Complaint: We bought a home from owl homes on 10/10/2014.They were paid to fully set up the home including connection to the septic system.They did not do any septic system work at all.They were paid in full as per the contract amount,but refuse to give us the title to the home.

Desired Settlement: We are seeking the title to the home.

Business Response: Customer's complaint refers to Owl Homes of Fredonia not connecting to the septic system.  In the sales contract between the customer and Owl Homes they were being charged a total of $3,500 to hookup to existing utilities to include the septic, well and electric.  The original septic system to their existing house failed the Chautauqua County's test and therefore had to be reworked where the customer hired a separate contractor to perform the work.  In addition Owl Homes was to hook up to the original electric to their existing house which would not pass inspection.  Owl Homes installed a new electric system which far exceeded the price charged to the customer in their sales contract.  Owl Homes lost money on the utility portion of the contract.

Owl Homes policy is that Owl Homes remains in possession of the home until paid in full.  In order to obtain a building permit to allow the customer to place a new manufactured house on their property The town of Hanover required Owl Homes to obtain a bond (see attached letters) to assure that the existing house was removed from the property once the new house was in place.  At this point in time Owl Homes is seeking reimbursement of the cost of the bond which it obtained.  The amount owed by the customer is $1,000 which was invoiced to the customer on invoice # 2047 dated 12/9/2014.  Per a conversation between the customer and the president of Owl Homes, Owl Homes would agree to release the MSO which would allow the customer to apply for a title for $500.00.

Consumer Response: Better Business Bureau:
I have reviewed the response made by the business in reference to complaint ID ********, and have determined that this does not resolve my complaint.  For your reference, details of the offer I reviewed appear below.
BBB spoke to ******* ********* today. He stated the bond is not mentioned in the contract and he does not owe any money. The company should have incorporated the bond into the contracted price. He is requesting the title as the house is paid in full. He put a $500 deposit down and is requesting proof of the bond being purchased.
