Complaint: My wife had breast augmentation Nov 22, 2013; on Nov 25, 2013 she found out the doctor put the wrong size implant inside her. She and the doctor agree on a specific size and width. When they discuss everything he told her its her choice and he can do any size. When she confronted the doctor he became upset and told her that was a good size for her. He then tried to lied and say they agree on that size. When she asked to see his note he refused. She asked him to admit the mistake he refused. The only reason we found out is because she of the insurance she has on her implant. If she hadn't check the insurance the doctor would have never told her.
Desired Settlement: We payed for a specific operation that was not completed to size determine before the survey. Since the implant was not correct size we desire a refund.
Business Response: Patient needs to follow up in the office to present these complaints and verify result of procedure. Patient's medical records are her property, and she is entitled to copy upon written request.

The young woman and her husband submitting this request are among our most favorite patients, and are wonderful people. They are requesting full refund after she had a breast augmentation procedure, with an outstanding, beautiful result.
The patient was evaluated at least twice in our plastic surgery office prior to her procedure. The breast augmentation procedure was explained in detail during these visits. Alternatives and risks were reviewed, and her questions were answered. She paid for the procedure in advance, including costs of the JCAHO accredited surgery center, the board certified anesthesiologist, the FDA approved implants, post surgical bra, and for the entire evaluation, planning, procedure performance, and post-surgical care by me, a board certified plastic surgeon with over two decades of experience.
Her procedure went well, and she experienced no post-surgical problems or complications. Her figure is dramatically improved, and she has the exact size of breast implants requested. Breast shape is natural, and the right and left breasts are symmetric. Texture of the breasts is soft, and there is no visible breast abnormality. In short, the patient has a superior result in every respect, a result which should last for many years. See attached photos.
The patient presented for a complex service provided by multiple highly trained and certified individuals, and by entities accredited and approved by private agencies and by Local, State, and Federal Government. Although the service is provided without any guarantee or warranty of any particular result in advance, the service was performed flawlessly in full, and the consumer in this case has a spectacular outcome that is expected to return dividends to her for a long time into the future. In short, the patient and her husband received and will continue to receive the value they were hoping for from their investment . Risks and adverse possibilities that accompany every surgical operation never materialized.
Better Business Bureau:
The reason for the lawsuit is not because of the surgery went wrong but because Dr. ******** used 550cc high projection implants instead of 550cc moderate projection implants. If he had used the correct implants her breast would have had a more natural look. If you read his comments he never refer to the different projection at all, he only comments on the successful surgery.
