Do

Lost your job. Bills are piling up. Can't pay your mortgage. What's the first thing you should do?

"Call your lender. Let them know what your situation is," Deb Bortner, director of consumer services at the state Department of Financial Institutions, tells KOMO News

Free help is available by calling a HUD-approved counselor. They can tell you what programs can help you get through your situation. 

What you have to be careful about is cold calls offering to help solve your financial problem. There are a lot of scams going around right now where con artists will want you to send them money upfront and you'll never hear from them again.

I am in the military and almost ready to change my duty station (involuntarily of course) and my home value is almost half of what I purchased the house for. I have been trying to modify my mortgae with Suntrust Mortgage and they keep ignoring my calls and dozens of messages. It is just ironic to see companies portray an extremely customer oriented service to hook the customers and a careless service once they have you on board.

Litton Loan gives consumers the run around regarding their mortgages. We have on several occasions tried to "modify" our loan with no success. They tell you to fax in this document or that document, then need additional information and to send that in....you are wasting your time. They won't do anything. Another problem we have with them is we switched our homeowners insurance companies and have paid that premium in full, providing that information to Litton Loan...because they REQUESTED it. They are still requiring me to pay the insurance, even though i already have. I've tried to tell them that so and so (not to name MULTIPLE names) and have the dates that i spoke with them. They then send you a letter denying your request....they always "DENY" your request whether it be for loan modification or having your insurance removed from your escrow account. I cannot express how much this company has LIED to the consumer. We have an ARM with them (old company sold our loan). Bottom line...don't waste your breath with them....you won't get anywhere. We are having to consider spending more money to "refinance" to get away from this HORRIBLE company.

This is how my loan modification with wells Fargo is going.
6/9/2009 - Faxed my wife’s paycheck receipts, my unemployment info and hardship letter to Wells Fargo Lost Mitigation August 2009 8/12 - We received notification that our request for loan modification was denied 8/19 - We were sent info regarding short sales and Realtor short sale guide. Called Wells Fargo and told them that I had no intentions of doing a short sale and was told to resubmit my paper work. 8/26/2009- We re-faxed the info to Wells Fargo Lost Mitigation.
9/8/2009 – Rec’d notification that we were accepted into the Home Affordable Modification Trial period plan.9/10/2009 – Called Wells Fargo – Asked for a break down of how they came up with the loan amount of $1419.20. (I felt the calculation was incorrect from the information I found on Freddie Mac website. (The guidelines for making homes affordable calculates 31 percent of your gross income and that should be the new payment) then the new payment should be $1160 per month. I could not get wells Fargo to recalculate my trial period payment so I did not send in the paper work to start the program and told them that I WOULD NOT CONTUNUE WITH THE PROGRAM until the trial period payment was recalculated. Continued to make the full house payment of 1649.49
February, I found out that Wells Fargo had not been applying our monthly payments to our account, causing there to be a negative balance in escrow for the homeowner’s insurance payment. Did a credit check and found that wells Fargo has reported that we have not made any house payments sense October 2009. Even the Trial period plan paper work from wells Fargo states “ the lender will hold the payments received during the trial period until the total amount that is enough to pay my oldest delinquent monthly payment on my loan in full” since I mad each payment in full they still have not applied any of the payments to my loan. I didn’t accept the trial period so how is well Fargo holding my full monthly payments.

I am a victim of a home modification program called ARI and Asssociates. I saw them on T.V. as a government recommended program for people that need help making their mortgage payments. I called them in July of 2009 maybe sooner, and signed up to get a modification loan through them. They claimed that I qualified under my circumstances and that they would not approve me unless I did so, further saying that if for somee reason the modification was unable to go through I would be refunded my 1300.00 Pymnt. Then in August they informed me that I needed to make payments for a few more months to mature my loan to year , so I agreed. Then I had heard from them till I notified them in December tofind out whatwas going on. By this time I had worked with three different employees due to the previous ones being fired. They had now told me that the mortgage company{WELLS FARGO} had said there was enough equity in home to refinance and would not approve my modification. I then contacted Wells Fargo to find that during all this they had added an extra 4-5 thousand in interest ontop of my loan and raised my payments as an agreement for modification. Ari. told me that I would receive my refund after sending in written request. I immediately sent my request and have been continouly ignored by them since. To sum it all up, I payed 1300.00 Dollars for a modification that increased my loan amount to over its retail market value and received a higher payment. I hope to find me some legal help in getting this company a lawsuit they will never forget. I am now facing immediate forclosure and have no or money to do anything about it.

I tried a full year to get a modification and they kept telling me to make my payment I'm getting a loan modification because I can't make the payment. I finally couldn't make it any more and I kept calling them seeing why they're not doing anything and then they would say they need more paperwork etc etc. I finally had to hire someone to help me with this and they told him they want my house! My favorite thing is there are hundreds of stories on the internet that are identical to mine! Then they sent me a letter saying after reviewing my account they are going to raise my payment a hundred dollars? can they even do that? These people need to be stopped! Please someone help all of us hard-working homeowners who just need a little help!

I'm dealing with Litton Loan as well and they do not want to help at all. My mortgage is more than I make and they keep telling me to just make the full payment. How am I suppose to eat? or pay my other bills. They don't want to help nor can I find help anywhere.

It isn't ONLY the scammers doing the scams. Loan Servicing companies are giving homeowners the runaround, rather than giving them the loan modifications that they are eligible for. It is unfortunate, but if you need a loan modification, and you are dealing with a LOAN SERVICER, rather than a bank, you DO need to get an advocate, otherwise, they will give you a runaround. They make far more money foreclosing than doing a modification, so they profit by refusing to modify your mortgage. I am dealing with Litton Loan Servicing and it has been a real nightmare.
