Refusal to refund a un-used down payment
February 18th I had a front tooth root canal performed at Ozarks Dental Studio. When I had pain and went back for a check-up a week later, the dentist told me the root canal was not effective and I would need the tooth extracted and replaced with an implant. I explained I have a metal allergy and was worried about the metal implant. He assured me it would be fine.
Trusting his knowledge, I gave him an $816 down payment and scheduled an appointment for the implant. Upon leaving the office and doing my own research, I found evidence that many implants fail due to metal allergy. I called and canceled the implant within an hour of leaving the office.
The next day, I went to a different office for a second opinion. It was here I learned not only had the root canal not been completed correctly, the reason I was having pain was due to an infection. I was started on antibiotics immediately and had to have the root canal re-done a couple weeks later at the new office.
I have called Ozarks Dental 4 times to request my refund. Each time I get the "check's in the mail" response. Four months later, I have yet to receive it.

Desired Settlement
I am seeking a full refund of the $816.00.

Final Consumer Response
On June 21, 2016, I received a check for $408.00, half of my down payment.

Dental office performed services that I did not authorize and I was not advised that I would have to pay our of pocket cost until after.
I went into ozark dental studio for my routine free cleaning that my insurance pays for. After the cleaning was started I was advised I would need further care. I asked how much that would cost after insurance and I was told "I don't know they will tell when you make your appointment. " After that the dr came in and did his normal exam and I was told I could go. I went to the desk to make my appointment and was told there were no appoints available until next year. So I said I would call later. Was never advised I owed anything. Again this was an appointment for my free cleaning. That afternoon I called to ask about my X rays and was then told i would have an out of pocket cost. I told them I had no our of pocket that my appointment was for a cleaning and I should have been advised of such cost BEFORE the service took place. I would not have stayed if I would have had an our of pocket cost. I am now receiving bills saying I owe ***** dollars for services that I never authorized or was even told were being done. I was never told that I would owe anything before the service. My insurance pays for 2 free cleanings a year and that is all this was suppose to be. The performed a service that I never authorized them to do and was never told my insurance would not cover it.

Desired Settlement
I do not believe I should have to pay the bill they say I owe. I was never told before hand I would have an out of pocket cost. My visit should have been free due to my insurance paying for 2 free cleanings a year. If I had been aware of the our of pocket cost I would not have allowed the services. I went in for my free cleaning and nothing more.

I apologize for the misunderstanding but our office policy is to let someone know if certain procedures becomes out of pocket. Apparently we had a mis-communication between patient and staff. We have corrected the situation.
