Our file contains a pattern of complaints from consumers alleging difficulties canceling vacation packages booked through Bluegreen Corporation. Consumers claim, although Bluegreen Corporation has a cancel within 30 days policy, their requests for refunds for canceled trips are denied. Other consumers feel they are victims of deceptive sales practices. Consumers claim resorts are never available when they contact Bluegreen Corporation. While yet other consumers claim the "free" vacation Bluegreen Corporation offers is not free and involve fees they were not made aware of.
Bluegreen Corporation has responded to these complaints with an explanation of their services.
On March 13, 2013, BBB sent certified correspondence to Bluegreen Corporation requesting their voluntary cooperation in resolving complaints on file with BBB and providing steps it will implement to eliminate the pattern of customer complaints.
On April 5, 2013, Bluegreen Corporation responded to BBB's concerns. Bluegreen Corporation does not believe they fail to grant cancellations and refunds where they are factually and legally appropriate. Bluegreen states their company does provide timely cancellations and refunds to those consumers who properly rescind their timeshare purchases within the rescission period. Occasionally, a consumer does not follow the properly prescribed cancellation method contained in the timeshare sales documents. Nevertheless, once the appropriate business area within Bluegreen becomes aware of the request, even when not properly given by the consumer, diligent efforts are made to process the cancellation and refund as promptly as possible. With respect to the purchase of a vacation package, such purchases are accompanied by details of participation which advise a purchaser how to cancel their vacation package and the amount of time they have to do so. Also, in some instances, the consumer may have purchased the vacation package from a third party provider or vendor, and not directly from Bluegreen Corporation.
While Bluegreen does not believe a problem with granting and providing cancellations and refunds exists, the company has provided some steps they will take.
1. Bluegreen will remind its third party providers who sell vacation packages about the importance of providing cancellations and refunds in timely fashion and urge such providers to take whatever steps are necessary to improve the efficiency and timeliness of cancellations and refunds where appropriate.
2. Bluegreen will review its internal policies and procedures governing cancellation and refunding of both timeshare interest and vacation package purchases to determine ways to improve efficiency in processing cancellation requests and providing refunds. One specific area of internal process that will be explored is improving centralization and synchronization of computer programs so that consumer accounts are more quickly and more efficiently located and processed.
Turning to the issue regarding sales practices, Bluegreen Corporation disagrees that there is a pattern of behavior. Bluegreen believes the number of complaints received versus the total number of sales transactions and interactions with customers is minimal. Bluegreen believes that a large number of consumer complaints which the BBB receives from consumers are "coached" letters which recount a repeated litany of alleged wrongdoings during the sales process, designed to bolster demands for relief from previous financial commitments. Bluegreen will now consider a variety of factors when considering a request to grant financial relief to a consumer.
BBB reviewed this company's complaints again on July 12, 2013 and found that the pattern has not been eliminated.
BBB will continue to monitor the complaint activity of the company and update the Business Review as needed.
