Complaint: My Complaint is of Miller Nurseries at Canandaigua, New York. I will try to number each page and tell you what they are.

1 - is the order sheet from their web sight note that I ask to be told when shiped.

2 has been there and still is

3 & 4 - recieved onorder day

5 - I had not recieved any information on order so was checking with Miller.

6 - This is my respounce I recieved from Miller after emailing them. I guess I would have though that they would have let me know ahead of time so that I could have looked some were else. I dose not look like they were going to say any thing because when the things that got sent name there was not a thing about why the colette trees were not in the order. It looks like they were trying to pull a fast one by not saying any thing. The only time I found out was when I emailed them on 05/23/2012. I had been checking our credit card history and found that they had charged us. Then they charged us for the full order. The bad part is that we need the other colette so that the trees we got will produce or this is what their sight is telling us. I boght the trees for my children so they each get one of each tree.

They state that they check the weather in the order area, but that can not be so, our apple & plum trees here had already blosemed out and had marble size fruit on them. frost was out in mid april and we had extra warm weather here and I dounder stand that they do not want to send to early and I would
not asked for that because of the warnty it would just maybe make extra work for both sides.

Desired Settlement:

Business Response: When you are dealing with live nursery stock, you take the chance of some of the stock not being up to the standards that it should be to be shipped out. If the stock does not meet the shipping requirements, we can not allow it to be sent to the customers. That is what has happened in this case. Once the order reached our shipping department, they could not send the trees ordered because they were not in good condition. Therefore the order was placed onto a backorder for the fall shipping season. Since the customer does not want to plant in the fall, we can cancel the backorder and credit the credit card back for the sold out items. I told the customer this is an email that was sent out on 5/24/12, when I tried to resolve the problem. The customer has neglected to include that email, however we have tried to resolve this matter with the customer. Please let us know if customer would like the backorder cancelled and his money returned, and we would be glad to comply. Thank you.

I have reviewed the response made by the business in reference to complaint ID *******, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.

Miller says that I did not send you the respounce about the refund but I did send the final e-mail I had recieved from them. Not that I did send every respounce between us from order date. Note that from order date I did not get any message from miller about anything about the order. I did get a respoune from asking about the order one day ahead of recieving it, other wise I would have not known I was only getting a parcial order. Had I had the oppertonity to cancel before they sent I would have canceled and found the product else were. I think it is verry stupide business to have a order set up in February and not now until the end of May you can not fill the order. I feal that the way they operated the did not even intend to inform me. The package I recieved did not state any thing about the order. THey also state that they do not send product that is not fit but the two trees I got I feal are not fit. It still looks like they were afraid I would buy else were and I would have. They also said they would not charge for order before sent and they did. (web sight notes). That order was suppose to be an order for a gift for two different people, but guess what they got 1/2 a gift. I feal I am intitiled to some kind of compansation for not informing me and all the trouble they ignored. They also say that they would be srnding the order when time to plant and that they would be checking weather and such in our area. That did not happen because part of my order was aspargrass(sp) and we had been picking some of the same kind I bought last year and ordered this year along with some that grows wild here  for better than a month before they sent this years order. I bought last years at our local ******** (18 plants) 6 per package, but wanted a larger amount 100 plants. They are doing good.

Sorry about taking so long. I guess we would like the trees yet, but why can’t they refund the money back to my card until they are shipped.

Unless they want to pay the 18% interest I would have to pay. Why should they draw interest from my money ?  I thought buy their web sight that They were a company that really new what they were doing. I guess what I am wondering is over all the goof ups they created what really happens To them, a slap on the hand and they can keep on playing what I call a crocked game. Another thing what kind of a warranty will I get.  Enough for Now I will just keep repeating my self on how they operate and get away with it. I am sure I am not the first.

Business Response: If the customer would like the credit card credited back at this time, and charged again when the trees are actually shipped out we would be glad to comply. If the customer would just like the backorder cancelled and credited back to the credit card we would be glad to comply. I just need to know how to proceed with this matter. I thought I pushed except but guess I did not. I ment to but still think they are playing game with my money.

Below is my opion of Millers and I am giveing them free advertisement.

It seems to me that Millers is run by a bunch of clowns. If I remember right in my last response I said I would like a 18% interest or they could refund my account and recharge in the fall when and if they sent out my order. I do not have any promise of even getting the order than. So than they would have my money tell the spring and the way they operate how do they know if they are going to have the trees than they can not tell three or four months ahead. As you see they  already played a game were they have ended with interest for 2 or 3 months more with my money.  What kind of foul does this place take their customers for thinking a product should be paid for 6 months ahead of time. I have never seen a place run in circles as much as this place. These trees that I was purchasing was kind of a legecy for my daughter and son but when you deal with some one who does not know how to be honest with their customers I guess this is what happens. (This part is kind of a repeat) but I think it very dishonest not to let the customer know that they could not fill the order until the day before delivery I recieved it on the internet because I sent and asked by E-MAIL.  I hope they get some one in CUSTOMER SERVICE that acually knows what they are doing instead of treating their customers like idiots.    MY OPION THEY CAN'T MAKE A LIVING ON HONEST MY THEY HAVE TO STEAL FROM CUSTOMERS and draw intrrest that way. Is that not what they did when they made me pay for a product they did not send. To me that is stealing. Nothing would happen but maybe it shoul be turned into some legal organizedation and all their local customers would see how they operate.

Business Response: This has really gone on long enough now, and this going back and forth is just silly. The paperwork has been put in and we will be placing a credit of $43.60 back onto the credit card and this will be done within the next two days. The $43.60 is $41.90 for the price of the two trees, and I also gave back part of the packing and home delivery of $1.70. When we begin to ship in the fall the credit card will then be charged for the $43.60, and that is usually done about one week prior to shipping the order out. Our fall shipping season will begin in the late part of October, once the stock has gone dormant and can be dug from the ground. If the customer decides that he does not want the order, he can either email ****** or he can call our toll free telephone at ###-###-#### and we would be glad to cancel the order. This problem could have easily been handled if the customer had just called our toll free telephone number back in June. I hope this helps.
