Complaint
***** ****** Realty unfairly withheld my security deposit at a duplex I rented, *** ****** Street, *** ******** CA XXXXX.
This complaint is primarily in response to a deposit refund, in which ***** ******, on behalf of owner ***** (******) **** deducted an unfair and possibly illegal amount from my deposit. The deductions were withheld even after several months of a very unpleasant tenancy at *** ****** Street, Los Angeles, CA XXXXX. I have emails confirming all the items noted in my complaint.

The deductions are as follows:
Original Deposit: $1,295
Paint/ Patch: -$200
Cleaning: -$80
Rents (electricity): -$398.66
Remaining Deposit: $616.34
Total Deducted: $678.66

Paint & Patch: For several days electrical repairs were performed on my unit which was left repeatedly in unclean conditions. The repairs had to be performed because the owner did not ensure the electricity met city code before rented the unit. I repeatedly complained to ***** ****** Realty that my unit was dirty, but they never cleaned it. Shortly before moving out ***** ****** sent their employee, Ralph, for a pre-inspection walkthrough. During the walkthrough I advised that not all the holes were patched. Additionally, not all the paint matched when I moved into the unit. I have email confirmation of this correspondence, along with reports/ violations from the Los Angeles Housing Department.

Cleaning: I advised the owner (******) shortly after I moved in that the unit was left very dirty. If he didn't give me the respect of leaving a cleaning home, I should not be responsible for cleaning when I moved out. I have email confirmation of this correspondence.

Rents (Electricity): In May 2014, while the electrical repairs were underway, I learned that I was subsidizing my neighbors rent for the entire length of my tenancy. Therefore, I deducted $338.66 from my rent. Additionally, the owner built an illegal unit underneath mine, and was using my electricity. The owner agreed to allow me to deduct $20 per month from my rent because he admitted illegal use of my electricity for 3 months. $338.66 + ($20 x 3) = $398.66. Again, I have email confirmation of this correspondence, along with reports/ violations from the Los Angeles Housing Department.

The following employees of ***** ****** are aware of these issues: ******* ********* ****** ******* and ******* ******* Additionally, the Owner, ***** (******) *** and his partner, *** ****** are also aware of these issues. I have email confirmation of everything listed above.

Desired Settlement
I am seeking the remaining amount of my entire deposit, which was promised to me by the owner. That amount is $678.66.

Business Response
Dear Ms. ******,
I will respond to this complaint point by point.

1)Patch and Paint: The total charge for the patch and paint of the unit was $800. $200 was deducted from your deposit for the holes you made in the wall to hang pictures and the portion of the walls you painted yourself which you mentioned in your conversation with our maintenance supervisor. These holes in the wall and portions of painted wall are your responsibility per your lease agreement. The total bill is attached bellow

2)Cleaning: Again, the total cleaning bill was $150. We listened to your complaints about the state of the apartment upon your move in and only charged $80. We had no other choice given the amount of detritus left in the apartment as well as the general level of grime.

3)Your reference to subsidizing your neighbors rent in the amount of $338.66 is a mystery to us. It is entirely spurious.

As to the $20 dollars a month you decided to detract from your rent, the "illegal" unit you reference is an unused storage closet one floor below you with a single light-bulb. It is unreasonable to deduct $20 dollars a month for the electricity of a storage unit that does not get used on a regular basis.
Electrical Repairs: Our maintenance staff handled the repairs in your apartment with the utmost professionalism and with an eye to minimizing the mess attendant on such repairs. Our attempts to foster a good relationship with you were rebuked throughout this process.

We are sorry you feel upset at the amount you were refunded. But, we always acted in accordance with the spirit of fairness and well within the limits California state law.

I would like the opportunity to provide email correspondent confirming that the landlord agreed to a $20 eletricity credit, that the ***** ****** did not clean my unit despite me continually asking after the electrical repairs, and that the unit was filthy or "grimy" when I moved in.

Neither ***** ****** nor ***** ****** *** (the owner) has not acted ethically and does not deserve a clean record with the Better Business Bureau. People need to know what a poorly run company ***** ****** is.

Final Business Response
In regards to the cleaning bill, as has previously been pointed out, we only charged you a fraction of the total cleaning charge. This is especially noteworthy as furniture was left in the building which we had to pay to remove.

In regards to the electricity bill, you are responsible for your own electricity bill per the terms of your lease. We are not aware of any agreement between you or the owner regarding a $20 credit.

Please discuss the $20 electricity credit and cleanliness of the duplex when I moved in with the owner, ****** ******* **** Please discuss the electrical wiring (and me supplying electricity to my neighbor) with the electrician that you hired.
