  • Government Actions

    On Wednesday, April 22, 2009, the Missouri Department of Insurance sued owners Darain and Cory Atkinson, and their company, demanding they comply with a subpoena.

    On June 15, 2011, Missouri Attorney General Chris Koster filed indictments in St. Charles County court against Darain Atkinson, President, and Cory Atkinson, Vice President of US Fidelis. Both were indicted on charges of consumer fraud, stealing and illegally selling insurance. If convicted, Darain Atkinson could face a life sentence, while Cory Atkinson faces up to 15 years in prison. The case is pending.

    In October, 2010, Cory Atkinson, former Vice-President and 50% shareholder of US Fidelis, entered into a Consent Judgment and Permanent Injunction with the Attorneys General of the States and Commonwealths of Arkansas, Idaho, Iowa, Kansas, North Carolina, Ohio, Oregon, Pennsylvania, Texas, Washington and Wisconsin. The States allege that Atkinson sold and marketed motor vehicle service contracts in a false, deceptive, and misleading manner. The Judgment cites that Atkinson shall not engage in any telemarketing sales, marketing or administration of motor vehicle service contracts and shall not make any false or misleading representations of fact of any good or service offered for sale.
    Cory Atkinson was ordered to pay a civil fine in the amount of $1.8 million dollars, plus $325,000 in attorney fees, court costs and investigative fees.

    The Better Business Bureau has questioned some advertised claims contained in mail solicitations sent to consumers. The BBB brought to the firm's attention that an advertisement as a whole may be misleading although every sentence separately considered is literally true, and that misrepresentation may result not only from direct statements but by omitting or obscuring a material fact. The BBB continues to receive a pattern of complaints and reports from consumers alleging that the firm's solicitations are misleading. The company agreed to discontinue its advertisement.
