Complaint: We signed into what we thought was a month to month lease with the option to buy the credit card payment processing equipment. We were misled to believe we could cancell at anytime with no penalty or long term commitment. The salesman we talked to understood we were a seasonal business as well as a start up business and we were not sure if our card sales would even be worth maintaining the service. He assured us they were the perfect fit for us and even discuraged us from signing a lease with another company. Upon our season ending we reviewed our credit card sales and came to the conclusion the service was not a good fit for us. We then attempted to put the account into seasonal status for further review only to find out the paperwork we signed was a non-cancelable lease that was implemented for 48 months and was not eligable for cancelation. We then attempted to contact the salesman and we were met with a less than helpful individual claiming he explained everything to us. There were three business owners present at the time of the signing and not one can recall a word about a non-cancelable lease. All the paperwork looks the same(color, size and layout) and in his presentation was crossing out items on these sheets and talking as though it was a simple process that he took care of all the long term commitments. In our opinion the non-cancellable lease was covered at the time of presentation and we were led to believe this paper was part of the processing agreement that looks identical the this lease agreement. Sections were crossed out and initialed by him as well. We were confident he was doing what was in our best interest at the time. We were wrong.

Desired Settlement: We would like his company to stand by his presentation and remove the obligation of this long term contract with the leasing company . We are willing to pay any and all fees owed to this date and will seek no further action if they are willing to do so.

Payment Processing Consultants, Inc. has reviewed BBB Complaint (ID *******) submitted on January 16, 2013 and strongly disagrees with the Complaint and all of the Claims.

Attached is a signed copy of the Lease Agreement which clearly identifies that it is Non-Cancellable. Further, after the agreement is signed by all parties, a copy is left with the Merchant for their records and review. This clearly negates the claim by the Merchant that "the non-cancellable lease was covered at the time of presentation". The Lease Agreement is also very clear that it is not "a month to month lease" and does not say that it "could be cancelled at anytime with no penalty or long term commitment".

The second page of the attached is a signed statement from the Salesperson in question, *********** *****. As you can see, he also strongly disagrees with any and all claims against Payment Processing Consultants, Inc..

In summary, I strongly deny any and all claims of deceit and feel that this is not a valid complaint against Payment Processing Consultants, Inc.. Therefore, I feel that it should be removed from our BBB file.

Here is the info you requested. As you can see the consulting firms contract has all the termination fee's crossed out with ************* initials next to them. there are so many things crossed off you can see how this can be mis-leading. Not to mention all the sheets are the same color and even the page numbers imply the non-cancellable lease is the fourth page of the consulting contract. Thanks again for your help.

 I've read Mr. ********* response to the evidence I've shown of the agreement he entered into with us, and his new accusations in regards to my company's business practices and his second personal attack on my Vice President of Sales, ***** *****.  Again, I agree to cancel Mr. ********* processing account with our company with no penalty to him, as is clearly stated on the third page of the agreement he signed with us.  I am also attaching the actual Page 4 of the agreement that Mr. ******* signed but neglected to include in his email to you.  He instead inserted the first page of his lease agreement in it's place.

I would point out that not only does the Non-Cancellable Lease agreement that Mr. ******* signed separately from the processing application follow a different format, but it utilizes a different size and style of font than our processing agreement, and has a header and footer that includes the term 'NON-CANCELLABLE LEASE' in bold, capital letters.  You will note that we also waived his first and last months' payments.

As a solution, I am offering to honor our agreement with Mr. ******* and cancel his account with no early termination fee.  In addition, Mr. ******* is free to resell his equipment to another business and contact the leasing company to inquire about a buyout amount.

Payment Processing Consultants Inc. has concluded through **** *******, who is a third party to a sales presentation he was not present at or a party to, that his Vice President of sales has impecable integrety that no one should question because he has 15 yrs in the business. Well as anyone who watches the news can tell you even the companies that claim to be above scrutiny have proven otherwise. Although I can appreciate his willingness to stand behind his trusted employee, everyone makes mistakes. Starting with the response he gave to my last complaint. He keeps using the words "OUR" contract and "US" and "WE". These words should be used carefully because of the services his company sells. That gives you an Idea of how the sale was presented to us. We believed the processing and equipment was to be handled by "HIS" company and could be cancelled and the equipment returned if we found it was not a good fit for us. *********** ***** "KNEW" we were looking for a non-binding short term trial credit card service that we could use as a test run for future credit card sales. Why in the world would we intentionally sign a contract that bound us to there service for four years. It absolutly makes no sense. The bottom line is his company wants to make money, I understand that. At the same time it should not be at the expense of *********** ******* customers that trusted in him to make the right decision for "OUR" business. The only resolution to this matter at this point is a full buyout of our lease agreement and cancellation of any and all ties to this processing company.
