Complaint: ******* Subdivison almost every bylaw in the covenants is being broken. It is managed by C Dan Joyner,the manager of ******* is **** ****** plus we have and HOA. If the home owners complain about a house not following the bylaws, **** say's they have been sent a letter and if they continue to break the laws they will put a lien against their house. The residents do not care if a lien is put on their house because, they know that all a lien does is keep them from selling the house or refinancing. All home owners are to pay a yearly $250.00 HOA fee, the ones that do not pay their fee's then the one's that pay their fees have to pay the ones that don't. The home owners that pay their fee's are being punished, for doing the right thing. The only amenities we have is a small play ground that has a swing set, slide, octagon crawl on, a bench and a garbage can. Most parent will not let there kids go there to play because, there is a drug house in the neighbor hood and, they sell drugs at it. In the bylaws it says Vehicles are suppose to park in their drive ways but do not. They continue to park on each side of the road, making it hard to get through the street. After calling **** and complained about it, she said there is nothing she can do because Greenville County owns the roads. I called Greenville County and talked to them about it, they said they take care of stop signs, potholes and pavement, and the management was suppose to manage the roads all so that they did not have enough man power to do this. They also said this needs to be addressed because an emergency vehicle would not be able to get through. I called **** ****** to tell her what the county said, she got mad and slammed the phone down on me. I called her boss and she was remanded. The next day I received a register letter from her saying, if I ever bothered her again she would have me put in jail. The other week and elderly women down the streets bedroom window was shot through. last week I found a 9 millimeter gun be side play ground,

Desired Settlement: Drop our fee's to 100.00 a year, and get Rid of C Dan Joyner managing property and, have the HOA take care of it.They are shooting almost every other month. I received a letter to paint my mail box within 15 days or be fined 50.00. Yesterday I counted over 10 mail boxes that have never been painted, and I received the letter on May 9, 2013. There are unsightly unkempt conditions where garbage is every where, I could go on and on about how bad this neighbor hood is but running out of letters

Business Response: C. Dan Joyner Property Management Company works for ******* Subdivision under the direction of their HOA Board.  We do monthly drive-thrus and inspections to monitor any rules being broken, maintenance issues, etc...If there is something to note (ie. mailboxes that need to be painted, trash that needs to be cleaned up, vehicles parked in illegal places, etc...) we report to the board and they let us know who needs to be sent letters.  The letters may be warnings, fines or just information.  This is the process that our company uses with 100% of our HOA customers. ****** *********'s other complaints of drug houses in the neighborhood, weekly shootings and guns being found on the playground are issues that need to be reported to the police.  We would like to be informed of these issues, which we weren't, but unfortunately we don't have the authority nor are we qualified to raid drug houses or to clean the streets of guns. Frankly, these complaints seem exaggerated and/or simply untrue.  ****** was sent a letter but not for the situation that she stated.  She was sent a registered letter on behalf of the board that stated she shouldn't approach the property manager while on site.  The main reason she was told not to approach the manager is for her safety as well as our manager's.  This was because she ran out into the road with her dog and stood in front of the manager's car and wouldn't let her pass while the manager was conducting a monthly drive-thru.  The letter didn't saying anything about her getting sent to jail.  It did say that our manager would have approval from the board to contact the authorities.

In regards to ******'s desired settlement, It would be in the HOA's, the boards and anyone else in the community's worst interests to meet her requests. By reducing their yearly dues by 60% (from $250 to $100 per year) the board wouldn't be able to cover their monthly bills (even if there wasn't a property management company).  Also, getting rid of C. Dan Joyner Property Management Company would be a decision that the HOA Board would have to make.  I don't think that will happen considering their response to these complaints - "I think (****) and CDJ do a great job.  Our community has taken a turn for the better since you have taken over, ****.  We have made lots of improvements financially and aesthetically in the past year. Most of what (*****) said in the letter is probably not true.  She exaggerates every story she tells.  Please let us know what the board can do to help with this matter."

I am writing you this letter about my complaint against Prudential C Dan Joyner Co, Realtors. In the e-mail I received from you asking for the signed contract I signed with the firm
about the Protective Covenants for ******* Subdivision, I do not have a copy. I was not informed about the HOA yearly fees till after closing on my house. After closing on my house the, Prudential Relator **** ******** informed me that there was a HOA yearly fee every year. ** ******** told me he thought it was $175.00. I was really upset with this information being with held from me. If I had known about the HOA, I never would have purchased my house. If I signed a contract they slipped it in on me because, in my file from the Attorneys office
**** * *****, Attorney ***** ***** did not have a copy of the Covenants in my file.

After getting moved and settled in at the end of July of 2011, I Called C Dan Joyner, I think it was sometime in September of 2011. I asked a Lady, I don't remember her name if she could mail me a copy of the covenants. The lady said no that, they could not afford the postage and I would have to come pick them up. The next day I drove down to there office on Pleasant burg Rd. in Greenville, SC and picked them up.

At the time when I moved in, there were no amenities. I had no idea there was a HOA here, this is such a small subdivision with no amenities. I went to the first HOA meeting, it was there I found out that the yearly fee was not $175.00, but $250.00 a year. I asked them why we had to pay such a large amount, they could not really give me and answer. Then they voted on building a play ground. I asked them who was going to clean up all the trash in the subdivision, they said if you see any pick it up. Then they asked for volunteers to meet the next Saturday and clean up all the litter. I did not volunteer because, I think that if I have to pay that much in yearly dues then, they should be responsible.

My next door neighbor volunteered, when she was returning home I asked her how much litter they had picked up. She told me that they picked up four truck loads.

C Dan Joyner, prorated my first year from July 2011 to December 2011. I ended up paying $112.00. Then for 2012 I paid 250.00.  So, I do not have a signed copy of where I was told about the Covenants. I only have the copy I picked up. I will mail them to you as soon as I get all papers together and pictures together.
