BBB Gets Junk Fax from EnviroFax Commission

How to reduce junk faxes

The Better Business Bureau gets junk faxes too! Recently the BBB serving Dallas and Northeast Texas received an unwanted fax from EnviroFax Commission that raised a lot of questions.

What does the fax from EnviroFax Commission offer?
The fax is headlined “Fax Us Your Unwanted Faxes” and gives a toll-free fax number. The offer: “We will contact the sender and have your fax number permanently removed from their fax list.”

The BBB notes that, under a Federal Communications Commission (FCC) rule, anyone can “opt-out”, or ask to be removed from a fax sender’s list. No one is required to send a fax number to EnviroFax Commission or any other service in order to be removed from a sender’s list.

What is EnviroFax Commission?
According to the fax, “EnviroFax Commission is a nonprofit corporation. Its assistance is FREE. EnviroFax does not sell goods or services and will not contact you.”

The BBB in Dallas hasn’t been able to learn any further information about EnviroFax Commission, or confirm that it’s a non-profit organization. An Internet search didn’t turn up a Web site or an address.

Why is EnviroFax making this offer? What is EnviroFax doing with fax numbers it collects?
EnviroFax claims it is offering this service because “Many recipients do not take the time to remove faxes or opt-out improperly which results in continued unwanted faxes.”

Why would an organization offer – for free – to help recipients stop unwanted faxes?
One guess is that EnviroFax Commission isn’t a nonprofit organization at all, but is a business. EnviroFax might be collecting active fax numbers (that is, numbers that recipients fax back from) in order to use those active numbers to send additional faxes or to sell to fax blasters.

How can you stop junk faxes?
If the fax has contact information for the junk fax sender, send an "opt-out" request to take your fax number off the sender's list. Your request must include the fax number or numbers for your request, and must be sent to the telephone number, fax number, Web site address, or email address on the unwanted fax.

We received one of these fazes this morning; does the BBB recommend faxing an opt-out request to the fax number Envirofax provides? I thought it might be ironic to send them back their fax with a note that says, "This is an unwanted fax; please unsubscribe fax # (x)." But then, that might be playing right into their hands, so I'm not sure what to do with this.

We received this unsolicited fax on 3/25/11. I have been diligent with opt-out responses, but did not notice a significant decline with junk faxes until I registered all our phone numbers on the Do Call Registry. I pay for communication services so that my CUSTOMERS can contact me and allow me to reciprocate. I believe that just because I have a "business" phone number does not open the door to its abuse and I do not apologize for passing that message along to the few telemarketers who dare to call my business. Besides, I keep an air horn beside the phone for those who persist. It's too bad that I am unable to exercise that tool with unwanted, junk faxes. For those entities that do not list opt-out numbers, I have called them (from the fax line) and asked them to remove our fax number, with a high rate of success.

We just got one here in Walnut Creek, CA today as well. They don't give an 'opt out' number on their fax either. Just the number to send the unwanted faxes to which is the same number as the one Brant in Mill Valley replied with and i've got no desire to reply and confirm anything to them.

Here's an interesting comment from the Mother Nature Network website... "According to the Federal Communications Commission or FCC (a commission that really exists!), it is illegal to send unsolicited ads to any fax machine — whether business or personal — without the receiver's invitation or permission. But these same ads can be sent to a fax recipient if the sender has an established business relationship as long as the fax number was supplied on a voluntary basis. This could be via the Yellow Pages, a website, business card or other sources such as an application, unless duly noted that unsolicited documents are not accepted. For EnviroFax to develop an established business relationship with my store (and fax machine), all they needed was me to willingly give them the fax number they already had on file..."

We're in Mill Valley, California and just received one from these folks. Listing their fax number as 877-661-2907. I don't recall any of the CAN-SPAM legislation covering our legal rights when it comes to faxes, so don't even bother responding to these faxes until there is legislation that controls unwanted solicitation.

It clearly states on the fax I received this morning. "EnviroFax does not sell goods or services and will NOT contact you." But if they faxed me... didn't they contact me? That's like me saying I'm not going to post on this message board.....

Seems like since i have been faxing opt out's to enviro, i get a new junk fax everyday. I'm going to stop.

It struck me as odd a company would send me an unsolicited fax offering to stop unsolicited faxes.
