Complaint: My friend and I ate at Lardo's and had the bill split between the two of us. A couple days later my friend found his account was overdrawn and he had $20 in overdraft fees. After digging into his debit card statement he found that ***** (our waitress) at Lardo's had put both mine and his meal on his card. My friend called Lardo's and told them what had happened, they agreed to credit his card for my meal but refused to do anything about the overdraft fee.***** then called me, let me know what had happened and said that she would like my card number to charge my meal to, my meal plus tip was around 45 dollars. I told ***** that I'd give her my card number but that she was only to charge $25 to my card, the other $20 I had given to my friend for his overdraft fee. ***** agreed that was fair and I gave her my card number, this was October 16th, 2013. On October 18th, 2013 ***** from Lardo's called and informed me that ***** had told her about the $25 dollar deal, but that she was charging the full amount minus the tip to my card. I told her that I'd only authorized $25 be charged to that card and that I'd call the credit card company and report anything other than that. She told me she was going to charge the full amount whether I like it or not. We got off the phone and I immediately called the credit card company and then filed this complaint. This matter was handled very unprofessionally by Lardo's.
Desired Settlement: I would like Lardo's to make right their wrong. It was not my friend's nor my error that the wrong card was charged, we should not have to pay for their mistakes. Lardo's needs to respect people's credit cards, when they are given to them over the phone with an agreed on amount they need to understand they can't just then charge whatever they'd like to it.
On September 28th at 7:00 p.m. ***** and ***** came in for dinner. ***** had a prime rib dinner and ***** had a sautéed mushroom burger. *****’s total was $38.68 plus a $7.00 tip, totaling $45.68. We have *****’s signature on a credit card slip proving he acknowledged he owed this amount for his dinner. *****’s ticket was $14.35 with a $2.00 tip, totaling $16.35. On October 5th Lardo’s received a phone call from ***** stating his credit card was run twice, one totaling $16.35 and the other totaling $45.68. Another server took the message and ******** called him back after researching the charges and finding the server ****** had run both charges on *****’s card. ******** called ***** back and he told her his bank account was overdrawn because of the two charges but did not ask for repayment for an overdraft fee. ******** said she would credit his card back for the $45.68 but that Lardo’s still needed payment for the product. ***** gave ******** *****’s phone number to try to receive payment and ******** credited back *****’s card $45.68. She left a message on Saturday the 5th for *****. ****** called ***** and left several messages in attempt to get payment between the 5th and the 16th. ***** answered his phone on October 16th and ****** asked him to pay for his meal. ***** said he had to pay ***** back $20 for the overdraft fee so she should only run his card for $25 and gave her his credit card number. ****** took the information to ********, the manager, and she said he still owes the total for his meal. *****, the bookkeeper, ran his credit card for the total owed, minus the tip, which was $38.68. She called ***** and left a message to let him know the total his card was run for acknowledging he only wanted to pay $25 but that the amount owed to Lardo’s was $38.68 and Lardo’s would not charge him for the tip. ***** called back and spoke with ******** saying he was going to dispute the charge because he only authorized $25. ******** said he owes Lardo’s $38.68 since that was the amount of the bill. He said it was Lardo’s fault the server ran the card twice, over drafting *****’s bank account. ******** said she understands it was the server’s mistake but that the amount owed to Lardo’s for the food and drinks consumed is $38.68, which is what was charged to *****’s credit card.
Lardo’s position is that ***** received what he asked for, which was a credit to his card for $45.68. ***** owed Lardo’s for his meal on September 28th but would accept payment for the food and drinks only, totaling $38.68 and not expect him to pay the tip since it was a server error. Unfortunately the agreement made between ***** and ***** for the overdraft fee is not Lardo’s issue. Our opinion is that ***** should be able to get the fee waived by his bank since he did not sign for the transaction.
Better Business Bureau:
I have reviewed the response made by the business in reference to complaint ID *******, and have determined that this does not resolve my complaint. For your reference, details of the offer I reviewed appear below.
The only reason I gave Lardo's my credit card over the phone was because ***** had agreed that $25 was fair. I never authorized more than $25 be charged to that card, the fact that ***** agreed that $25 was fair makes my agreement between ***** and I Lardo's issue. The card I gave Lardo's over the phone was a completely different card than I gave them in the restaurant, by signing for my meal in the restaurant that is in no way authorizing them to charge another card the same amount. After speaking with ***** ***** they agreed that given the circumstances Lardo's was not authorized to use my card. Lardo's didn't know or care how much money I had on that card and they charged it without my permission, which is illegal, just because you feel someone owes you money doesn't give you the right to charge their credit card without permission. ***** clearly stated in her voice mail that has been sent to ***** *****, that she received the note from ***** stating that I'd only authorized $25 be charged to the card and that she was going to charge the full amount anway. Lardo's could have very easily over drafted my card too, had I not had the funds in that account. Lardo's clearly admitted in their reponse that the mistake was theirs and the overdraft was *****'s fault. Lardo's or ***** should pay for the mistake not us.
