Additional Complaint Information

On January 30, 2013 a dispute between RG Custom Constructions Inc. and a consumer was arbitrated. On February 12, 2013 the arbitration ruling was issued in favor of the consumer. On February 21, 2013 the business advised it would not be complying with the arbitration ruling, and was seeking to have the ruling overturned in the courts. Accordingly the complaint was closed as unresolved and revocation proceeding initiated.

Subsequent to closing the complaint the BBB was advised that the dispute was resolved through other legal means.

Complaint
RG Cobstruction did my roof. Roof not done well problems with leaking and sinking roof. Contacted the owner he left reply will not cover labour.

I hired *** the owner of RG to replace my roof. Not long after it was leaking around chimney. He came back to try to fix it. Now under 5 years later roof is sinking and I need a new repair. **************************************************************. I contacted the owner asked him to come by look at the roof and then contact me . He came by I was not home he did not want to go on the roof without my presence but said he would not take responsibility for the problem with the roof (in a text). *******************************************************************************************

return the money so I can hire someone who knows how to fix the roof properly

Business Response
AS the customer indicated the roofing Job was done 5 years ago.
The customer did fail to indicate that the warranty on labour was 3 years from the date of the install.
Also as the customer indicated in the complaint that when she did have an issue with the roof within the warranty period, the repair was done for free without any delay.
Considering the warranty period has been expired, the company can not provide a free repair.
In addition I would like to mention that when the customer called to set up an appointment, it was clearly explained to customer that she needs to be home for the inspection.
Regardless to that the customer was not home for the appointment and did not answer her phone. Customer only contacted the company a week later to ask why the installer did not go up on the roof without the customer being home.
It is our policy not to trasspass the customer property considering that customer is not home.

I believe if he won't guarantee his workmanship I should still have warranty on the shingles themselves
I would pay for his labour because I need the warranty on the shingles unless I can get the materials replaced
**************************** when he was hired to replace the initial roof it leaked almost immediately with the first rain
Yes he came back to fix it but a roof installed properly the first time does not leak but clearly it wasn't actually resolved because there are still major issues with the roof it is sinking.

Final Business Response
The customer had 3 years to complain about any problems with the roofing job, which she did not after the first repair. All she had to do is pick up a phone and call the company.

The warranty on the labour has expired over a year ago.
So what is not clear that, why is she still trying to get work done under warranty.
As I mentioned already that she failed to report any problems with the roofing job within the warranty period. If she would, like she already knows from previous experience, the repair would have been done ASAP.

The customer is welcome to hire whom ever she thinks is trustworthy on her own expense.

Also the customer mentioned that "clearly it wasn't actually resolved" but there is no any evidence that she had a leak.
She thinks that is why her roof is sinking. But even to this date there is no leak to my understanding.
