** ***** of Waterfall Pools strung out my pool project for months trying to bait and switch me for more money. He is rude, unprofessional and a crook.
I have had nothing but terrible experiences with pool contractors and subcontractors. All of them ask for payment in advance then once they have you hooked they bait and switch you into higher costs and threaten to abandon the project knowing it will cost you more to go to anybody else half way. I contracted with Waterfall Pools after having been robbed of a lot of money by another crook company Nationwide Pools run by Keith Stuart. I should have suspected foul play when the owner ** ***** only provided a handwritten contact that was specifically vague on the scope of work. I had to sit and discuss the contract with him for over 4 hours as I saw multiple opportunities where he left the contract open ended to try an upcharge later on. This left him little scope to upcharge me as he had originally planned but he still squeezed extra money out of me on various stages as described below.
First ** had his subcontractor ******* ******** over dig around my pool to a depth of 4 feet which was totally unnecessary. He did this to avoid trenching for the pipes as is customary and this over-dig and subsequent backfilling work cost me $10,000+ extra. **'s subcontracted plumber did not finish the plumbing according to plan. ** tried to ask me to hurry up and cover the flawed plumbing (with multiple uncapped pipes too) in hopes I would not notice. When I brought in an independent pool plumber to inspect the work and discovered the flaws, ** refused to fix it and abandoned my project for over 2 months. Finally when I threatened informing the authorities he finished the plumbing job but now wanted an extra $1100 for the extra work for a mistake his subcontractor made!
During the build of the waterfall he tried similar upcharges at every stage and threatened to delay work and walk away from the project whenever I disagreed. He agreed to build a bridge and table later decided he did not want to build it as per his words he had just mentioned a price in the moment to do these items but is not interested in making them as he will make no money on it! Again this is his ploy to keep a very vague contract upfront so he can upcharge as the job gets along thereby showing a lesser cost in the beginning but ending up to be more expensive later on.
He up-charged me $2500 for electrical piping after having agreed to do it for $1000. He later up-charged me $3500 for closing up a hole in the slide structure that he initially agreed he would do. Apparently the charge was for removing the concrete papering since the slide structure would now be exposed.
** and his one worker popped in an out whenever they wanted with no focus on my project. They did not clear construction debris and left a messy job site for days. They stored material such as concrete and blocks for other jobs on my site and used my  backyard as a storage area without my consent. I had to call repeatedly and he was routinely rude and disrespectful to me and my family members raising his voice and losing his temper.
Overall ** is a dishonest businessperson, he has no sense of customer service, overcharges for work and holds customers hostage. Avoid ** ***** and Waterfall Pools at all costs and please report similar instances where he has messed with customers so this person can be stopped from doing pool business in South Florida especially Broward County. I have complained to the City of Davie and Sunrise on ** and his nefarious acts.

Desired Settlement
I am reporting them as an unscrupulous business under-quoting to get a job then stringing out customers with an unfinished job to extract more money out of them. The quality of work was also shoddy and I had to hire other contractors to finish the job. Ed's subcontractor made a mistake in the plumbing and he wanted to charge me more to fix their mistake. He charged extra money for electrical piping saying he was sorry he underquoted me.

He frequently screamed and shouted cutting us off when we said he was doing something wrong. Check his reviews on other review sites on how he is treating his other customers so you know this is a pattern. I am also making a complaint against his pool license to make sure other customers are not harmed in the way i have.

In re: ******, Souran Waterfall Pools, Inc.
2950 Steeplechase Rd. Coral Springs, Fl., XXXXX
Fort Lauderdale, fl. XXXXX Case #XXXXXXXX
Waterfall Pools is a builder of custom pools which are usually of a jungle or Polynesian motif. It is widely recognized for the craftsmanship and quality of its work as well as the professionalism of its president and CEO, Ed *****. Waterfall Pools was initially contacted by ****** Souran on or about January of 2013. Mr. Sourran met with Ed ***** of Waterfall pools on at least three (3) occasions over a period of several weeks. Mr ***** prepared two (2) extensive drawings along with cost proposals for the proposed custom pools at the direction of, and in accordance with the descriptions imagined by Mr. Souran. Mr. ***** then provided the drawings an cost estimates to Mr. Souran on a good faith belief that Waterfall Pools services would be retained to perform the job. Mr. Souran kept the plans and estimates . Shortly thereafter Mr. Souran advised Mr. ***** that he would not agree to Waterfall Pools' price and that he was going to retain another pool contractor. Waterfall Pools had not performed any improvements to the property and had no further communications with Mr. Souran for a period of approximately eight (8) months.
In August of 2013, Mr. ***** was again contacted by Mr. Souran who asked that Mr. ***** come out to the Souran residence to discuss the possibility of

