Complaint: My husband and I recently contacted Boren Construction about 60/40 dirt to build the foundation for our new home. When we spoke to him he relayed to us that his rate was $90 per load. Since that is much cheaper than the going rate we were thrilled and asked when the company could begin delivery.. we were told the next day. At the time of said conversation we only requested 50 loads,however; due to unforseen complications we ended up needing a TOTAL of 78 loads. At which point we relayed this info to Borens delivery subcontractor, *****'s Truck. The subcontractor continued to delivery until he said we had reached our desired load request. Keep in mind that we were never asked to sign anything with either Boren or his associate (not even delivery slips). When we went to the office to make our payment we were told our total was $9090.00. (For 101 loads) but we only requested 78 and the subcontractor turned in to Borens that he delivered 101 loads. So when we questioned the bill, the company said that they were going to watch a video of their site and see how many loads ***** ******** left his site with. After it was all said and done the owner called us back in and sat us down and informed us that after watching the video the amount of our bill had actually gone up even more... since ***** ******** used 16 yard trucks instead of 12 yard truck the price was now at $120 a load and that the video clearly showed him leaving the site with 101 loads that he "said" were delivered to our property for a grand total of $12240.00. We were never informed of a price increase due to truck size and our contractor only counted 78 loads delivered to our site.. however was not asked to sign any delivery slips until all was said and done and we were disputing the load count. The subcontractor from Boren called our contractor after hours pleading with him to meet him anywhere to have the slips signed.. our contractor denied his request since he did not know if in fact the slips that were needing to be signed were the ones for the actual loads that were delivered to our property. So in the end to avoid any type of lien being put against our land or home we decided to just pay the bill. We had only budgeted for 78 loads at $90 per load... yet instead had to pay for 101 loads at $120 per load.. and again I stress we were NEVER informed of a price increase.
Desired Settlement: We would like justification in the above matter. What this company did to us was fraud.. I can not say whether or not 101 loads were in fact delivered to our property or not, but in the same breathe neither can Boren Construction.. he has no signed delivery tickets from us or our Contractor. And furthermore, we should have been notified that we were receiving 16 yr. Trucks and that the price that was quoted to us would no longer be $90 per load but in fact $120 per load. There is no telling how many countless other individuals they have committed fraud against.
