We ordered the tank on Aug13 and were told to get delivery in about 2 weeks. Then we were told delivery was the week of Oct. 10, 2021, and no delivery was made. End of October was told we would receive $250 in refund. The second week of November, we did not get the delivery and were offered to $500 and a temporary tank to use at no charge so we could move into our house by Thanksgiving. The temporary tank was delivered and was told that we would get the credit of $500 after the delivery of the 1,000-gallon tank. Once the 1,000-gallon tank was received by ******* gas the first week of January when asked about the $500 credit told that we would get it after the tank was installed. But when we called after, were told the representative was fired who had no authority to give us the credit. They would not give the credit and also refused to pay anything for the delay. Under the Uniform Commercial Code , there is a contract breach here and we have right to get compensation for our damages including the expectation damages. As we calculated, we had more than $500 damages since the gas price went up after 6 months from the cold season to peak season, we also got charged $200 for extra installation fee because we could not get the tank as promised instead of getting a temporary tank first. Under the Restatement(Second) of Agency, all your representatives all have apparent authority and the Galwayco-up is the one who is liable for what your representatives' action. We are seeking for compensations by communications before we bring the case to the court.