Page 2
Sauran v. Waterfall Pools December 5,2014
performing work, When Mr. ***** arrived; he learned that Mr. Souran had retained the services of Nationwide Pools which had dug the hole for the pool, performed the steel work and dug a trench around the steel work which was approximately four (4) feet in depth. Mr. ***** is in possession of photographs which determine that Mr. Souran is mistaken as to his allegations of "over-dig" which are completely unfounded.. The outline of the steel work was strikingly similar to the drawings which Mr. ***** had given to Mr. Souran for free. Mr. Souran then advised Mr. ***** that he wished Waterfall Pools to create a
waterslide, a bridge and to pull the necessary permits for same and that Mr. Souran would be retaining yet another contractor to shoot the gunite portion of the pool . A contract was negotiated and signed by both parties. The contract with Waterfall Pools states that Waterfall Pools would not warranty the existing pool/spa plumbing which had already been installed and would not be responsible to backfill the excavated area around the pool.
Mr. ***** did not demand upcharges for any work which was not agreed to by both parties. Mr. Souran insisted that the waterslide be larger than originally planned and Mr. ***** advised that it would require steel reinforcing as opposed to a fiberglass waterslide to be code compliant. Mr. Souran agreed to pay the additional monies for his grand waterslide. Waterfall Pools then fabricated and placed the steel work for the bridge. Mr. Souran instructed Mr. ***** to construct a wall and relocate a central waterfall against the advice of Mr. *****. Mr. Souran stated that he was in charge as the homeowner/ builder and that Mr. ***** would do as instructed. Mr. Souran then began to ask for more work and expensive amendments to the original plans which Mr. ***** originally provided at "discount pricing." With discount pricing not being sufficient, Mr. Souran then began to ask for free services including but not

Sauran v. Waterfall Pools December 5,2014
limited to the construction of a walk in cave/ grotto. When Mr. ***** advised it would cost additional monies for additional work, Mr. Souran became very irate and would argue with Mr. ***** about. He subsequently advised Mr. ***** that
he would obtain another contractor to complete the work on the bridge.. Mr. Souran has still not paid Four-Hundred and Seventy-five ($475.00) Dollars.
It is regrettable that Mr. Souran could not abide by the terms of the contract with Waterfall Pools and was persistently attempting to obtain a "better deal'. Mr. ***** strongly denies any allegation that he ever threatened to delay work or walk off the job at the Souran residence. Mr.***** denies that Mr.
Souran ever threatened to "inform the authorities" unless Waterfall Pools performed any work and that it was never necessary to inform the authorities. The original plans called for an enclosed slide and Mr. ****** advised that he changed his mind after a large portion of the slide was completed and that he desired a "see through "slide. Waterfall Pools then reworked and cut steel to create an open water slide at which point it was advised by Mr. Sauran that he changed his mind again and wanted an enclosed slide. Mr. Souran agreed to pay the additional $3,500.00 for approximately five (5) days of work by Waterfall Pools in building, partially demolishing and rebuilding the waterslide.
Mr. ***** states that he and his employee(s) worked in a timely fashion but the completion of the pool was delayed by Mr. Sauran's delayed payments, and interference caused by delays with other subcontractors hired by Mr. Sauran. No material for other jobs was ever stored on Mr. ********* property. Mr. Sauran instructed Mr. ***** to epoxy and finish the waterslide but Mr. ***** advised Mr. Sauran that it would be unsafe to put the final slick finish on the waterslide with an unfinished pool and other subcontractors still working. Not only would it

Page 4
****** v. Waterfall Pools December 5,2014
have presented a safety hazard with an empty pool but the epoxy glaze would have been ruined by the dirt, dust and other debris which would stick to same. Mr. ***** advised Mr. ****** to call him to complete the epoxy finish when all the other workers had left but never heard back from Mr. Sauran. The only debris left on his property were two (2) black plastic garbage bags filled with empty cement bags which Mr. ***** would have gladly removed if he had received the last call from Mr. ******
It is unfortunate that Mr. ****** has asserted to making the false allegations as he has done. Contract documents and photographs are in the possession of Mr. ***** which disprove Mr. ********* claims. In the end, Mr. Sauran was a customer who simply could not be satisfied by any means. Waterfall Pools and Mr. ***** deny any and all allegations made in the Complaint Activity Report.
If this Complaint is not withdrawn forthwith, Waterfall Pools stands ready to file suit for the libelous statements made therein.
