CONTRACTOR PAYMENT 1K LT 20K DOL VIOL PERMIT WORK (8761) (489.126 2):

This charge, often referred to as Misapplication of Construction Funds, applies to a contractor who has received payments of $1,000 or more, but less than $20,000, for work that requires a building permit. The contractor is accused of violating the law by failing to use the funds to complete the work for which they were received. This is considered a third-degree felony.


CNTRCTR FAIL REFND EXCESS VALU WRK 20K LT 200K (8766) (489.126 3):

This charge is also a form of Misapplication of Construction Funds. It applies when a contractor receives a payment that is $20,000 or more, but less than $200,000, and then fails to refund the excess amount to the customer for work that was not performed or materials that were not supplied. This is considered a second-degree felony due to the higher monetary value involved.
