Complaint: I have a policy with lifetime engine warranty #XXXXXXX with a claim phone number of XXXX XXX XXXX and a po box ***** woodland hills, ca XXXXX. i believe now they are part of protective insurance company.A claim was made in late September regarding my 2004 Mazda Rx8 on the failure of its piston rings which is a part clearly covered by the lifetime engine warranty, however the motor on the 2004 mazda Rx8 is a rotatory engine unlike conventional v-6 engine, on which the piston ring of the engine is referred as to the apex seal, both serving the same function and both made from the same material.i have called 3 times ever since to the point where the repair shop asked to pick up the car to free space due to the denied claim and their unwillingness to reason with the owner and head master mechanic of the shop on how its the same part on different engines, serving the same purpose on both engines despite their difference. Desired Settlement: repair of the engine. or a settlement of the amount of 5,500 dls which is the cost of a new engine from Mazda dealership

Business Response: Initial Business Response /* (1000, 5, 2015/03/05) */ On behalf of Protective Administrative Services, Inc. (PASI), the Administrator for Mr. ******' Limited Engine Warranty, we are responding to your February 19, 2015 e-mail. Under the terms of this warranty, the customer must provide proof of maintenance. When Mr. ******' claim was called in, PASI requested copies of his maintenance receipts, which to date, have not been received. Additionally, while PASI agrees that the apex seal on a rotary engine performs the same function as a piston ring, the failure is due to low compression, which type of failure is specifically excluded from coverage. Based upon the terms of the warranty coverage, we believe this claim has been properly denied. If Mr. ****** has additional information he would like to consider, please send it to my attention. The matters stated in this letter do not waive, but rather reserve any and all rights and defenses PASI may have under the warranty. Sincerely, ***** ******* Compliance/Legal Support
